CDC offers guidanceWhile Memorial Day weekend say many Americans looking to cool off, the Centers of Disease Control and Prevention offered new guidance on community pools. The agency says currently, "there is no evidence that the virus that causes COVID-19 can be spread to people through the water in pools, hot tubs, spas, or water play areas. Proper operation and maintenance (including disinfection with chlorine and bromine) of these facilities should inactivate the virus in the water."But for San Diego County, health officials are leaning on the state for the go ahead on pools. Sarah Sweeney, communications officer with the county's Health & Human Services Agency, says the risks go beyond pool chemicals.RELATED: Gov. It’s the gathering of individuals across different households for extended periods," says Sweeney.The county's public health orders allow for water activity in the ocean, bays, and lakes. But health officials says it's unlikely that large groups will swim together in the ocean and people aren't expected to wear facial coverings while engaged in active water sports. 1722

SAN DIEGO (KGTV) -- California’s new gig economy law was meant to help rideshare drivers and other freelance workers get better benefits, but some critics say it’s threatening the spirit of Christmas itself.Those critics are mall Santas, who have traditionally been hired as independent contractors through third-party bookers or employment agencies.Under Assembly Bill 5, authored by Assemblywoman Lorena Gonzalez (D-San Diego), those workers must be reclassified as employees with insurance and other benefits.“Lorena Gonzalez, she might kill all the Santas. She might kill the Easter Bunnies,” said Steve Schafer, the president of the San Diego chapter of the Fraternal Order of Real Bearded Santas.Some Santas warn that bookers may go to great lengths to avoid paying employee benefits. “I don't know how someone can justify this,” said Jerry Tamburino, a Santa who has worked for more than a decade at a large commercial store.Tamburino said his agent notified him Tuesday that she would replace him and other Santas at a chain of California retail stores with out-of-state St. Nicks.“That's what [the booker is] being forced to do to address -- or evade -- or stay in business with this stupid law,” he said.Bringing in out-of-state workers to skirt AB-5 would violate California law, since labor laws apply to anyone performing work in the state, said Gonzalez’ office. But Tamburino said it would be hard for regulators to enforce.Malls and stores could hire Santas directly as independent contractors, Gonzalez’ office noted, since that kind of relationship passes AB-5’s three-pronged test.To do so, Tamburino said he would have to form his own LLC and said he doesn’t have the experience to run his own business.Tamburino said he would begin reaching out to other Santa-booking agencies in hopes they will hire him as an employee, but there’s a lot at stake: he receives about half of his annual income from Santa jobs. 1938

The district's curriculum is becoming more inclusive. School can be a tough time for many students, including those who identify with the LGBTQIA community."In a 2017 report, a national study, 82% of our LGBTQ students reported hearing anti-LGBTQ remarks," says Assemblymember Todd Gloria. "Seven in 10 reported being called names or threatened during their school day."Gloria spearheaded Assembly Bill 493. It would mandate LGBTQ identity training for educators, grades 7-12. Governor Gavin Newsom signed the bill into law last fall.Although school is out for summer break, the San Diego Unified School District is showing its support. The Pride and Transgender flags, among others, were raised outside of the district's office.SDUSD has implemented a curriculum that will help teachers and students. Each module contains four lessons. It comes equipped with terminology and LGBTQIA history."What we found out as a district, is that these students are hearing about these issues and these people for the first time because a lot of our educators have been ill-prepared to have these discussions in classrooms," says Ebonee Weathers with the Youth Advocacy Dept.Weathers also notes that it's important for educators to build relationships and empower students, so they feel safe and comfortable in school settings. 1478

  

SAN DIEGO (KGTV) — Brightwood College stunned its students and workers with its abrupt shutdown Wednesday morning. But the for-profit college, with three locations in San Diego County, may have violated California law by not giving workers proper notice.The state’s WARN Act requires employers with at least 75 workers - which multiple employees say Brightwood had - at least 60 days notice (and pay) before a mass layoff.But Brightwood did not notify the workers or the state before announcing the shutdown. Brightwood’s parent company, Education Corporation of America, did not immediately return an email seeking comment. Employment attorney Dan Eaton said there are exemptions to the warn act, but under very specific financial conditions the state Department of Industrial Relations must approve.“On the face of it they would have to provide more documentation to show they are excused from the requirements,” said Eaton, of Seltzer Caplan McMahon Vitek. “If they are unable to do that, then there will presumably be consequences from not giving the 60 days notice."Those consequences include employee backpay, medical reimbursement, and a civil penalty of 0 a day. Brightwood said in a statement that that added requirements from the Department of Education, and a loss of accreditation from the Accrediting Council for Independent Colleges and Schools made it impossible to continue operations. 1687

  

SAN DIEGO (KGTV) – Authorities in San Diego have confiscated twelve guns from campuses across the county since the anonymous hotline “Students Speaking Out” was implemented in 1999.That’s according to Dep.
