SAN DIEGO (KGTV) — A San Diego judge says police departments must release records related to officer misconduct.The decision comes after local media groups, including 10News, sued to keep some police unions from blocking departments from following a groundbreaking new law in California.“This court finds that Senate Bill 1421 applies retroactively, to all, keyword, all personnel records of peace officers not only now but prior to January 1, 2019,” said San Diego County Superior Court Judge Eddie Sturgeon.Senate Bill 1421 requires departments to release records of officer-involved shootings and major uses of force, officer dishonesty and confirmed cases of sexual assault to the public.Several police associations in San Diego County sued to block the release of records, arguing Senate Bill 1421 doesn’t contain any express provision or language requiring retro-activity or any clear indication that the legislature intended the statue to operate retroactively. They claimed the bill eliminates the longstanding statutory confidentiality of specified peace officer or custodial officer personnel records.“These records have been under seal for 45 years, and when you have that kind of duration, and decisions are made for that long than it is going to create substantial disruption when the law changes, and all of a sudden these things have been under seal for four and half decades are available for public perusal,” said Richard Pinckard, attorney for the unions.An attorney for the ACLU argued they intervened in the case to defend the public right to know saying the law was designed to be retroactive.“These are fundamental matters that the public has a right to know,” said David Loy, attorney for the ACLU of San Diego & Imperial Counties. “To restore public trust the public has to have the right to know and observe what the officers have done and what the agencies have said about it.”The Judge ruled no records could be released before March 29. SAN DIEGO (KGTV) -- A gunman is on the loose after a Thursday morning shooting at Barrio Logan’s Chicano Park left a 19-year-old injured.San Diego police were called to the 2000 block of National Avenue, off Interstate 5, at around 1 a.m. in response to reports of dozens of shots fired.Details on what prompted the gunfire were unclear, but police confirmed a 19-year-old person was struck. The victim was taken to UC San Diego Medical Center for treatment.The victim’s condition is unknown.Police are searching for a Hispanic man in his 20s in connection with the shooting. They believe the gunman fled in a dark gray or silver car.About an hour later, as police were investigating the shooting, someone in the car matching a description of the getaway vehicle fired shots while on southbound I-5 towards officers at the shooting scene.No one was hurt in that gunfire. 878

SAN DIEGO (KGTV) -- A San Diego County sheriff’s deputy was arrested and charged with multiple sex crimes involving minors.Chula Vista police said they received anonymous tips via Crime Stoppers on April 9, 2020, “regarding an unidentified adult male suspect, who engaged in sex acts with an underage victim. Investigators were able to identify the suspect and also determine that there were two additional underage victims.”During the probe, investigators identified the suspect, 27-year-old Jaylen Fleer, as a correctional deputy with the San Diego County Sheriff’s Department.According to CVPD officials, Fleer surrendered to investigators on Wednesday, July 22. After being processed at CVPD headquarters, he was transported to the sheriff’s Vista Jail.Jail records obtained by ABC 10News show Fleer was booked on 15 charges, including oral copulation with a person under 16, luring a minor for a sex offense, and sending harmful material to seduce a minor.Chula Vista police noted that the sheriff’s department “cooperated and assisted with the investigation.”In a statement, the San Diego Sheriff Department said that Fleer was placed on administrative assignment when the department was made aware of the possible incident and that because of the seriousness of the allegations, his authority as a peace officer was taken away. A jury Friday found local jeweler Vahid Moradi liable for fraud, awarding Brees ,130,767 in damages in his lawsuit against Moradi.The Brees family accused Moradi and his company, CJ Charles Jewelers in La Jolla, of selling Brees and his wife several supposedly investment grade diamonds that would appreciate in value 150 to 200 percent.RELATED: Closing arguments being held in civil trial between NFL star Drew Brees and San Diego-based jewelerThat wasn't the case, according to Brees, who says Moradi lied about the true value of the diamonds. Between 2012 and 2016, the Brees family says Moradi sold them million in diamonds. SAN DIEGO (KGTV) - A San Diego Fire-Rescue chaplain found himself in need after flames ripped through his apartment in Old Town.Father David Fucci was with a friend last Thursday night when he got a call."My neighbor calls and says, 'Your apartment is on fire'," said Father Fucci.As he raced home, a mix of feelings washed over him. For about seven years, he's served as a volunteer chaplain, consoling victims during tragedy."That night, it felt surreal. Almost like an out-of-body experience. Normally I'm the one driving to the scene, thinking about what I can say," said Father Fucci.Instead, he could only watch as flames claimed his home. "Just kept thinking, don't let it spread to any other apartments and thankfully, it didn't," said Father Fucci.Then, something remarkable happened. As word spread of whose apartment it was, some familiar faces began appearing, including five other volunteer chaplains and a battalion chief."They took the time to put a hand on my shoulders. I knew I was blessed," said Father Fucci.Father Fucci found himself the person receiving comfort. "Sometimes those that give, it's hard to receive ... the compassion, love and help. You learn to let go," said Father Fucci.In the end, the apartment was declared a total loss. Amid the ashes, Father Fucci found something that survived."I found a picture of Mom and Dad. Last picture of them. They died a year later," said Father Fucci.He also discovered something else. He calls it a blessing born from his loss: a perspective that will allow him to better help others at the next scene."Now you have a greater understanding of what they need," said Father Fucci.Father Fucci did not have renters insurance.
