SAN DIEGO (KGTV) - Hundreds are getting tested for coronavirus before Thanksgiving hoping to keep their family safe. Medical experts say it's not necessarily going to work. The lines were hours long in front of a Linda Vista testing site, just as long at sites around the county Sunday."There's a worrisome reason for that, people are planning to go visit their older relatives and they think they're going to be 100% safe," Dr. Davey Smith, Chief of Infectious Diseases at UC San Diego said getting tested Sunday or any day leading up to Thanksgiving could give you a false negative."If I get tested now, it doesn't mean that I'm not infected, it just means that I'm not actively shedding the virus," Smith said.According to the CDC the incubation period for the virus is 2-14 days."I thought Halloween was going to be the scary part of the year but November, December, January are just going to be really tough I think. We've got Thanksgiving coming up, then we have Christmas coming up and then New Year's and everybody is tired of being on lock down, it breaks my heart," Dr. Smith said leaning back in his chair.Data shows after each holiday this year, we've seen a spike in cases. The CDC and Dr. Smith urge everyone to gather virtually, or in small groups outside, socially distance and wash your hands often. We all know 2020 has been the year of sacrifices and Dr. Smith feels it too, "I'm really grateful for my niece who I have not met yet, because of the pandemic, I am so excited, I get pictures every day, so I'm pretty happy."All of us hopeful next year we can all be with our loved ones."If we can just get through the winter, I promise these vaccines and treatments are really going to change everything and that just means there will be more of us to celebrate next year," Dr. Smith said. 1811

SAN DIEGO (KGTV) — Four San Diego businesses, including two restaurants and two gyms, have filed a lawsuit seeking an emergency injunction to stop the latest shutdown orders.Under the red tier, both sectors were open for indoor operations as limited capacities. Restaurants were allowed to serve people inside at 25 percent of the normal capacity, and gyms at only 10%.On Saturday, purple tier restrictions will go into effect, meaning businesses like restaurants and gyms must shutdown indoor services completely and move outside.Cowboy Star Restaurant & Butcher Shop, Home & Away Encinitas, Fit Athletic Club, and Bear Republic filed the lawsuit against California Gov. Gavin Newson and the County of San Diego, as well as other state and county officials arguing that the closures go against their rights. The lawsuit states that Newsom and the California Department of Public Health (CDPH) lack the authority to impose the continuing restrictions on California businesses. All four businesses detail the numerous health and safety measures they’ve added to provide a safe environment for staff and customers during this pandemic.“I think it’s pretty clear that the law is on the side of governmental authority to try to get this under control,” said Jan Ronis, an attorney with the Law Offices of Ronis & Ronis. “Why they continue to file lawsuits… it’s beyond me.”Ronis is not involved in this case, but said when the pandemic began, he reviewed emergency legislation available to the government at both state and federal levels.“These laws have been in the book for decades, and governments have used them sparingly, and quite frankly think they’re valid as surprised as I was by the breadth and scope of government authority once these emergency declarations are declared,” said Ronis. He said he had seen similar lawsuits filed across the state during the last several months, and most don’t hold up in court.“I really feel sorry for the businesses, but the fact is this is a monumental health crisis,” said Ronis.Dr. Wilma Wooten, San Diego County’s public health officer, recently asked for the CDPH to allow the county to stay in the red tier. She explained that businesses that would be impacted the most by purple tier restrictions, like restaurants and gyms, are not the cause for the local increase in COVID-19 cases. The lawsuit said despite the data provided by Dr. Wooten, the CDPH still denied the request without any justification based on science or data. Both the law firm that filed the lawsuit and the County of San Diego refused to comment on this matter, stating they do not comment on pending litigation. 2646

SAN DIEGO (KGTV) - Doctor's orders: Make room for a day at San Diego's Coronado Beach. In his annual list of America's best beaches, Stephen Leatherman, a professor at Florida International University known as "Dr. Beach," named the local beach among the best in the country. Coronado Beach was also the only California beach to make the top 10 list, coming in at ninth best.RELATED: Fact or Fiction: Is Hotel Del Coronado painting its lobby white?"Coronado Beach is the toast of Southern California; it is a veritable oasis by the sea, measuring hundreds of yards wide. With its lush subtropical vegetation, unique Mediterranean climate, and fine sparkling sand, beach-goers flock to this beach for great ship-watching and the summer’s warm and mild surf," Leatherman writes on his website.Kapalua Bay Beach in Maui, Hawaii, topped the doctor's list of beaches followed by Ocracoke Lifeguarded Beach in North Carolina, Grayton Beach State Park in Florida, and Coopers Beach in New York.Beaches were measured on water and sand quality, tide and wave breaks, weather, and safety and management. Dr. Beach also gives extra points whether a beach prohibits smoking.RELATED: Hundreds of students and volunteers to clean Mission BeachSo what makes Leatherman the doctor of beaches? Since 1991, the professor has been grading the country's best beach destinations. He's regarded as a coastal expert, writing 20 books and hundreds of articles on storm impacts, coastal erosion, and beach health. 1535
