SAN DIEGO — Democratic Congressman Mike Levin has opened a commanding 20-point lead over Republican challenger Brian Maryott in coastal North County's 49th district, according to a new scientific poll.The ABC-10News Union-Tribune poll shows Levin leading Maryott 56 percent to 36 percent, with the remainder undecided. It's an increase over the 49 percent to 37 percent lead Levin had over Maryott in a prior poll taken in mid-September. The district stretches from Del Mar into parts of southern Orange County."It's all over but the shouting," said political analyst John Dadian, who said the district has become increasingly democratic over the last 15 years. "It was getting bluer gradually, and now, the last election cycle and I believe this one, we're going to see the fruit come to bear."Levin won the 49th District seat in 2018 after Republican Darrell Issa decided not to seek re-election after nearly two decades. Issa is now running for Congress in east county's 50th District, which leans Republican. "We've seen a lot of the communities that have shifted to more in the democratic party since 2016 are these more suburban, well-educated communities like many of the communities in California's 49th," said Stephen Goggin, a lecturer in the political science department at San Diego State University. The poll of 514 likely voters shows Levin getting the support of 68 percent of independents, with Maryott, a San Juan Capistrano councilman, getting just 15 percent of them. Both are getting the bulk of their backing from their own parties. In an interview Tuesday, Levin said he was not taking anything for granted, and that the only poll that matters is the one on election day. "This is the home stretch of an election, all hands on deck, leave no stone unturned. That's the only way I know and that's what we're going to do over the next three weeks," Levin said. Maryott's campaign released a statement saying the race is much closer than what this poll shows. "We see it firsthand, on a daily basis: as more voters uncover Mike Levin’s extreme record, support for Brian Maryott increases significantly. We put our trust in the voters, not polls," the statement said. The SurveyUSA poll reports that 13 percent of respondents already voted, and 63 percent are 100 percent they will. It also shows Joe Biden defeating President Trump in the district, 56 percent to 39 percent. SurveyUSA surveyed 650 voting-age individuals from Oct. 8 to Oct. 12. 2472

SAN DIEGO (AP) — Marine Corps prosecutors were meeting Tuesday to try and save its cases against 13 Marines accused of crimes tied to a human smuggling and drug investigation after a military judge ruled it was illegal to make the videotaped arrests made during a battalion formation while leaders called them “a cancer” and “bad Marines.”Maj. Kendra Motz said prosecutors at Marine Corps Camp Pendleton were exploring their options, but she did not know what they were considering.The judge, Marine Col. Stephen Keane, gave prosecutors until Nov. 25 to offer a way to remedy the situation.When ruling Friday, Keane agreed with defense attorneys that commanders violated the rights of the accused when they pulled the Marines out of a morning battalion formation of 800 troops at Camp Pendleton July 25 and accused them of the crimes in front of their unit, 1st Battalion, 5th Marines.The actions amounted to unlawful command influence, Keane said. That is when commanders use their positions of power to affect a case and compromise the ability for a fair trial.If the prosecution cannot remedy the situation, the court would be left with only one option: dismissing the charges, he said.Defense attorneys for some of the Marines have asked for charges to be dismissed. They say the public display would make it difficult to find an impartial jury pool and guarantee a fair trial.The Marine Corps filmed the arrests. The video was obtained by the San Diego Union-Tribune.The Marine Corps said in a statement when the newspaper obtained the video that it was made to document the arrest “in an unbiased, non-editorialized manner.”The video is for official use only and would not be released, Motz said. Prosecutors declined to be interviewed, saying they do not comment on pending cases.The military personnel are accused of various crimes from migrant smuggling to drug-related offenses, but officials have not said exactly how they were involved.U.S. Border Patrol officials say smuggling rings have been luring U.S. troops, police officers, Border Patrol agents and others to work for them as drivers — a crucial component of moving migrants further into the United States once smugglers get them over the border from Mexico.None of the Marines are accused of bringing immigrants across the border. 2309

  

Samuel Oliver-Bruno found sanctuary in a North Carolina church for nearly a year. Authorities detained him last week after he left the building for an appointment. Dozens of his supporters were arrested, too, as they sang "Amazing Grace" and tried to block immigration officials from taking him to a detention center.Days later, Immigration and Customs Enforcement deported the 47-year-old undocumented immigrant to Mexico, Rev. Cleve May of CityWell United Methodist Church told CNN Friday.Oliver-Bruno was deported Thursday evening to Matamoros, Mexico, May said."Samuel's family, church community, and supporting neighbors are grieved at Samuel being ripped from his family, church and community," officials with the Durham, North Carolina, church said in a statement.Oliver-Bruno had lived in North Carolina with his family for more than two decades. Advocates had appealed to authorities to stop his deportation.An ICE spokesman did not immediately respond to a request for comment Friday.Last week ICE spokesman Bryan Cox said authorities arrested Oliver-Bruno as part of a "targeted enforcement action.""Mr. Oliver-Bruno is a convicted criminal who has received all appropriate legal process under federal law, has no outstanding appeals, and has no legal basis to remain in the US," Cox said.Fearing deportation, Oliver-Bruno had been living at the church since December 2017.ICE generally avoids arrests at "sensitive locations" such as houses of worship.The CityWell United Methodist Church agreed to take him in but the building wasn't ready for him. He helped with the renovations, including building a bedroom and a shower."He helped construct his living quarters. He's remarkable. He's very generous and kind," May said last week.During his time at the church, he attended classes to learn English as a second language, played guitar and read during services.With the help of community members, Oliver-Bruno, who is an aspiring baptist minister, continued his studies at Duke University's Divinity School after his class agreed to meet at the church, advocacy group Alerta Migratoria said.But the uncertainty and the wait would also get to him."As I continued cooped up, sometimes I feel the need to be free. I need to work, do the activities I used to do, to afford medicines for my wife and doctor's appointments," he said in a video posted by advocates days before his arrest. 2416

  

SAN DIEGO — Police are investigating multiple shootings that erupted in downtown San Diego Monday night.The gunfire was reported around 11 p.m. at several locations in the East Village neighborhood, about three blocks east of Petco Park's tailgate parking lot.A crew for Scripps station KGTV in San Diego was at the scene of one shooting at 15th Street and Island Avenue where several victims were being loaded into ambulances. Two other people suffering gunshot wounds were located near Market Street.No further information about the victims is available at this time.A witness told KGTV that he heard about a dozen gunshots coming from different locations and two vehicles speeding from the scene.It is unknown at this time if there are any other victims. San Diego Police Department Gang units are also on scene.The shooting happened not long after the San Diego Padres wrapped up their game against the Washington Nationals at Petco Park. 1015
