SAN DIEGO (KGTV) - As businesses continue to reopen, it's becoming the newest requirement for entry: your signature.Step into any of three Gila Rut salons in the county, and you'll see COVID-19 safety is being taken seriously. Clients' temperatures are taken. Their hands are sanitized. Their personal effects are placed in a bag. In another bag is everything needed for their appointment, from combs to scissors."So they can feel comfortable that when they sit down, everything has been sanitized for them," said Gila Rut President Keri Davis-Duffy.Inside the salon: masks, social distancing, and capes disposed of after each appointment. The owners are intent on protecting clients, staff and also, the business. A day head of an appointment, clients are emailed a waiver."They have to sign a waiver releasing Gila Rut of any liability should anybody contract COVID-19," said David-Duffy.Davis-Duffy is hardly alone. At the Point Loma Sports Club, set to open Friday, a liability waiver is also required before you can enter. Across the county and country, at salons, gyms, offices and even the New York Stock Exchange, waivers are quietly becoming the new normal. It's unclear how much they're really needed. Attorneys tell us it would be hard to prove a business caused an illness. and the waivers don't protect a business against 'gross neglience.'"If someone signs a waiver, that means they agree not to hold someone else responsible for any damages. What we're seeing here are businesses trying to avoid liability when a patron is exposed to covid-19 at their place of business. Waivers are not, however, ironclad. For a business to be protected, the business must show that such a waiver was signed and that it covers the potential claim. Even if a business shows that, a waiver is invalid if the business was grossly negligent or reckless. Also, a person could challenge a waiver by claiming it was signed under duress or that it was unconscionable," said attorney Evan Walker.For Davis-Duffy, the waiver is simply another precaution."We're in a vulnerable business ... We just want to make sure we're protecting are business and create some sense of sustainability," said David-Duffy.Davis-Duffy says all but a handful of clients have agreed to sign the waiver. 2279

SAN DIEGO (KGTV) - Civil right activists and lawyers are hoping the court system can force San Diego County law enforcement agencies to change the way they deal with protests.On Thursday, a group of lawyers announced a half-dozen claims and lawsuits against the La Mesa Police Department, San Diego Police Department and the San Diego County Sheriff's Department for what they call unnecessary use of force during recent protests.Dante Pride represents four of the claimants, including Leslie Furcron, the woman hit in the head by a bean bag round fired during a protest outside La Mesa police headquarters on May 30.Pride said Furcron suffered multiple fractures in her face, has no vision in her left eye, has problems walking, has problems remembering, and difficulty with balance.RELATED: Woman shot with bean bag round in the face during La Mesa protest makes public statement"All because she decided to come out, as she is entitled to do, and protest," said Pride.Pride’s other clients have injuries ranging from broken fingers to severe cuts and contusions from being hit by what officers call "less lethal" rounds."The manner in which these things were used, shot indiscriminately into crowds, these are lethal methods being used," said Pride.Other claims stem from protests across the city in the days that followed.Gerald Singleton said his two clients are the "epitome" of peaceful protesters, who were simply standing in the crowd when they were hit by what he calls "rubber bullets.""Anybody who embraces this movement is, unfortunately, under the current police culture, viewed as an enemy, and they're treated accordingly,” Singleton said.RELATED: La Mesa woman hospitalized following protests, family saysThe claims ask for monetary damages to cover medical expenses. They also call for sweeping changes to police tactics and the end of any use of force that could "escalate" an encounter."The recent conduct of local law enforcement agencies has sparked the need for systemic change," said San Diego ACLU President David Loy. "Instead of lashing out against demonstrators, law enforcement should be listening to them and hearing their concerns."The San Diego Police Department says due to the litigation they do not have a comment. A spokesperson for the La Mesa Police Department tells 10News, "The La Mesa Police Department cannot provide comment relating to any pending litigation. We encourage any member of the public that believes they suffered injury as a result of force used by any of our officers to contact us so that their incident can be investigated." 2590

SAN DIEGO (KGTV) -- Before the sun rose Friday, cars already packed parking lots at San Diego beaches to kick off Labor Day weekend and what's expected to the some of the hottest days of summer.However, San Diego County leaders said no matter where you are this weekend, they want to emphasize people must still follow CDC guidelines to prevent the spread of COVID-19.ABC 10News was at La Jolla Shores on Friday morning as beachgoers wearing masks secured spots far enough to stay socially distanced.Beachgoer and Santee resident Kris Moberly, “We know we can find a spot if we come early."It's the new norm, but also a way to ensure San Diego stays off the state's watchlist after just getting off of it two weeks ago.Moberly said she hopes everyone will follow the rules this weekend, telling ABC 10News, "I'm sure there's people who push the limits but you're responsible for your own health and I think most people are considerate of others."San Diego Lifeguards said they won't be regulating when it comes to social distancing or masks."We're going to be focused on keeping people safe in the water, but social distancing is everyone's responsibility,” a lifeguard told ABC 10News.County Supervisor Nathan Fletcher said the status of our county depends on people's actions this weekend. In a press conference earlier this week, he said people should avoid indoor parties and continue to follow CDC guidelines.To ensure added safety, beaches like Carlsbad will also be handing out masks and teaching visitors about safety guidelines.Lifeguards said in addition to COVID-19 restrictions, the heat will also be a big safety factor. SAN DIEGO (KGTV) - Cockatiels rescued from unsanitary conditions in a Rancho Bernardo apartment are now available for adoption, the San Diego Humane society announced Tuesday. Humane Society Law Enforcement Officers seized more than 80 birds from one unit Jan. 23. They were flying freely through the home, creating an unhealthy situation, shelter officials said.Veterinarians cleared the birds for adoption. The cockatiels will need socialization and time to adjust to their new homes, according to the Humane Society. SAN DIEGO (KGTV) — Construction has started on Mission Valley's first public elementary school.The new preschool through 5th-grade campus at the corner of Via Alta and Civita Boulevard will serve residents living in the Civita residential development. Families living in the Mission Valley and Fashion Valley neighborhoods will also make use of the new school.The campus will feature classrooms with roll-up doors that open to the outside for 1st- through 5th-grade students; dedicated play areas for preschool, kindergarten, and 1st- through 5th-grade students; "makerspaces" for students; and an indoor-outdoor multipurpose facility.San Deigo Unified School District provided a virtual walkthrough of the campus here."With more significant growth planned in the area, we must prepare for the influx of new families and students," said Dr. John Lee Evans, Board of Education President. "This community deserves a quality neighborhood school."The campus will enroll up to 500 students and construction is expected to finish in spring 2022.The new school is funded through 2012's voter-approved Proposition Z bond measure, state schools facilities funding, and developer fees, according to San Diego Unified School District. 1231
