In a sharp turn of events, a San Francisco judge denied Monsanto's request to nix a 0 million award to a man who said he got terminal cancer from Roundup weedkiller. But she's also slashing that man's punitive award down to about million.Former school groundskeeper Dewayne Johnson was the first cancer patient to take Monsanto to trial, claiming Roundup gave him non-Hodgkin's lymphoma.Jurors sided with Johnson and awarded him 0 million in punitive damages (to punish Monsanto) and about million in compensatory damages (for Johnson's lost income, pain and suffering). The jury's verdict came in August. But on October 10, the tide appeared to turn in Monsanto's favor. That's when Superior Court Judge Suzanne Bolanos issued a tentative ruling granting Monsanto's request for a JNOV -- a judgment notwithstanding verdict. That's basically when a judge in a civil case overrules the jury's decision.Bolanos said the plaintiff "presented no clear and convincing evidence of malice or oppression to support an award of punitive damages." In other words, Johnson's entire 0 million punitive award was in jeopardy. The judge gave attorneys on both sides a few days to respond and further make their cases. When she issued her final ruling Monday, Bolanos reversed her tentative ruling and denied Monsanto's request for a JNOV.But it wasn't a complete victory for Johnson. Instead of 9 million in combined damage awards, Johnson is slated to get a total of about million.Bolanos said the punitive award was too high and needed to match Johnson's million compensatory award."In enforcing due process limits, the court does not sit as a replacement for the jury but only as a check on arbitrary awards," Bolanos wrote in her ruling Monday."The punitive damages award must be constitutionally reduced to the maximum allowed by due process in this case -- ,253,209.35 -- equal to the amount of compensatory damages awarded by the jury based on its findings of harm to the plaintiff."Monsanto had also requested a new trial on the punitive damages. The judge said that request will be denied if Johnson accepts the smaller punitive award. If he does not accept the million punitive award, then a new trial would be set.The 1 million plummet in Johnson's punitive award caught some legal experts by surprise, including University of Richmond?law professor Carl Tobias."I am somewhat surprised, but the punitive damage award was high even though the (percentage of) reduction was steep," Tobias said. "No one thought the plaintiff would retain the whole (punitive damages) award." 2626

If you've been looking for a new kitchen appliance this year, locating certain models can be as tough as finding a new Xbox Series X or PlayStation 5.The appliance shortage that began in March shows no sign of letting up.Tommy Conougher is among the many frustrated shoppers. He needs more space in his refrigerator."This is one we've had since we built the house 17 years ago," he said.Like many families during this pandemic, he wants to stock up on frozen beef and chicken."We thought we would just invest in a freezer we would put in the garage, so we started to look."But finding a freezer was tougher than finding Nemo."We have been searching all summer long, nine months, for a freezer," Conougher told us in a Zoom interview from his kitchen."And even when the big box stores have their specials, they don't have them in stock."Many brands, price ranges affectedIt doesn't matter if you are looking for a freezer, refrigerator, range, oven, or washing machine. It also doesn't matter if your budget is 0 or ,000, or what brand you want (though American brands like Whirlpool and Maytag appear to be in better shape than European or Korean brands). You are going to find spot shortages just about everywhere, according to Ken Reiman, co-owner of an appliance distributor. He supplies builders and remodelers, who he says now have to delay finishing some projects due to ongoing shortages."When I check our vendor websites," he said, "they are just not available."He says the shortages that started when factories shut down for two months early in 2020 have not let up."For instance," Reiman explained, "they will give an estimated time of December 5, and December 6 comes around and they have moved to January."Why the shortage hasn't endedReiman says there are 3 reasons for the current shortages.Originally, it was factory shutdowns in March, April and May, along with delays getting appliances shipped from China during that time. The second reason is shortages of foreign-made parts, such as wiring harnesses and compressors, which forces U.S. factories to shut down their assembly lines until product arrives. The third reason is high demand, as people spend their vacation dollars this year on their kitchens instead, Reiman said. His suggestion: Be flexible on brand and model."We have products coming in," he said. "Our warehouses are more stuffed now than ever. But it seems we can't get the full package of matching appliances, which means you may get a range and microwave, but may have to wait three months for the matching fridge."If your heart is set on an exact size, color, and model, he says you could wait till spring.Reiman says your best bet is to ask what models are in the local or regional warehouse that you could get in a few days. While you will find shortages of all appliances, the worst of all are standalone freezers, because not many of them are made.As always, don't waste your money.________________________________Don't Waste Your Money" is a registered trademark of Scripps Media, Inc. IMPERIAL BEACH, Calif., (KGTV)-- Looming questions about border security arise after dozens of people were caught on camera, breaching the fence at Friendship Park yesterday. After being captured and detained, all 52 people are now seeking asylum. A local Youtuber who goes by the username, "Mexican Andy" live-streamed the video of the migrants rushing the border. At around 4 PM, Thursday, he witnessed a man, using what looks to be a knife to slice through the fence and razor wires. The moment it was wide enough for an adult to crawl through, the rush began. US Border Patrol agents said they now have 52 people in custody, including 23 men, 12 women, and 17 children, for illegally crossing the border. This includes 27 families, 24 single adults, and one unaccompanied child, hailing from Honduras, El Salvador, and Guatemala. All of them have since filed for asylum. This kind of breach is hardly a rarity for Border Patrol. Last November, just after the installation of Concertina wire on top of the border wall, two women and a child appeared to squeeze through the fence and walk into the United States.Days later, thermal cameras captured a man, attempting to kick the same razor wire at the San Diego border. Later that same month was the largest caravan rush in recent years, which shut down the San Ysidro border crossing, freeways, and surrounding businesses. With so many more incidents of asylum seekers trying to cross into the United States illegally, it is unclear if Border Patrol has any plans of adding extra security. 10News also asked if this latest group will be sent back to Mexico while their asylum claims are processed, as instructed by President Trump. CBP has not responded to 10News' inquiries. 1738

HOUSTON (AP) — Barbara Bush was the "first lady of the greatest generation."Historian Jon Meacham bestowed the title on Barbara Bush while speaking to former presidents, ambassadors and hundreds of other mourners inside the nation's largest Episcopal church during her funeral Saturday. He recalled the former first lady's quick wit, as well as her devotion to promoting literacy, bringing awareness to AIDS patients and to her husband of 73 years.Former President George H.W. Bush., the historian noted, was the "only boy she ever kissed."Meacham, who wrote a 2015 biography on George H.W. Bush, joined some 1,500 people on a gray, rainy Saturday to honor the wife of the 41st president and the mother of the 43rd. The private funeral filled St. Martin's Episcopal Church in Houston a day after more than 6,000 people came through the church to pay their respects during a public viewing.RELATED: Family, former presidents and more attend funeral for Barbara Bush in Houston, TexasHer son, former Florida Gov. Jeb Bush, joked during his eulogy that his mother called her style of mothering him and his siblings "a benevolent dictatorship — but honestly it wasn't always benevolent." He emphasized how she believed in the power of laughter and that joy should be shared. He choked up when saying his mother — known for her self-deprecating remarks about her wrinkles and gray hair — was "beautiful" until the very end. He said he felt priviliged that he had a "front row" seat to the incredible love story that his parents shared. His father, George H.W. Bush, was helped into the cavernous sanctuary with a wheelchair behind Jeb and his son former President George W. Bush. He laughed as Meacham and others recalled his wife's wicked sense of humor. Barbara and George Bush were married longer than any other presidential couple.GALLERY: Funeral, visitation for former first lady Barbara BushA eulogy was also given by Susan Baker, wife of former Secretary of State James A. Baker III, who said her longtime friend was "the secret sauce of this extraordinary family."Seated near the front of the church in the same pew were two other former presidents — Bill Clinton and Barack Obama — along with their wives and current first lady Melania Trump.Barbara Bush's granddaughters delivered readings during the service and her grandsons served as pallbearers as the casket was later wheeled out of the church. George H.W. Bush followed in his wheelchair, pushed by son George W. Bush, shaking hands with some of the people in the pews. In his lap, he carried his glasses and a copy of the funeral program.Barbara Bush died, with her husband by her side, at their home in Houston on Tuesday at age 92.Flags were flown at half-mast as the service began as the choir sang "My Country Tis of Thee." The church was adorned with sprays of yellow garden roses, yellow snap dragons, antique hydrangeas and other flowers.Other guests included former Rep. Gabby Giffords and her husband, retired astronaut Mark Kelly, and professional golfer Phil Mickelson, along with Karl Rove, and other former White House staff. Many were seen embracing in the church before the service.President Donald Trump isn't attending to avoid security disruptions and "out of respect for the Bush family and friends attending the service," according to the White House. He released a statement Saturday saying his "thoughts and prayers" are "with the entire Bush family."A burial will follow at the Bush Library at Texas A&M University, about 100 miles (161 kilometers) northwest of Houston. The burial site is in a gated plot surrounded by trees and near a creek where the couple's 3-year-old daughter, Robin, who died of leukemia in 1953, is buried. On Friday, a total of 6,231 people stopped by the church to pay their respects. Many of the women wore the former first lady's favorite color, blue, and trademark pearls. After seeing how many people had lined up to pay their respects to his wife, former President George H.W. Bush decided to attend — he sat at the front of the church in a wheelchair, offering his hand and smiled as people shook it, for about 15 minutes.Barbara Bush, one of just two first ladies to have a child elected president, also was known as the "Enforcer" in her family, the glue who kept the high-powered clan together. 4328
