SAN DIEGO (KGTV) - A new study released Wednesday by a University of California San Diego professor is making claims about inhumane treatment of asylum seekers in detention centers along the border."Over 1 out of every 3, or 34.7%, of the asylum-seeking heads of households reported issues related to conditions in immigration detention, treatment in detention, or medical issues," the report headed by Tom K. Wong, PhD, said. He is an Associate Professor of Political Science at UC San Diego.The study was conducted from October 2018 through June of 2019, with 7,300 migrants.Here are some of the findings:Among those who reported issues in immigration detention, 61.8% reported issues related to food and water, including being fed frozen or spoiled food, not having enough to eat, not being given formula for infants, not being given water, and having to drink dirty water, among others;Among those who reported issues in immigration detention, 34.5% reported issues related to hygiene, including not being able to shower, dirty bathrooms, and not having a toothbrush or toothpaste to brush their teeth, among others;Among those who reported issues in immigration detention, 45.6% reported issues related to not being able to sleep, overcrowded conditions, confinement, and the temperature being too cold in la hielera (ice box);232 asylum-seeking heads of households reported verbal abuse, including being told “go back to your f****** country” and “you’re an ape,” among other examples;40 asylum-seeking heads of households reported physical abuse, including being thrown against a wall, among other examples; and18 asylum-seeking heads of households reported having their physical property taken, including their passports and travel documents, among other examplesCustoms and Border Protection's Transport, Escort, Detention and Search (TEDS) Directive is outlined as follows:"Regular hold room checks should be conducted and recorded to ensure proper occupancy levels, safety, hygiene, and the availability of drinking water. Officers/Agents or detainees will not be expected nor required to perform such tasks.""Adult detainees, whether in a hold room or not, will be provided with food at regularly scheduled meal times. SAN DIEGO (KGTV) — A San Diego judge says police departments must release records related to officer misconduct.The decision comes after local media groups, including 10News, sued to keep some police unions from blocking departments from following a groundbreaking new law in California.“This court finds that Senate Bill 1421 applies retroactively, to all, keyword, all personnel records of peace officers not only now but prior to January 1, 2019,” said San Diego County Superior Court Judge Eddie Sturgeon.Senate Bill 1421 requires departments to release records of officer-involved shootings and major uses of force, officer dishonesty and confirmed cases of sexual assault to the public.Several police associations in San Diego County sued to block the release of records, arguing Senate Bill 1421 doesn’t contain any express provision or language requiring retro-activity or any clear indication that the legislature intended the statue to operate retroactively. They claimed the bill eliminates the longstanding statutory confidentiality of specified peace officer or custodial officer personnel records.“These records have been under seal for 45 years, and when you have that kind of duration, and decisions are made for that long than it is going to create substantial disruption when the law changes, and all of a sudden these things have been under seal for four and half decades are available for public perusal,” said Richard Pinckard, attorney for the unions.An attorney for the ACLU argued they intervened in the case to defend the public right to know saying the law was designed to be retroactive.“These are fundamental matters that the public has a right to know,” said David Loy, attorney for the ACLU of San Diego & Imperial Counties. “To restore public trust the public has to have the right to know and observe what the officers have done and what the agencies have said about it.”The Judge ruled no records could be released before March 29. Included in the list is Del Mar, Rancho Santa Fe, Coronado, Solana Beach and Encinitas.One of those cities, Encinitas, became a million city within the last year. SAN DIEGO (KGTV) -- A San Diego judge has ruled that demolition of the historic California Theatre would violate environmental law.The theatre, which was built in 1926, was the largest vaudeville and movie palace in San Diego.City Council approved the demolition of the theatre in 2017. The proposed demolition, however, required an environmental impact report.RELATED: San Diego approves replacement for dilapidated California Theatre?The legal challenge to the approval, filed by the Save Our Heritage Organization, said the city failed to adequately address the ability to adapt and reuse the California Theatre.The court granted SOHO’s legal petition because the review failed to comply with the California Environmental Quality Act.The demolition approved by the city would have allowed a 40-story skyscraper to be built that would have included 282 residential units."The California Theatre is an outstanding historic building that has been standing for almost 100 years, it presents many opportunities for successful adaptive reuse to revitalize the C Street corridor. When the City's EIR failed to study alternatives to demolition, we put our faith in the Court to enforce CEQA. SAN DIEGO (KGTV) - A man carjacked two vehicles within hours in Otay Mesa, San Diego Police said Friday.The first carjacking happened in the parking lot of the Iris Trolley Station on Iris Ave. about 10:30 p.m. Thursday.A man was outside of his Volkswagen Jetta and a woman was sitting in the car when the suspect got into the driver’s seat, police said.The woman got out of the car and the suspect drove away, according to San Diego Police.Officers searched the area and found the suspect had parked the Jetta at Palm Ave. and Beyer Way and carjacked another car.Two men who were sitting in a Hyundai Genesis when the suspect grabbed the driver and pulled him out of the car. The passenger got out and the suspect drove away in the Genesis, officers said.The suspect crashed into a white SUV at I-805 and Sweetwater, police said.Paramedics took the driver, 33-year-old Daniel Perez, to the hospital with a knee injury. 927
