SAN DIEGO (CNS) - A drunken driver who went the wrong way and crashed head-on into another car in 4S Ranch, killing the other driver, was convicted Wednesday of gross vehicular manslaughter while intoxicated and DUI causing injury.Jurors deadlocked on a second-degree murder count against Alexandria Bayne, but will return Thursday to resume deliberations in hopes of reaching a consensus. The 37-year-old defendant was charged with murder due to two previous DUI convictions from 2005 and 2008.The panel deliberated two days before returning the vehicular manslaughter and DUI verdicts, and acquitted Bayne of four child endangerment counts involving allegations that she drove drunk earlier in the day while her children were riding in her minivan.RELATED: Fatal 4S Ranch DUI suspect breaks down in tears when husband testifies in hearingOn Thursday, the jury will hear a read-back of closing arguments and receive clarifications on the legal definitions of certain terms such as "intentionally" and "deliberately," which were cited as a source of contention in jury notes submitted to San Diego County Superior Court Judge Robert F. O'Neill.Sarita Shakya, a 38-year-old Scripps Mercy Hospital nurse, was heading home from work the afternoon of Dec. 17, 2016, on Camino Del Norte when her car was struck head-on by the defendant's vehicle.Deputy District Attorney Cally Bright told jurors in her opening statement that Bayne had been drinking alcoholic beverages throughout the day, starting that morning. The defendant and her attorney conceded she'd been drinking but was not drunk when she was behind the wheel. Though she testified that she had eight drinks throughout that day, she told the jury she simply made a mistake when she turned into opposing traffic lanes on Camino Del Norte.RELATED: Tears at preliminary hearing in suspected DUI fatal crashBayne's attorney, Michelle Hunsaker, contended that Bayne made that mistake because she was distracted by family issues, as well as her cell phone.Prosecutors said her blood alcohol content was measured at between .32 and .33% -- the legal limit is .08% -- after the crash.Hunsaker disputed that testing result, saying Bayne's alcohol consumption "just doesn't line up" with the .33% BAC alleged by the prosecution. The 19-year-old man was weaving in and out of lanes near Camino de Estrella about 3 a.m., agents said. He drove his 1997 Chevy pickup truck to a nearby gas station and agents followed to conduct a safety check. “During the encounter, the agents grew suspicious of the driver’s behavior and they decided to request for a K-9 team to respond. The K-9 alerted to the truck’s engine compartment,” agent Theron S. Francisco said in a news release. Agents said they found four packages of heroin inside the truck’s air intake box. The drugs weighed almost five pounds and had a street value of about 7,000. The driver, a U.S. citizen, faces felony drug smuggling charges. 824

New reservation data from Open Table shows seated dining in San Diego is down about 80% from this time a year ago. One reason: only about 45 percent of the restaurants in Open Table’s network are even taking reservations. “Just because we've had to open the economy doesn't mean that there is no coronavirus anymore, and I think that's where people are coming from when they don't want to be among the masses,” Lake said. Lake said while delivery is up, overall sales are down 40%. And to make it harder, she's spending 80 cents per order on disposable plates and utensils. Lake said she has been able to keep all of her 14 workers, but that their hours have been cut. Normally, around this time year, Lake would have hired twice as many people. Customers, meanwhile, are now ordering from the front patio. While a server wearing protective gear brings out the food, customers asked to bus their own tables. 1855

  

SAN DIEGO -- As part of an initiative aimed at expanding San Diego's regional bike network, SANDAG has released a map of bikeways throughout the county. The plan, known as GO by BIKE, proposes a bike system of interconnected corridors, support facilities and programs that make biking a convenient form of travel.According to Keep San Diego Moving, making the region more bike-friendly resolves issues like traffic congestion, air quality and livability.The plan proposes a network of bike corridors that will allow residents to bike on more direct routes within and between major destinations and activity centers.The plan also supports the implementation of SANDAG’s regional comprehensive plan and SANDAG’s 2050 regional transportation plan.To promote the infrastructure, SANDAG is putting on Bike to Work Day, which will take place on Thursday, May 17.The plan also has a 0 million early action program. SAN DIEGO (CNS) - A 40-year-old man was shot and wounded while riding his bicycle early Saturday morning in Logan Heights.The shooting was reported at 1:20 a.m. in the 2900 block of Marcy Avenue, said San Diego police Sgt. Michael Tansey.The victim was riding his bicycle on the sidewalk westbound on Marcy Avenue when someone inside a black Jeep Cherokee that was parked along the north side of the street exited the passenger side and fired several rounds at the victim, Tansey said.The bicyclist was struck twice by the gunfire and fled on his bicycle. He rode into a fast food restaurant in the area of 29th Street and National Avenue, where he was taken to a hospital for treatment of non-life-threatening wounds, Tansey said.The victim sustained a gunshot wound to his buttocks and left lower leg, Tansey said.The gunman was described as Hispanic, in is mid 20s, wearing a black shirt and dark pants, according to Tansey. 935
