SAN DIEGO (KGTV) -- San Diego City Attorney Mara W. Elliott has heard complaints from neighbors and has filed a civil enforcement action to shut down a short-term vacation rental property in La Jolla that has been dubbed a "COVID party mansion."The complaint alleges that defendants are maintaining a public nuisance and engaging in unfair competition, including false advertising at the La Jolla Farms rental property located at 9660 Black Gold Rd. According to city officials, the rental property continues to operate in violation of state and county COVID-19 public health orders.According to a press release, Elliott is seeking civil penalties and a permanent injunction against property owners Mousa Hussain Mushkor and Zahra Ali Kasim, property manager Nital Meshkoor, and Steven S. Barbarich, who leased the property from Mushkor and subleased it as a short-term rental.City officials said the oceanfront mansion has been the subject of at least 30 calls to the San Diego Police Department. Officers have spent more than 173 hours at the property to investigate nuisance activity. Most of the incidents involved raucous parties, some of which had up to 300 attendees.Elliott said about a dozen of the party complaints came during the COVID-19 pandemic, while public health orders prohibited large gatherings.According to the press release, concerns about the property were brought to the City Attorney’s Office by San Diego police and by neighbors who reported that the situation was "becoming more pronounced as the COVID-19 pandemic progressed." “Shutting down dangerous party houses protects the public health by preventing COVID super-spreader events and other illegal behavior,” Elliott said. “It’s unfortunate that San Diego does not have short term rental regulations in place. Relief for this neighborhood would have come much sooner. Instead we must rely on time-intensive prosecutions at significant taxpayer expense.”According to the press release, gunfire was reported to police during a party in May of 2019. Officers arrived and found a large party in progress. Partygoers questioned by police admitted gunshots were fired during a fight that had occurred earlier. Police found shell casings outside the property and a neighbor found an additional casing the next day and turned it over to police. The City Attorney's Office assembled evidence from investigations by SDPD, the Code Enforcement Division of the City’s Development Services Department, the County Health & Human Services Department, and the City Fire Marshal. SAN DIEGO (KGTV) - San Diego is getting its first round of Pfizer vaccines to fight the coronavirus next week, but the vaccine is recommended for those 16 years and older.Many parents are concerned about what that means for their children and going back to school."Essentially the Pfizer vaccine wasn't studied in kids under 12 but we are going to see more study in them," Dr. Abi Olulade, with Sharp Family Medicine said.While Pfizer is working on a child-safe vaccine, their competitor Moderna started testing their vaccine on 12-17-year-olds Thursday.Dr. Olulade sees the newly approved Pfizer vaccine as a lifeline, "we have a weapon now in the war against this virus and we're all breathing a huge sigh of relief."The vaccine a relief for our healthcare system swamped with coronavirus patients.When a shot is approved and safe for kids, Dr. Olulade said it's important parents have their kids vaccinated."Vaccines have a very long and proven safety record in kids," Dr. Olulade said. When asked what is the risk of waiting to get your child vaccinated, she replied, "death and long term effects of COVID, overwhelming our healthcare system and preventing us from providing care for other conditions that don't just stop because of COVID and so I think everyone should really really think about making sure that they get vaccinated to protect all of us."She said it's important also to get children vaccinated because they are proven super-spreaders of the virus and susceptible to harm from it."We just saw in Los Angeles the first child that died from Multisystem Inflammatory Syndrome which is a really scary thing that is new with this virus," Dr. Olulade said.Dr. Olulade said we will have to wait and see if schools require the vaccine moving forward.If your child has allergies, she said make sure you talk with your doctor before vaccinating your child."To say that this is a breakthrough and a victory for science is probably an understatement," Dr. Olulade said about the vaccine.A weapon, she said, is only helpful if we all use it, "when you get vaccinated, you're not just protecting yourself, you're protecting other people and children who may be going through really terrible things like cancer, so it's our responsibility that we all have to protect those who are more vulnerable." 2311

SAN DIEGO (KGTV) - Restaurants are feeling backed into a corner after the pandemic forced them to add outdoor seating and Saturday brought cold rain and high winds.As the clouds rolled in, businesses across San Diego braced for impact."We were planning on covering everything up but we were kind of waiting and seeing just how big the storm was going to be," Whiskey Girl Manager Jake Southworth said.In the Gaslamp, he says they've been lucky this weekend, "We were ready to go with more of the tarps, to put out but waited till midnight when we were closed anyway, so definitely dodged a bullet there and today again it looks like it's going to hold off until later so I feel like we're still going to be doing good."Whiskey Girl is on a section of Fifth Avenue that shuts down to vehicle traffic Thursday through Saturday, allowing restaurants to spill into the street and seat more customers.The extra chairs help them stay afloat, but outside the rain and future winter weather are putting a damper on their options.Some businesses put up pop-up shades and umbrellas to provide some shelter against the weather."I mean it does open a lot more seating having outside but we'll see what the weather sends us," Southworth said.Every restaurant is also holding its breath, waiting to see if the county drops into the purple most restrictive tier next week, which would mean no indoor dining at all."How can I ask someone to spend, you know - on a drink if they're sitting outside shivering and the rain's coming through?" SAN DIEGO (KGTV) - San Diego Police identified Monday the man shot and killed in the Shelltown neighborhood. Ricardo Moran, 49, was identified as one of two men who was shot on S. 42nd Street Saturday at 1:35 a.m. Officers received multiple 911 calls about gunshots. When they reached the scene, they found Moran and an unidentified 56-year-old man suffering from injuries. Witnesses heard a vehicle speeding away following the gunshots but were not able to provide a description. Moran died at the hospital. The second victim is expected to survive, police said.
