BOSTON (AP) — A federal appeals court has upheld a district court decision clearing Harvard University of intentional discrimination against Asian American applicants. Two judges on the 1st U.S. Circuit Court of Appeals in Boston rejected claims from an anti-affirmative action group that accuses the Ivy League university of imposing a "racial penalty" on Asian Americans. The decision delivers a blow to the group, Students for Fair Admissions, and moves the case a step closer to a possible review by the U.S. Supreme Court. The group's 2014 lawsuit alleges that Harvard's admissions officers use a subjective "personal rating" to discriminate against Asian Americans who apply to the school. Harvard denies any discrimination.According to the Associated Press, the judges concluded that Harvard does not place outsized emphasis on race. 848

Before arriving for jury duty on Monday, prospective panel members filled out a lengthy questionnaire that might have given them pause."The case for which you are summoned involves the defendant JOAQUIN ARCHIVALDO GUZMAN LOERA, also known as 'El Chapo,' " read query No. 48. "Have you read, seen or heard anything about the defendant, the case, or people involved?"It would be hard not to."In some ways, this case is unprecedented; the amount of public attention has been extraordinary," Brooklyn U.S. District Court Judge Brian Cogan wrote in a recent ruling. That will be a major challenge when jury selection begins on Monday for Mexican cartel boss Joaquin "El Chapo" Guzman.Everything is extraordinary in the long-awaited case against a defendant once considered the world's most powerful drug trafficker. The international scope of an alleged criminal enterprise that spanned continents "makes it an outlier among even the biggest drug prosecutions to date," Cogan wrote last week. 993

Both Nevada and Pennsylvania — two closely contested states in the presidential election — certified results Tuesday, officially declaring president-elect Joe Biden the winner in both states.Pennsylvania Gov. Tom Wolf tweeted Tuesday that the Pennsylvania State Department “certified the results of the November 3 election in Pennsylvania for president and vice president of the United States. As required by federal law, I’ve signed the Certificate of Ascertainment for the slate of electors for Joe Biden and Kamala Harris.” The certification confirms that the state's 20 electoral votes will flip to Biden. Trump defeated Hillary Clinton in his 2016 election win.Trump made the state a centerpiece of his unsuccessful legal attempts to invalidate the election results. His campaign and legal team filed several lawsuits alleging widespread fraud and inconsistencies, though none of those claims were ever proved in court. 932

BOSTON (AP) — The Boston Red Sox has rehired Alex Cora as manager. The team decided about a week after Cora finished the one-year suspension handed down by Commissioner Rob Manfred for sign-stealing while he was the bench coach in Houston in 2017.The move returns him to the Boston dugout less than a year after the ballclub let him go because of his role in the Houston Astros cheating scandal.Major League Baseball said the Astros decoded pitch signs by using their video replay system. To alert the batter, members of the Astros would relay the information with a noise, which included banging a trash can.The Red Sox dismissed Cora in January. In April, after an investigation into the Red Sox, MLB stripped the Red Sox of their second-round pick in this year's amateur draft for breaking video rules in 2018. The league suspended then-former manager Cora through the 2020 postseason, the Associated Press reported.Per the AP, MLB also suspended the Red Sox's replay system operator J.T. Watkins after they found that he used in-game video to revise sign sequences provided to players.Cora joined the Red Sox in 2018 and led them to the World Series championship. 1173
