Sears is swinging the ax again. The struggling retailer announced plans to close another 46 Sears and Kmart stores. The company has already closed more than 100 stores this year -- including the last remaining Sears in its hometown of Chicago -- as it attempts to stem losses.Employees at 13 Kmart stores and 33 Sears stores were notified that their locations would close by November. When Sears and Kmart merged in 2005, they had about 3,500 US stores between them. About 900 US stores remain, and more closings are likely."We continue to evaluate our network of stores, which is a critical component to our integrated retail transformation, and will make further adjustments as needed," the company said in a statement.Liquidation sales at some of the stores will start as soon as August 30.Sears has lost .2 billion since 2010, its last profitable year and sales have plunged 60% in that time. The company has been looking at selling assets as a way to raise money. In August, CEO and majority shareholder Eddie Lampert offered to buy the company's Kenmore appliance brand for 0 million, and its Sears Home Services division for between million and million.Lampert said he also plans to negotiate with lenders to try to extend the repayment schedule for some of Sears' debt.Shares of Sears plunged 35% in the week since Lampert's bid was disclosed, and hit an all-time low of .15 a share Wednesday. The stock closed trading at .18, still down 5% for the day.Stores set to close:Kmarts:Spring Valley, California,Clovis, California,Antioch, CaliforniaLos Angeles, California (at 6310 W. 3rd Street)Milford, ConnecticutNewark, DelawareSteger, IllinoisCape Girardeau, MissouriColumbus, MississippiRiverhead, New YorkGresham, OregonScott Depot, West VirginiaGillette, WyomingSears:Flagstaff, ArizonaSanta Cruz, CaliforniaGrand Junction, ColoradoTampa, Florida (at University Square Mall)Doral, FloridaNaples, FloridaSavannah, GeorgiaAtlanta, GeorgiaBrunswick, GeorgiaBloomington, IllinoisFort Wayne, IndianaFlorence, KentuckyHammond, LouisianaHolyoke, MassachusettsTaunton, MassachusettsJackson, MichiganCrabtree, North CarolinaSalem, New HampshireManchester, New HampshireMays Landing, New JerseyVictor, New YorkGlen Falls, New YorkNew Hyde Park, New YorkDayton, OhioCincinnati, Ohio (at Northgate Mall)Happy Valley, OregonHouston, Texas (at Memorial City Mall)Bryan, TexasWest Jordan, UtahFairfax, VirginiaVancouver, WashingtonEau Claire, WisconsinLa Crosse, WisconsinThe-CNN-Wire 2503

SANTA ANA, Calif. (CNS) - The Orange County Board of Education announced Wednesday that it has decided -- by a 4-0 vote -- to file a lawsuit against Gov. Gavin Newsom and the California Public Health Officer to seek a court order that sets aside the state orders preventing public schools from holding in-person classes and resuming services on campus. The vote came during a closed session Tuesday night, according to a statement. The California Supreme Court has interpreted the California Constitution to require that California school children have a constitutional right to substantially equal opportunities for learning, and the governor's order will unequally burden the most underprivileged families of California, the bard's lawyers said in a statement. The attorneys, Tyler & Bursch, LLP, of Murrieta in Riverside County, said they agreed to represent the board pro bono "to protect the vulnerable children in California."The lawsuit will also be supported by the nonprofit legal organization, Advocates for Faith & Freedom."California children have a constitutional right to both an education and equal protection under the law. The governor denied them these rights and did so without adequately considering the disparate impact these restrictions would have on the disadvantaged," said attorney Jennifer Bursch of Tyler & Bursch, LLP. "We brought this lawsuit to protect the single mom and her children, children whose parents do not read or write English, and children with special needs."The governor's ban on in-person learning will cause tens of thousands of kids to fall through the cracks and, in many cases, will be harmed for life."The Orange County Board of Education earlier this month approved a non-binding recommendation for reopening schools that would not require physical distancing or wearing masks. One of the county's largest districts, Santa Ana Unified, almost immediately rejected that advice, as did other school officials."The board majority's recommendations are not binding and La Habra City School District will not open our schools under these conditions," said that district's superintendent, Joanne Culverhouse. "The health and safety of our staff and students will guide the decisions we make for reopening our schools." 2281

Sears is getting serious about selling Kenmore. The struggling retailer announced Monday that it had formed a "special committee" to explore the sale of its in-house appliance brand. The move comes less than a month after Sears CEO Eddie Lampert wrote a letter to the board urging it to sell the brand. He offered to buy it himself if necessary, along with other assets. There is a good chance that Lampert will be the one buying Kenmore.Through his hedge fund, ESL Investments, Lampert owns a majority of shares in Sears Holding, the company that owns the Sears and Kmart chains.Sears has been exploring a possible sale of Kenmore and other assets for a number of years but never found a buyer. But this week it escalated its efforts by forming the "special committee," retaining counsel and bringing on an investment bank. The announcement was enough to briefly lift Sears shares 19% in early trading Monday, before they retreated to more modest gains of about 6%.Shares are still near historic lows. The retailer has admitted "substantial doubts" exist that it will be able to remain in business.Lampert has insisted that the company is on a path to return to profitability. But it is in need of cash and has been closing stores, cutting costs and getting creditors to agree to a longer repayment schedule on its debt. Because of that delayed repayment schedule, Sears was judged to be in default of some of its loans earlier this year.In early 2017 Sears sold its Craftsman tool brand to Stanley Black & Decker in a deal valued at 0 million. The Craftsman tools went on sale at rival Lowe's for the first time Monday. The board says it is looking at selling other assets, including its parts business and home services businesses, both of which Lampert has expressed interest in buying.  1806

SAN MARCOS (KGTV) - A report of a man shooting his wife at their North San Diego County home Tuesday may have been a swatting call, San Diego County Sheriff’s Deputies said.Deputies got a call indicating a man had opened fire on his wife at a home in the 1400 block of Clearview Way near San Elijo Park in San Marcos about 2:30 p.m.Investigators surrounded the home, breaking down the door with guns drawn. They found the man unarmed on the balcony. No victim was in the home. Several schools were temporarily placed on lockdown. The man’s wife later arrived at the scene, unaware of the situation. The woman, who did not want to be identified,  told 10News she and her husband are gamers with millions of followers. "People always have an opinion and they may not like what you do or say and sometimes it’s taken to an extreme when they call the cops on you," said the man's wife. The wife said her husband had no idea deputies had entered the home until he heard shouting. He usually wears a headset while he's playing. "He heard 'this is the police'. I think he heard it, 'this is the police' and he took his headset off and he came downstairs and he saw guns being pointed at him and he wanted to show his hands because he was afraid to get shot," she said. The call made to deputies was traced back to a doctor’s office in Michigan, according to the San Diego County Sheriff’s Department. Deputies confirmed the call was a hoax.Swatting is the practice of making a hoax call about a crime to draw law enforcement officers to a specific location. The San Marcos man said he had been playing an online game when the incident happened. This story has been updated from the initial Sheriff's Department report that a woman had been shot at the home. 1801
