A federal judge has dismissed several charges against Dr. Jumana Nagarwala in the historic female genital mutilation case, ruling that the federal law against female genital mutilation is unconstitutional.U.S. District Court Judge Bernard Friedman ruled that Congress did not have the power to enact a federal law that banned female genital mutilation in the United States.Instead, Friedman made the argument that the law was too broad and it violated Congress' powers, as the law does not stand up to scrutiny under either the Necessary and Proper Clause or the Commerce Clause of the US Constitution.He also found that laws penalizing Female Genital Mutilation should be handled at the state level, similar to laws regarding Criminal Sexual Conduct, battery or child abuse.  Shannon Smith is the Defense Attorney for Dr. Nagarwala.  She says the ruling is "absolutely a huge victory. When you actually studied the law they enacted, there was no constitutional basis for them to enact the law. It’s really an issue that should be left to the states."Smith also claims the doctors did not perform Female Genital Mutilation, saying instead they performed a mild form of female circumcision."What Dr. Nagarwala was doing, if we had gone to trial, would have been vindicated that she was not mutilating little girls. While we’re happy with the victory and we’ll certainly take it, there’s a part of me that’s a little disappointed that the public isn’t going to see the evidence brought out at a trial to see that she was never guilty of it in the first place," Smith said.The ruling comes after Friedman also dismissed a "conspiracy to transport minor with intent to engage in criminal sexual activity" charge in January. That was the only count that could have lead to life in prison for both Nagarwala and Dr. Fakhruddin Attar.Friedman's ruling leaves two counts in place in the case. A Las Vegas police officer "accidentally" fired his gun in the Mandalay Bay suite where mass shooter Stephen Paddock fired into a crowd at a music festival on Oct. 1.This is according to the sheriff for Las Vegas. He said the officer was not shooting at anything and it did not happen in the same area where Paddock's body was discovered.The sheriff also said that the 32nd floor where the suite is located did not have security cameras facing the gunman's suite or the stairwell.The sheriff spoke to the Las Vegas Review-Journal.In the shooting, 58 people were killed and hundreds more were injured. The shooter's motive is still unknown and the investigation is ongoing. 685

A Glendale, Arizona mother has been arrested after reportedly leaving her toddler in a car for 90 minutes while she went shopping. Glendale police report that around 9 p.m. Monday, they were called to a shopping plaza at 91st and Northern avenues. Witnesses reported to police that there was a toddler in a car with no adult around. Police found the 2-year-old boy, "crying, dirty and covered in urine." The child's mother, 19-year-old Dakota Cheyanne Brown, was located in a nearby store. She allegedly told police that she was in the store for about 45 minutes and was checking on him by looking out the store window. Police say the car windows were darkly tinted and they couldn't see inside, even from a few feet away. Store employees allegedly told police that Brown was in the store for about 90 minutes. Store surveillance video reportedly shows that Brown never left the store to check on her son. Brown was arrested for endangerment and child abuse. 1011

A farm in Indiana is recalling more than 200 million eggs sold in nine states over salmonella fears.Rose Acre Farms voluntarily recalled 206,749,248 eggs due to potential contamination with Salmonella Braenderup, the Food and Drug Administration said in a statement.At least 22 illnesses have been reported so far, the FDA said Friday.The eggs were sold through retail stores and restaurants. They reached consumers in Colorado, Florida, New Jersey, New York, North Carolina, Pennsylvania, South Carolina, Virginia and West Virginia."Consumers with these eggs shouldn't eat them," FDA Commissioner Scott Gottlieb tweeted. "Throw them away or return them to place of purchase for credit or refund."Brands affected include Country Daybreak, Coburn Farms, Crystal Farms, Sunshine Farms and Glenview, with some eggs sold at Walmart and Food Lion stores.Salmonella causes serious and sometimes fatal infections, especially in young children, the elderly and people with weakened immune systems. It is generally contracted from contaminated poultry, meat, eggs and water, and affects the intestinal tract.Chickens can pass the bacteria to eggs because the eggs leave hens through the same passageway as feces. Alternatively, bacteria in the hen's ovary or oviduct can get to the egg before the shell forms around it, according to the US Department of Agriculture's Food Safety and Inspection Service. A California high school student has been charged with two counts of battery stemming from a fight involving a Donald Trump "Make America Great Again" cap, according to KOVR-TVCell phone video of the fight shows a Union Mine High School student confronting and yelling at a fellow student wearing a red MAGA hat in support of President Trump. After yelling at her classmate, she reportedly grabbed the hat off his head and threw it on the ground and left the classroom, according to the El Dorado Sheriff's Office.The student later returned to the classroom and again removed the student's hat. The teacher escorted the girl out of the classroom, and she reportedly slapped him on the arm as he led her out. A school resource officer arrested the girl in the hallway. She was taken to a local juvenile detention center and suspended from school, according to KTXL-TV. The girl was charged with two counts of battery, once against the student with the MAGA hat, the other against the teacher."“…student and staff safety is our highest priority and the UMHS administration will continue to cooperate with the El Dorado County Sheriff’s Office as the incident is being investigated,” the school said in a statement, according to KTXL.Alex Hider is a writer for the E.W.
