Dramatic moments in a San Bernardino courtroom today as a prosecutor slammed a sledgehammer onto a table. He was simulating what he says is how a Fallbrook family of four was murdered in 2010. Charles Merritt is accused of killing his business partner, Joseph McStay, his wife Summer and their two young sons Giani and Joe Jr. The prosecution says Merritt was being sidelined from the business and owed thousands of dollars to McStay. The defense countered in their closing arguments that the prosecution focused on trying Merritt’s character and not the actual facts of the murder. The defense told jurors the circumstantial case produced no evidence tying their client to the family’s violent deaths. The prosecution told jurors they didn’t have to prove how, where or when the murders took place, only that Merritt committed them. The McStays disappeared from their Fallbrook home in early February 2010. Days after they were last seen, the family’s SUV was found abandoned at a strip mall parking lot in San Ysidro. In 2013, the bodies of the family members were found in the Mojave Desert, near Victorville. Prosecutors said the family died from blunt-force trauma to their heads. Authorities found a sledgehammer, believed to be the murder weapon, in one of the graves.Merritt was arrested in connection with the killings in November 2014 after sufficient evidence linking him to the case, including DNA, was discovered.Authorities alleged Merritt killed the family members inside their home and then buried them in the desert. Merritt also tried to paint over the crime scene, according to authorities.Merritt, 61, has pleaded not guilty to charges of murder and is being held without bail.Prosecutors are seeking the death penalty in the case. 1758

EL CAJON, CALIF. (KGTV) - A pair of Navy Junior Reserve Officers’ Training Corps cadets from an El Cajon high school are turning heads for their achievements. It has been 19 years since a student from Grossmont High School was appointed to military service academy and the class of 2018 has two who received multiple appointments.John Flaherty and Nicholas Ghosn earned four appointments in total.Flaherty was nominated to West Point and the United States Merchant Marine Academy while Ghosn earned them to the U.S. Air Force Academy and the U.S. Naval Academy.“I was on top of the world,” said Flaherty describing the moment he got the call he was being appointed, “it was everything I dreamed of since I was four-years-old.”Flaherty is attending West Point and Ghosn will head to Annapolis at the end of their summer.Nicholas Ghosn says it was bittersweet to get the nod from the U.S. Navy.“All I ever wanted was to go to that college and join the ranks of the officer corps in the Navy, but I knew I was going to be away from my family and friends and home,” said Ghosn, “it’s going to be a long time before I get to see them so I was kind of sad because I knew this was it.”The 17-year-olds grew up a mile and a half from each other in Spring Valley and played sports together.“It’s unprecedented,” said Gunnery Master Sgt. Mark Brosnan on the two earning nearly million dollars in scholarship money from the schools.“I’ve never had cadets from public school get two appointments in the same year,” added Brosnan. They are teenagers, but they know they are on the precipice of something great.“They don’t let you into the Naval Academy or West Point if you eat tide pods,” laughed Ghosn, “Thats on the application.”The two head to their respective schools in late June, but plan to see each other at the Army-Navy game in December.  1855

EL CAJON, Calif. (KGTV) — The Dehesa School District Board voted 4-0 Friday afternoon to place their superintendent on paid administrative leave amid a fraud investigation.Earlier this week, the San Diego District Attorney’s Office charged Superintendent Nancy Hauer with one count of misappropriating public funds. She was one of 11 people charged in a statewide scheme, in which the DA says two men siphoned more than million in state money through a network of 19 charter schools.“The defendants sought out small school districts with limited experience in oversight and proposed they authorize online charter schools to earn additional public funds in the form of oversight fees,” the DA’s Office wrote in a summary of the charges. At Friday’s special Dehesa School District Board meeting, the board spent an hour and a half in closed session with legal counsel discussing Hauer’s employment.Board President, Cindy White refused an interview with 10News.On the dais, Board Vice President Karl Backer told the audience, “we have initiated new legal council to peel apart the charter operations to make sure sound practices and legal compliance is met.” 1165

Dozens of wildfires are burning throughout California in August as news is emerging that a wildfire burning in Northern California is the largest in state history. The fires burning a few miles apart, known as the Mendocino Complex, started on July 27 and now encompasses an area the size of Los Angeles. 2018 also marks the second straight year California has recorded the state's largest wildfire following the Thomas Fire in 2017. A fire that began Monday is also spreading quickly in Orange County. Known as the Holy Fire, the blaze is tearing through fuel that has been accumulating for 40 years. Currently, nearly 30 wildfires are burning throughout California.
