BOSTON (AP) — Prosecutors dropped a case Wednesday accusing Kevin Spacey of groping a young man at a resort island bar in 2016, more than a week after the accuser refused to testify about a missing cellphone the defense says contains information that supports the actor's claims of innocence.Spacey was charged with indecent assault and battery last year in the only criminal case that has been brought against the actor since his career collapsed amid a slew of sexual misconduct allegations. The two-time Oscar winner was among the earliest and biggest names to be ensnared in the #MeToo movement against sexual assault and harassment that swept across the entertainment and other industries.Spacey denies groping the man, whose mother first went public with the allegations in 2017.A phone message seeking comment was left with Spacey's lawyer.The actor's accuser was ordered to take the stand earlier this month after he said he lost the cellphone he used the night of the alleged groping. The defense said it needed the phone to recover deleted text messages it says would help Spacey's case.The man denied deleting messages or manipulating screenshots of conversations he provided to investigators. But when he was pressed by the defense about whether he knew that altering evidence is a crime, he invoked his Fifth Amendment right against self-incrimination, and the judge said his testimony would be stricken from the record.The judge then questioned how prosecutors would be able to bring Spacey to trial if the accuser continued to refuse to testify, and prosecutors told the judge they needed time to decide how to proceed.On Wednesday, Cape and Island District Attorney Michael O'Keefe said in court documents that they were dropping the charge "due to an unavailability of the complaining witness."The hearing at which the accuser testified came days after the man abruptly dropped a lawsuit he had just recently filed against the actor that sought damages for "severe and permanent mental distress and emotional injuries." The suit was dismissed "with prejudice," meaning it cannot be refiled.The man did not receive a settlement to drop the civil case, his mother said. His lawyer said he dropped it because he was emotionally overwhelmed and wanted only "one roller coaster ride at a time" and so chose to focus on the criminal case.The man's mother, former Boston TV anchor Heather Unruh, alleged in 2017 that Spacey got her son drunk and sexually assaulted him at the Club Car, a bar on Nantucket where the teen worked as a busboy.The man told police he went over to talk to Spacey after his shift because he wanted to get a picture with the former "House of Cards" star. He said Spacey bought him several drinks and tried to persuade him to come home with him before unzipping the man's pants and groping him for about three minutes.Unruh's son told police he tried to move Spacey's hands, but the groping continued, and he didn't know what to do because he didn't want to get in trouble for drinking because he was underage. The man said he fled when Spacey went to the bathroom.Shortly after Spacey was charged, he posted a video on YouTube in the voice of his "House of Cards" character who was killed off after the sexual misconduct allegations emerged, saying "I'm certainly not going to pay the price for the thing I didn't do."Spacey has faced several other accusations.His first accuser, actor Anthony Rapp, said Spacey climbed on top of him on a bed when Rapp was 14 and Spacey 26. BALTIMORE — The University of Maryland, Baltimore has suspended an experiment they were conducting after reports indicate they were denying pain relief to animals they were operating on.  The university confessed they were forced to stop their experiment because they failed to comply with multiple federal regulations, according to the national watchdog group SAEN, or Stop Animal Exploitation NOW!, which monitors U.S. research facilities for illegal activity and animal abuse.While the details about the experiment are still limited, documents from UMB reveal the project was suspended because animals were repeatedly denied pain relief after surgeries, they were not given proper time to recover after surgeries, the staff did not euthanize them after they reached their endpoints and the staff did not properly keep records. In a letter to the University of Maryland Board of Regents, SAEN said animals were not given any pain relief during a procedure involving cardiac arrest, and instead of giving the animals a three- to seven-day recovery period, they were given up to 24 hours. It also said animals were inspected by veterinarians and one animal required euthanasia, but was kept alive. All of this was discovered during multiple separate lab inspections done by UMB research administration. The letter also says during those inspections, the lab was notified of the serious consequences of not providing pain relief to the animals, but still did not get the necessary medications by the time another inspection took place, even though a surgery was going on at the time of the second inspection. After another unannounced inspection, changes were still not made, so the experiment was suspended on October 25. Now, SAEN is urging for UMB to do further research of abuse, terminate the project and refund all of the project support, .9 million, to the federal government. "This failed experiment must be terminated immediately,” said Michael A. Budkie, a co-founder and executive director of SAEN.  "The idea that a principal investigator repeatedly violated their own protocol and denied pain relief to animals indicates a total disregard for proper scientific procedures and total contempt for the authority of UMB Research Administration." SAEN is also calling for the results of the research to not be published because protocol was not followed.  2477

BEIRUT (AP) — Lebanese officials targeted in the investigation of the massive blast that tore through Beirut sought to shift blame for the presence of explosives at the city’s port, and the visiting French president warned that without serious reforms the country would “continue to sink.” The blast, which appeared to have been caused by an accidental fire that ignited a warehouse full of ammonium nitrate at the city’s port, rippled across the Lebanese capital, killing at least 135 people, injuring more than 5,000 and causing widespread destruction. It also may have accelerated the country’s coronavirus outbreak, as thousands flooded into hospitals in the wake of the blast.French President Emmanuel Macron visited Thursday amid widespread pledges of international aid.Macron, who viewed the devastated port and was to meet with senior Lebanese officials, said the visit is “an opportunity to have a frank and challenging dialogue with the Lebanese political powers and institutions.”He said France will work to coordinate aid but warned that “if reforms are not made, Lebanon will continue to sink.”The head of Lebanon’s customs department meanwhile confirmed in an interview with LBC TV late Wednesday that officials had sent five or six letters over the years to the judiciary asking that the ammonium nitrate be removed because of the dangers it posed.But Badri Daher said all he could do was alert authorities to the presence of dangerous materials, saying even that was “extra work” for him and his predecessor. BOSTON (AP) -- Harvard University and the Massachusetts Institute of Technology filed a federal lawsuit Wednesday challenging the Trump administration's decision to bar international students from staying in the U.S. if they take classes online this fall.The lawsuit, filed in Boston's federal court, seeks to prevent federal immigration authorities from enforcing the rule.
