SAN DIEGO (KGTV) -- A new report from the Auto Club ranks San Diego as the top travel destination for Southern Californians this Labor Day weekend.According to the report, Las Vegas, San Francisco, Grand Canyon and Santa Barbara also rank among top travel destinations for Southern Californians. The Auto Club is also warning San Diegans not to drink and drive. According to AAA, 31 people were injured in DUI-related crashes last year over Labor Day weekend.Statewide, eight people were killed in DUI crashes last year. “While alcohol-related crash fatalities have dropped in the last three years over this holiday, injuries have risen,” said Auto Club Traffic Safety Manager Anita Lorz Villagrana.“We want to remind everyone to make a plan before celebrating – use a rideshare service, stay at a hotel or someone’s home, or designate a sober driver. SAN DIEGO (KGTV) -- A new apartment complex in Pacific Beach is gearing up for its opening, but residents can expect to pay top dollar for all the bells and whistles offered by the complex. The Jefferson, a 3 million complex, is located just off I-5. According to its website, studio apartments range from ,478 to ,617. The largest apartments in the complex with three bedrooms and 2.5 bathrooms range from ,987 to ,103. Those prices are much higher than the typical apartment in Pacific Beach, according to Zillow. Zillow’s rental map shows prices in Pacific Beach ranging from ,425 for a studio to more than ,850 for a three bedroom. Between those two price points, Zillow shows 152 apartments available for rent. One rental manager who spoke with 10News says The Jefferson may have a difficult time finding tenants at those prices. “Tenants, prospective tenants, they're educated. They educate themselves and they do comparative shopping. So if it's too high, you're going to sit empty,” said Jim Vosacek, who runs Western Hills Real Estate Management. While there are currently no other new, luxury developments like this in the area, this development will offer residents a quality, high-end lifestyle that has not previously been available. SAN DIEGO (KGTV) -- A previously-deported sex offender who tried to enter the U.S. illegally was arrested Sunday by Border Patrol agents.On July 5 around 1:30 a.m., agents patrolling the U.S./Mexico border near Tecate saw three people enter the U.S. illegally, the agency said.All three men were arrested and, after fingerprinting all three, a records check revealed that one of the men, a 33-year-old Mexican national, had been convicted for sex crimes against a child.According to the agency, the man had been convicted in 2006 of lewd acts upon a child and sentenced to 10 years in prison. He was removed from the U.S. in 2014.The man is currently being held in federal custody pending charges for felony illegal re-entry after deportation, Border Patrol says. 771
SAN DIEGO (KGTV) — A San Diego High School teacher said she warned her school administration about the behavior of a former teacher nearly a year before he was arrested.According to a recently filed lawsuit, Vanessa Montgomery alleged Juan Carlos Herrera engaged in a continuous course of sexually harassing conduct. The lawsuit states, "On a near-weekly basis, Herrera made comments about Ms. Montgomery's dress, looks, and body."Herrera, formerly a special needs curriculum instructor, was sentenced to 10 years in state prison earlier this month. In August, Herrera pleaded guilty to 11 felonies, including lewd acts on a child and assault. Montgomery said she first met Herrera in 2016. She was new on campus."I was basically just trying to survive and learn things along the way," Montgomery explained.Montgomery said she had her first uncomfortable encounter with Herrera just a few months on the job."I just want to let you know that the dress you're wearing and the outfit you have looks really good, and it hugs your body really well," Montgomery said Herrera told her.Last week Montgomery filed a lawsuit against Herrera and the San Diego Unified School District alleging sexual harassment and failure to prevent sexual harassment.Based on the lawsuit, "Herrera's sexually harassing comments included: Remarks that Ms. Montgomery's clothes made her 'curves look good;' remarks that Herrera would do anything for Ms. Montgomery as long as she wore 'those shorts;' and a comment and attendant gesture suggesting Ms. Montgomery needed to hold her chest when walking down stairs to stop her breast from bouncing."Montgomery shared with Team 10 Investigator Adam Racusin that she felt "very uncomfortable all the time," around Herrera.Montgomery said words eventually escalated to touching. In her lawsuit, she described an occasion where she spilled coffee on her shirt. She states Herrera took a toothpick out of his mouth and pushed on her breast where the stain was located with his toothpick."He took it out, put it back in his mouth and winked at me, smiled and walked away," she said.Montgomery said she took her concerns to her supervisor, the vice principal at the school. She said she had a face-to-face conversation and also sent an email in May 2018.According to the email obtained by 10News, Montgomery wrote, "I would like to inform you about some issues that have occurred in the last couple of years with Juan Herrera. I have decided to report sexual harassment against Herrera."The email described four incidents in three years.In the email she also detailed Herrera's interactions with female students, writing, "Herrera always has a group of young girls around him. He pulls them out of class to offer support which makes me wonder what has he said to them. He is normally in a classroom with the girls and without another teacher. I know he means well but the comments that I have shared above make it hard to trust him."That email was sent nearly a year before Herrera was arrested."He'd be working with groups of girls in classrooms alone with the door closed," Montgomery said. "I witnessed that multiple times."Prosecutors said Herrera assaulted an unnamed victim "on almost a daily basis" between February 2018 and March of this year, when the girl was 15 and 16 years old. He was arrested in May 2019. "The HR (human resources) office had no documents related to complaints that were made by Ms. Montgomery and they had no intention of investigating any of those complaints, and that was even after Mr. Herrera was arrested," Montgomery's attorney Andrew Hillier said.Hillier said when an organization becomes aware that an employee has reported sexually harassing behavior, the organization has a responsibility to investigate. He said they also have to take some sort of temporary remeasures to ensure it stops and if its warranted take permanent measures."The allegation is sexual harassment of course, but it's also a failure on the part of the district to step in once they became aware of the harassment," Hillier said.According to the lawsuit, the district did not interview Montgomery. "To Ms. Montgomery's knowledge, SDUSD did not interview anyone in relation to her complaint. SDUSD did not make Ms. Montgomery aware of any temporary or permanent remedial measures the district put in place to address Herrera's harassment," the lawsuit stated.Montgomery said the harassment continued until Herrera was arrested.A spokesperson for the school district didn't answer any of our questions about Montgomery's allegations. SAN DIEGO (KGTV) — A non-profit organization held a first-of-its-kind seminar to teach law enforcement officers, first responders, and legal professionals how to understand and handle incidents involving people with intellectual and developmental disabilities. More than 100 individuals representing a variety of agencies, including the San Diego Police Department, Chula Vista Police Department, and the public defender's office attended the Arc of San Diego's "Pathways to Justice" training at the Handlery Hotel in Mission Valley. In recent years, law enforcement agencies from across the country have been under attack about their handling of cases involving witnesses, victims, and suspects with disabilities. Arc of San Diego hopes to bridge the understanding gap. On April 30, 2015, San Diego Police officer Neal Browder responded to a call about a man reportedly wielding a knife. He rolled into the alley with no lights, sirens, nor was he wearing a body camera. But a nearby surveillance camera caught the entire encounter. Within three seconds of opening his door, Browder fatally shot the man, Fridoon Nehad. It turned out, Nehad was an unarmed, mentally disabled man. Since this incident, the American Civil Liberties Union has questioned the officer's use of lethal force. Would this have happened if San Diego Police officers had the proper training?The Arc of San Diego hopes this never happens again, which is why they invited agencies to join their training seminar."We want to help first responders have a better understanding of what it is to interact with people with intellectual and developmental disabilities," Arc of San Diego CEO and President Anthony Desalis said.San Diego was chosen as one of four cities nationwide to run this three-pilot program. The others are Monmouth County, New Jersey, Loudoun County, Virginia, and Columbia, South Carolina. The program includes this one-day seminar where each department will create its own Disability Response Team. Finally, the departments will hire disabled individuals as intern cadets through the "Growth Through Opportunity" program. "That gives the officers at those stations a chance to interact with someone who has a disability," SDPD Sgt. Jonathan Lowe said. While his primary assignment is recruiting, he is also the Chief's Liaison for the Disabled Community. So how do you deal with a situation like Nehad's? Experts say step one is to be patient. "Don't automatically assume they are somebody who is drunk or somebody who is on drugs," Desalis said. "It may just be that it takes a moment to process what you're saying to them."Giving that person that extra moment could be the difference between life and death."No situation is ever going to be perfect in the field," Sgt. Lowe said. "But at least we can do our best to be proactive about training our officers the right way." 2871
