The founder and CEO of a fitness business in Phoenix says he intends to file a lawsuit against Governor Ducey in response to his executive order closing select businesses.The executive order said that as of 8 p.m. Monday night, gyms, bars, waterparks and tubing areas will all have to close to try to help slow the spread of the coronavirus.Tom Hatten, Mountainside Fitness CEO, said during a press conference Monday that the governor’s move is "arbitrary" and lacks clarity.“If this is truly as bad as we are being told, I don’t think health clubs closing tomorrow is going to solve the problem. I don’t think tubing is going to solve the problem,” Hatten said. “I don’t think closing a movie theater that hasn’t been open is going to solve the problem.”Hatten also called for unity from the governor, saying that if the governor is serious about coronavirus, the executive order shouldn't be limited to bars, gyms, and movie theaters.A representative for Mountainside Fitness says several other large gyms are taking part in the lawsuit as well, though that has not been confirmed with the other gyms.Dozens of members showed up to work out at Mountainside Fitness as soon as it opened Tuesday morning.Those like John Kiesewetter say they agree with the CEO's reasoning to remain open if other businesses aren't also forced to close. He says regular physical activity puts them in a better position to beat the virus."It seems to be unfair that things like casinos are still open but gyms, they are not. The fog hangs heavy over Great Bay along the New Hampshire seacoast on a raw as Josh Carloni and his wife, Jessica, emerge through the mist on their fishing boat.They are the owners of Rising Tide Oyster Company, a family-owned business that typically sells thousands of oysters a year to restaurants across New England. But when the novel coronavirus hit back in March, their sales disappeared overnight as restaurants were forced to closed.“Every time you turn on the news, there’s just more bad news out there,” said Carloni. “Our business is down maybe 20 percent.”The Carlonis and oyster fisherman across the country were finding themselves in similar positions. They suddenly had thousands of perfectly healthy oysters that needed to be harvested, but there was no place for them to go.“Oyster farmers had been growing these oysters for three years, and suddenly, they didn’t have a market at all. The pandemic hit oyster farmers across the country hard,” explained Alix Laferriere, who serves as the Marine and Coastal Director for the Nature Conservancy of New Hampshire.Laferriere and her team thought there was little they could do to help struggling oyster farmers until a few months ago when an anonymous donor gifted a million donation.With that sudden infusion of cash, Laferriere and her team got to work. With help from the Pew Charitable Trust, they developed the Supporting Oyster Aquaculture and Restoration (SOAR) initiative to buy back five million oysters that needed to be harvested. The program is being deployed in seven states: Maine, New Hampshire, Massachusetts, New York, New Jersey, Maryland and Washington state.But it’s not just helping fisherman’s bottom line, it’s also helping estuaries and reefs at the bottom of the ocean.Turns out oysters don't just taste good; they can do good for the environment. That grant bought back 10,000 of Josh Carloni's oysters. And he isn't just throwing them into the ocean. Laferriere and her team have strategically told him where they should be deployed across the Great Bay Estuary along New Hampshire's coast. Eventually, the oysters will latch on to reefs below and help restore the damage done by decades of overharvesting, pollution and disease.“It’s this win-win opportunity where we get to put oysters back in the bay and help our local oyster farmers,” explained Briana Group, who also works with the Nature Conservancy of New Hampshire.One adult oyster can filter up to 30 gallons of water a day, and when they’re filtering that water, they’re removing nitrogen from the ecosystem.While the program is giving fisherman an infusion of cash, it’s also giving reefs and estuaries across the country an infusion of clean water, courtesy of a 3-inch mollusk.“There’s nothing bad about this situation; it’s only good,” Laferriere said as she looked out over the ocean.For fisherman like Josh Carloni, the program means he gets to keep his business afloat for another year, while at the same time, giving back to the environment. And it’s all because of COVID-19.“It makes us feel really good about doing something good for the environment,” he said. 3134

The budget-priced Motel 6 chain is well known for the enduring tagline: "We'll leave the light on for you."But some Phoenix immigration attorneys said employees of the motel chain also have been shining a light on undocumented guests, providing guest information directly to US Immigration and Customs Enforcement agents.Motel 6, in response to a report this week in the Phoenix New Times, said employees will no longer work with immigration agents.The weekly newspaper reported that federal immigration agents arrested at least 20 people at two Motel 6 locations in the Phoenix area between February and August. Motel employees told the New Times they regularly delivered guest lists to ICE."This was implemented at the local level without the knowledge of senior management," the hospitality company tweeted Wednesday night. "When we became aware of it last week, it was discontinued."A Motel 6 statement on Thursday confirmed "certain local Motel 6 properties in the Phoenix area were voluntarily providing daily guest lists to Immigration and Customs Enforcement.""To help ensure that this does not occur again, we will be issuing a directive to every one of our more than 1,400 locations nationwide, making clear that they are prohibited from voluntarily providing daily guest lists to ICE."The company was reviewing practices to "help ensure that our broader engagement with law enforcement is done in a manner that is respectful of our guests' rights," the statement said."Protecting the privacy and security of our guests are core values of our company," the statement said."Motel 6 apologizes for this incident and will continue to work to earn the trust and patronage of our millions of loyal guests."Phoenix immigration attorney Ray Ybarra Maldonado said one of his clients, Alfonso Gutierrez Tovar, was taken into custody by ICE agents at a Motel 6 in May. Gutierrez had returned to the United States illegally from Mexico after a previous deportation. He was deported again last month."One of the obvious questions to me was, 'You didn't commit a new crime, so how did ICE know you were at this Motel 6?" Ybarra said.Ybarra said ICE agents knocked on the motel room door one day after Gutierrez had checked in. They asked for him by name, handcuffed him and put him in the back of a car."Then he saw them knock on four other doors and get people as well," the attorney said. "At that point it's kind of like, OK something fishy is going on here."Another attorney, Robert McWhirter, said a client named Jose Eduardo Renteria Galaviz, an undocumented immigrant from Mexico, was picked up at a Phoenix Motel 6 and is awaiting deportation. He, too, had been previously deported."I won't stay at a Motel 6 again," McWhirter said. "Here's the thing -- you don't have a right of privacy on your signature on a register ... Motel 6 is in the business of renting hotel rooms. They (shouldn't) care about immigration status."Yasmeen Pitts O'Keefe, a spokeswoman for ICE's Phoenix division, declined to reveal specifics about enforcement leads. She said those sources include other law enforcement agencies, relevant databases, crime victims, and leads from the public via agency tip lines."It's worth noting that hotels and motels, including those in the Phoenix area, have frequently been exploited by criminal organizations engaged in highly dangerous illegal enterprises, including human trafficking and human smuggling," she said in a statement.Phoenix Police spokesman Sgt. Jonathan Howard said the department sometimes gets hotel and motel guest lists through "informal contacts."Civil liberties groups criticized the Motel 6 practice.The American Civil Liberties Union of Arizona tweeted: "Will new policy reflect this "discontinued" practice, @motel6? The FBI issued a warning on Wednesday alerting Americans to scammers using the coronavirus to solicit donations for fraudulent charities.Federal law enforcement officials say they have received reports that scammers are using the pandemic to steal money, personal information or both.The FBI says that often, the fraudsters will use the name of a real charity to conduct their scam. The FBI adds that criminals may spoof their caller ID number to make it appear the call originated from a legitimate charity.“Be careful,” the FBI said.The FBI offered the following advice to Americans:The best way to protect yourself is by doing your research. Here are some tips on how to avoid becoming a victim of a charity fraud:Do your homework when it comes to donations, whether you’re donating through charities, social media, or crowdfunding websites.Look for online reviews of charity organizations or use information from your state’s regulator of charities or from websites like the Better Business Bureau, give.org, charitynavigator.org, or charitywatch.org to check on the legitimacy of charitable organizations.Before donating, ask how much of the donation will go toward the program or cause you want to support. The City of Columbus took down a Christopher Columbus statue from in front of City of Hall on Wednesday, removing what Mayor Andrew Ginther called a symbol of “patriarchy, oppression and divisiveness.”Ginther announced the decision to remove the statue on June 18."That does not represent our great city, and we will no longer live in the shadow of our ugly past,” Ginther said. “Now is the right time to replace this statue with artwork that demonstrates our enduring fight to end racism and celebrate the themes of diversity and inclusion.”The statue, which was a gift from the people of Genoa, Italy, in 1955, will be placed in safekeeping at a secure city facility. The city asked the Columbus Art Commission to launch a community-driven process that embraces diversity.
