SAN DIEGO (CNS) - Rep. Scott Peters, D-San Diego, Friday called on the federal government to determine and commit to an interim and long-term plan for nuclear waste storage.Peters challenged the rest of the federal government to find a storage solution during a meeting of the House of Representatives Energy and Commerce Committee's Environment and Climate Change Subcommittee.The subcommittee, on which Peters sits, held a hearing on three bills that would establish a process to send spent nuclear fuel rods from decommissioned plants to designated storage areas around the country. To do so, Peters said the government should invoke the Constitution's supremacy clause, which requires states to follow federal law if they have conflicting statutes.``There's not a lot of enthusiasm among the states to accept any defined or undefined amount of nuclear waste. There just isn't,'' Peters said.``To me ... the magic of federalism is the supremacy clause and the ability of the federal government to ... (say) in this geology, per this engineering, (and) through this licensing process that this risk is lower.''Two of the bills the subcommittee considered -- the Spent Fuel Prioritization Act and the Storage and Transportation of Residual and Excess Nuclear Fuel Act -- would directly affect San Diego County by relocating spent nuclear fuel from the defunct San Onofre Nuclear Generating Station to designated storage sites like Yucca Mountain in the Nevada desert.The plant shut down in 2012, but nearly four million pounds of spent fuel cells remain buried under the plant in a temporary storage facility about 100 feet from the Pacific Ocean. The plant sits approximately 60 miles or less from both San Diego and Los Angeles and the storage facility continues to be susceptible to a major earthquake or significant sea level rise.The bills remain in limbo due to pushback from legislators who represent the districts in which spent fuel rods would be stored.However, Peters' office hopes the bills could get a vote out of the committee by the end of the year. 2073

SAN DIEGO (CNS) - San Diego City Attorney Mara Elliott was celebrating a reelection victory Wednesday, following a dominant performance over private attorney Cory Briggs."When I was elected four years ago, I pledged to put the people of San Diego first, and that's just what we've done," Elliott said in a statement Tuesday night claiming victory in the race."With the help of our terrific team in the City Attorney's office, San Diego is a leader in reducing gun violence, helping domestic violence victims, and holding corporate polluters accountable. We moved quickly to protect public health during the pandemic and we've made it a priority to safeguard taxpayer dollars. I'm humbled and grateful that the people of San Diego have placed their trust in me to fight for them for another term."Elliott has been city attorney since 2016, and since then has taken an uncharacteristically proactive approach to the role, sometimes ruffling feathers, such as with the Smart Streetlights program. In August, members of the San Diego City Council boycotted a meeting with Elliott over restrictions on sensitive documents.Briggs has sued the city dozens of times, ostensibly to increase transparency at City Hall. He said during the campaign he wanted to remove petty politics from the office."As someone who has spent nearly two decades fighting special interests at City Hall, I believe now's the time to bring my training, experience and taxpayers-first approach to the City Attorney's Office," he said.Elliott pointed to Briggs' many lawsuits as reasons she is more fit for the office.The pair have faced off in court during the election cycle. Elliot sued Briggs for identifying himself as a taxpayers' advocate, while Briggs sued Elliot for claiming an endorsement from the San Diego Union-Tribune after it expired. Briggs prevailed in both cases.The city attorney serves as the city's prosecutor and legal adviser.Meanwhile, San Diego voters weighed in on a trio of ballot measures:-- Voters rejected Measure A, a housing bond that would have allowed the city to issue up to 0 million in bonds to fund low-income, substance abuse, and mental health service housing. It required two-thirds of the vote to pass, but initial tallies showed it with only 57%.-- Voters approved Measure B, which amends the city's charter to replace the Community Review Board on Police Practices with the Commission on Police Practices, which will be appointed by the City Council to conduct investigations and subpoena witnesses and documents related to deaths resulting from police interactions and complaints made against police officers.-- Voters also approved Measure E, providing an exception to the city's long-standing 30-foot height limit in the Coastal Zone for the Midway- Pacific Highway Community Plan. SAN DIEGO (CNS) - San Diego-based medical equipment manufacturer ResMed Corp. has agreed to pay more than .5 million to resolve allegations that it paid kickbacks to suppliers, sleeps labs and other health care providers in exchange for referrals and prescriptions for its products, the Department of Justice announced Wednesday.The government accused ResMed of violating the Anti-Kickback Statute of the False Claims Act by providing free or below-cost medical equipment to companies in several states. Court documents state that ResMed's products -- which treat sleep apnea and other sleep disorders -- were provided to companies that in some cases began writing prescriptions to their patients entirely for ResMed equipment.Prosecutors say some examples of ResMed kickbacks included free home sleep testing devices, free or below-cost positive airway pressure masks and diagnostic machines, and free telephone call center and patient outreach services that allowed the companies to order resupplies for sleep apnea patients.RELATED: San Diego suing SDG&E for allegedly delaying pure water projectThe settlement agreement resolves five lawsuits filed by whistleblowers, who will collectively receive around .2 million out of the total settlement."Paying any type of illegal remuneration to induce patient referrals undermines the integrity of our nation's health care system," said Assistant Attorney General Jody Hunt. SAN DIEGO (CNS) - The City of San Diego began a virtual open house Monday to solicit public input for two potential uses for a vacant lot in the Encanto community.The city is asking the public to consider two redevelopment proposals for the Valencia Business Park located at Stevens Way and Imperial Avenue.Located in the federally designated San Diego Promise Zone, the Valencia Business Park has been vacant for more than 20 years. According to the city, the community-focused redevelopment is moving forward and expected to create at least 72 full-time jobs."For years, the vision for Southeastern San Diego has included activating the Imperial Avenue Corridor and development of the Valencia Business Park property," said Councilwoman Monica Montgomery Steppe. "We are energized to take another crucial step in this process and get vital input from our community on this redevelopment, as we see this vision come to fruition."The first proposal is a campus for the San Diego American Indian Health Center, described as a "wellness-centered community hub" that would account for 150 healthcare jobs, including 75 new ones.The other proposal is the San Diego Energy Equity Campus, a community hub site which proposes to provide educational resources to the underserved Southeast San Diego community.The public can view the proposals and provide feedback by visiting ValenciaBusinessParkInput.org. Public feedback will be collected through Oct. 14.The San Diego Promise Zone is one of 22 Promise Zones throughout the United States and is one of four located in California. More than 80,000 San Diegans live within the SDPZ, which covers a 6.4-square-mile targeted area from East Village and Barrio Logan east to Encanto.According to the city, community input received through the open house will directly impact the evaluation of the request for proposals submissions and help determine which plan will proceed negotiation and development."This is a fantastic opportunity for the surrounding residents, business owners and all community members to voice their preference on the proposals and share their collective vision for the development of this site," said Christina Bibler, director of the city's Economic Development Department.All San Diego residents and business owners are allowed to participate in the virtual open house.
