SAN DIEGO (KGTV) — A pedestrian was struck and killed by a vehicle while on Interstate 5 late Sunday.The pedestrian was on southbound I-5, just north of Cesar E Chavez Parkway, just before 11 p.m. when a vehicle struck and killed the person, according to the California Highway Patrol.Several vehicles hit the person after the initial crash, CHP added.CHP said it's unclear why the person was on the freeway and whether drugs or alcohol were a factor in the collision.I-5 was closed between Cesar Chavez Parkway and Logan Avenue while CHP investigators responded. The collision was under investigation as of Monday. 623

SAN DIEGO (KGTV) — A man who is accused of falling asleep drunk with a lit cigarette, starting a Rancho Bernardo fire that killed his two children in 2017, has been sentenced to nearly 13 years in prison.Henry Lopez was convicted last September of involuntary manslaughter, child endangerment, and recklessly starting the fire that killed 7-year-old Isabella and 10-year-old Cristos.Wednesday, victim impact statements were read aloud — including a statement by Lopez — before the judge sentenced Lopez to 12 years and eight months behind bars.“[The] defendant has completely and utterly failed to accept the consequences of his actions. These horrible deaths were completely avoidable. The defendants actions caused a lot of pain. Prosecutors say Lopez fell asleep with a lit cigarette that likely made contact with a defective cell phone, sparking the blaze. Lopez woke up to find his home on fire and tried to escape but passed out from the smoke, fire investigators said.His two children died in the blaze. Investigators say Cristos was burned to death and Isabella passed out from smoke inhalation and never woke up.Throughout the sentencing hearing Wednesday, heated moments erupted from Lopez's ex-wife and even one of the jurors."I told you if you continued on this path of reckless behavior something bad was going to happen. SAN DIEGO (KGTV) — A new report by the San Diego Food System Alliance, expected to be released in January, calls for major changes to how food is produced and distributed across the county. The findings suggest that many neighborhoods are disadvantaged by limited access to fresh, healthy food.“Our goal here is to unite people behind cultivating a healthier, more sustainable, and more just food system," said Alliance spokesperson Margaret Chiu.Chiu suggests a significant solution would be less reliance on large corporate food system suppliers, and more access to locally farmed and sourced foods. “We want better grocery stores. we want community gardens or we want access to places where we can grow our own food," Chiu said.She says the whole community benefits when it is easier to turn blighted properties into urban farming or community gardens.The Alliance hopes to work with county and city leaders to make their suggestions into policy. "I’m very hopeful that that will be the case with this study, that we will continue to have the political will to push it forward to make San Diego everything that we say that we are," said San Diego City Councilmember Monica Montgomery Steppe. 1202

SAN DIEGO (KGTV) — A judge has issued a temporary restraining order against the City of San Diego, barring them from removing pepper trees in Kensington.The trees are more than 100 years old, planted when the neighborhood was first marketed as a housing development in the early 1910s. While the neighborhood was once filled with them, resident Maggie McCann estimates there are only about 33 left.“I think they are pretty looking,” said McCann. “They’re part of the fabric of the neighborhood.”McCann was one of the residents who filed the TRO against the city. She said she has been working for more than a year to designate the remaining pepper trees as “Heritage Trees” and “Parkway Resource Trees” under the City’s Conserve-a-Tree program.When she heard a pepper tree on the 4500 block of Edgeware Road had been cut down on Monday, she rushed to process the TRO.“We don’t know why these trees are being cut down,” said McCann.McCann suggested it may be related to a plan to bury SDGE utility lines in the neighborhood, but the City of San Diego denies that claim.In a statement to 10News, a city spokesperson said the tree that was cut down Monday had been “evaluated more than a year ago as part of a project to repair a damaged and uneven sidewalk caused by the tree’s growth. Noticeable decay and deteriorating tree structure were also observed during the evaluation and the adjacent property owner was notified at that time.”On Tuesday, the remnants of the trunk remained on Edgeware Rd. Decay could be seen in the interior part of the tree, though much of the large trunk appeared to be healthy.“The tree really didn’t need to be removed,” argued McCann.But the city said their decision was more about damage to the sidewalk than whether the tree could have survived a few more decades.“In this instance, the imperative to make the sidewalk safer for residents was weighed against the city’s desire to preserve neighborhood trees and continue to grow our urban canopy. Due to the tree’s damaging impact to the adjacent sidewalk and its decaying state, the decision was made to remove it in order to preserve public safety,” wrote the city spokesperson.A resident on the block said the sidewalk had been recently replaced. The new pavement had been cut around the tree and was undamaged.Several other pepper trees in Kensington have been marked for removal. On Tuesday, McCann walked the streets, posting copies of the TRO on the trees.The fate of those trees remains unknown. A city spokesperson said, “the city looks forward to working with the community and Council office on this matter.” A court hearing on the TRO is scheduled for Feb. 7. 2661
