SAN DIEGO (KGTV) — San Diego's District Attorney's Office Wednesday says the officer who fatally shot a man who had attacked another person with a machete in Southcrest acted in self defense.After review the case and officer's actions, DA Summer Stephen's office says Officer Corey Pitts, who fired upon Vaughn Denham on Aug. 8, 2018, is not criminally liable for the shooting.Denham, 48, has reportedly attacked another person with a machete during an argument over a dog chain. Pitts used a Taser but it didn't stop Denham, forcing Pitts to retreat for a block and a half while he continued to order Denham to drop the chain and get on the ground.The DA's office added Pitts warned Denham he would shoot if he continued to refuse. Pitts eventually fired two rounds, striking Denham.Denham later died at the hospital. The Stephen's office says a toxicology report showed phencyclidine (PCP), cannabinoids, and methamphetamine in his system."Based on these circumstances, Pitts fired at Denham in his own defense," the office's review states. "He therefore bears no state criminal liability for his actions."In addition to clearing Pitts of any criminal wrongdoing, the DA's office released nearly two minutes of body camera footage from the incident. 1751

SAN DIEGO (KGTV) — Six San Diego inmates had to be treated with an overdose drug this month after deputies say they were showing signs of a fentanyl overdose.The San Diego Sheriff's Department (SDSO) said the overdoses happened just after 4 p.m. on Dec. 4 at San Diego Central Jail. The six inmates were given various doses of the drug Naloxone to reverse the effects of their overdoses.All inmates regained alertness and were taken to a nearby hospital for care.Deputies searched the cells of the affected inmates and discovered pills possibly laced with fentanyl, according to SDSO.The department says it's taking several approaches to stop drugs from entering jails, including x-ray body scanners, screening of visitors who may be smuggling drugs into jails, and overdose awareness and contraband detection techniques.SDSO says that about 70% to 80% of people entering their custody are using drugs at the time of arrest or have committed a crime during drug use. 974

  

SAN DIEGO (KGTV) — Still many unanswered questions after alleged Poway synagogue shooter appeared at his readiness hearing in San Diego Superior Court.The Deputy District Attorney, David Grapilon, said he doesn't know if this will be a death penalty case and can't tell 10News how the 19-year-old legally obtained the gun used during the shooting.In the state case the shooter faces one count of murder, three counts of attempted murder and a count of arson against an Escondido mosque."We have still not received recordings of the witnesses, we expect that there's going to be firearms analysis which will be crucial for this case, we also expect that there's going to be computer evidence involving my client's computer which is going to be very relevant in this case," Public Defender John O'Connell said.The evidence is already extensive, more than 700 pages handed over from the Deputy District Attorney to the defense. More evidence includes surveillance video of the shooting from the time he entered to the time he left the synagogue."The Sheriff's Department did a pretty exhaustive investigation along with the FBI, and allied agencies and there's a lot of statements of witnesses that we're taking," Grapilon said. He added those statements will be redacted when turned over to the defense.While the shooter's family was in federal court two days ago, no one was in the gallery Thursday.10News went to the family's neighborhood to see how they're faring.
