SAN DIEGO (CNS) - Carlsbad-based Callaway Golf Co. announced Wednesday it has agreed to buy driving-range chain Topgolf Entertainment Group in an all-stock transaction valued at billion.The merger combines Callaway, a global golf equipment company, with Topgolf, which made its name as a party-golf attraction for players at all skill levels. Topgolf's driving ranges allow players to track their golf balls electronically and play against other groups nearby while ordering food and drinks.Callaway already owned 14 percent of Topgolf and first invested in the company in 2006."Together, Callaway and Topgolf create an unrivaled golf and entertainment business," said Chip Brewer, president and CEO of Callaway. "This combination unites proven leaders with a shared passion for delivering exceptional golf experiences for all -- from elite touring professionals to new and aspiring entrants to the game."Topgolf, founded in 2000, has 58 locations in North America.The company has 33 additional venues in some stage of planning nationwide, the San Diego Union-Tribune reported. SAN DIEGO (CNS) - A San Diego-based telemarketer was fined nearly million by the Federal Communications Commission Wednesday for making more than 47,000 robocalls over a two-day period leveling false accusations against a local state Assembly candidate and manipulating caller ID information to appear as though a competitor was making the calls.Kenneth Moser and his company, Marketing Support Systems, were fined ,997,750 for making the calls on May 30 and May 31, 2018, about one week prior to the primary election, in which Philip Graham unsuccessfully sought to represent the 76th Assembly District.Shortly before the primary, a woman accused Graham of kissing her against her will in an Encinitas bar, triggering a sheriff's department investigation that concluded the claim was unfounded. Nichole Burgan, the woman at the heart of the allegation, later pleaded guilty to filing a false report.According to the FCC, the robocall messages repeated Burgan's claim and caller ID information was manipulated to make the calls appear as though they originated from another telemarketing company, HomeyTel, described as a competitor to Moser's company. As a result, HomeyTel received "a multitude of angry complaints" from people who received the calls, as well as a cease-and-desist letter from Graham, according to the FCC.The agency said 47,610 robocalls were made during the two-day period, with multiple calls sometimes sent to the same recipients.The calls violated the Truth in Caller ID Act prohibiting manipulation of caller ID information -- otherwise known as spoofing -- with the intent to defraud, cause harm or wrongfully obtain anything of value, according to the FCC. 1697

SAN DIEGO (CNS) - A woman driving on a suspended license who had more than three times the legal blood-alcohol limit when she crashed her SUV head-on into another vehicle while driving her three young daughters through Rancho Bernardo was sentenced Thursday to 14 years in state prison. Mayra Alejandra Gonzalez, 30, -- on probation for a prior DUI -- had a .29% blood-alcohol content when she drove on the wrong side of Camino del Norte Nov. 12, 2018. Her SUV crashed head-on into an oncoming 2011 Jeep Liberty, causing severe injuries -- including a skull fracture and a brain bleed -- to her 9- month-old daughter, who was riding unrestrained. The defendant's 2-year-old daughter suffered facial injuries and her 8-year-old daughter broke a bone. The 57-year-old driver of the other car suffered broken bones and underwent five surgeries to treat his injuries. RELATED: Mother arrested for wrong-way DUI crash that injured childrenDeputy District Attorney Ramona McCarthy told the court at Thursday's sentencing that Gonzalez was drinking throughout the day on Nov. 12 and driving with her kids in her vehicle on a trip that stretched from North San Diego County to East County and back. She crashed into a signpost and a parked car, and backed into a wall prior to the crash that led to her conviction, the prosecutor said. ``She put alcohol and what she wanted to do above the safety of her children and the safety of the community,'' McCarthy told the court. Considering the condition of her then-9-month-old, who still uses a feeding tube to this day as a result of the crash, McCarthy said ``It's a miracle (Gonzalez) is not here on a murder charge.'' At the time of the crash, she was on probation and driving on a suspended license due to a 2017 North County DUI, in which she crashed while pregnant and with at least one of her children riding in the vehicle. She had .23% blood-alcohol content in that case. Gonzalez, who pleaded guilty in August to felony child abuse and drunk driving charges, addressed the court, asking for leniency and the chance to see her family sooner. ``My children are my world, my reason for living,'' said Gonzalez, adding she was ``very, very remorseful'' for the crash. San Diego County Superior Court Judge Laura W. SAN DIEGO (CNS) - A woman robbed a San Diego vape and smoke shop at gunpoint and was later arrested, authorities said Saturday.It happened just before 10 p.m. Friday at the shop at 3094 National Avenue, according to San Diego police Officer Robert Heims.The woman walked in, pointed a gun at an employee and demanded money, Heims said. She took an unknown amount of money and fled eastbound on National Avenue.Officers located the suspect a few hours later near South 32nd Street and arrested her, he said.The suspect was identified as Jeanette Sarmiento, 37, Heims said. 579

  

SAN DIEGO (CNS) - A towering palm tree and the tree trimmer strapped to it came toppling down inside the lobby area at a University City-area hotel Thursday. The tree was being cut down at Embassy Suites by Hilton San Diego-La Jolla, 4550 La Jolla Village Drive, when it struck a person shortly before 11 a.m., according to police and the San Diego Fire-Rescue Department. San Diego Police told 10News the injured man was a tree trimmer. Medics took the victim, to Scripps Memorial Hospital La Jolla. Joe Jaha, a supervisor at Arbor West Tree Surgeons, says a 3-man crew was at the hotel to take down three large palms in the lobby. He says the tree trimmer was 30 feet up the final, 40-foot palm. He had taken off the top and was trying to bring it down when the tree uprooted, with the tree and tree trimmer crashing to the ground. The tree trimmer, a man in his 30s, suffered a broken leg and arm."It had highly unusual, shallow roots, which we couldn't detect until it was too late. OSHA arrived and said we were in total compliance. It was a freak accident," said Jaha.The Hilton sent 10News the following statement: 1131
