(KGTV) -- A strong warning from the mother of a La Jolla teenager injured in a deadly car crash on the way to Coachella.10News spoke with Eva Cerciello at the hospital where her daughter is recovering. Doctors have taken out her feeding tube and she is now awake.Sadly, her cousin was killed in the crash while the driver walked away with minor injuries. Cerciello says she’s been relying on prayers and positive thinking for strength. As more San Diegans head to Indio for weekend two of the Coachella music festival,Cerciello has a harsh warning that they shouldn’t put themselves in danger. She nearly lost her daughter last week. “She's like a miracle,” Cerciello said. Manuela Cerciello-Rahbari, 16, suffered severe brain damage when the BMW she was in with her cousin and a friend who was driving veered off the road. They slammed into two trees on I-10, 40 miles away from the festival. “Their main goal was to be there at 7 a.m.,” Cerciello said. They left around 3 a.m., but never made it. “The driver fell asleep while driving. They were both asleep, my niece and my daughter,” she said.Cerciello says she even called to warn them. “If you're tired, you need to stop. You don't keep on going,” she said. “You can’t challenge your body.”Their car was part of a caravan with friends and Cerciello feels peer pressure played a deadly role. “I know the kids were texting ‘speed up, speed up’ because we have all the messages.” Now, she's passing along her own message to other parents and their children.“Parents, they think ‘Don't drink. Don't drive. Don't do drugs…and everything will be fine.’ No, not everything will be fine,” Cerciello said.To be clear.. no drugs or alcohol were involved the crash, but she just wants people to see the reality of poor-decision making-- and says be smart.“You will never have the same life again. Never. Never. Because even if physically you are ok, psychologically you will never be the same.”While Cerciello knows her daughter's future is unclear... “I need to be strong. If I'm not strong, who's gonna be strong?”She doesn't want anyone else to experience her pain. "[If] I can help even one person, I’m good with that.” It’s is an eerily familiar situation for Cerciello.Four and half years ago, her son, Carlo, was also in a major accident and suffered brain damage. He is still in physical therapy today. In the meantime, the family has set up a GoFundMe page to help pay for medical expenses as well as research for brain injuries. (KGTV) – A bill to end the retail sale of dogs, cats, and rabbits in California is heading to Gov. Gavin Newsom's desk for approval.Assembly Bill 2152, known as "Bella’s Act," would ban the retail sale of dogs, cats, and rabbits, while allowing stores to partner with rescues and shelters for adoption events. The bill stops pet stores from receiving any money from adoption transactions or from using the store or its resources in connection with adoption events.Assemblymember Todd Gloria, of San Diego, introduced the bill in February 2020. The bill is sponsored by the San Diego Humane Society.RELATED:San Diego area puppy stores accused of selling dogs from puppy millsFake animal rescue group sued for alleged "puppy laundering scheme"San Diego-area pet stores cited for illegal puppy sales"The mass breeding operations of puppy mills are unhealthy and inhumane. We don’t want animals experiencing that cruelty in California," said Assemblymember Todd Gloria. "Bella’s Act will finally fulfill our state’s promise to end the illicit puppy mill industry and encourage pet retailers to partner with rescues and shelters for adoption events. I urge the Governor to sign this bill and ensure we no longer tolerate or facilitate puppy mill cruelty in this state."While California implemented a ban on the sale of dogs, cats, and rabbits in retail stores in 2019, unless the animals were obtained from a shelter or rescue group, some retails utilized a loophole in the law by importing animals from outside the state for sale.Bella's Act was named after a corgi named "Bella" who was illegally bred in a puppy mill, before being sold in a San Diego County pet store where she was advertised as a rescue animal. Bella sold for thousands of dollars. Her owner says the dog was declawed while in the puppy mill and developed severe bronchitis that led to costly medical bills.Bella has since recovered but still suffers from anxiety.San Diego Humane Society President and CEO Dr. Gary Weitzman said, “We are thrilled with the passage of AB 2152, Bella’s Act, to close loopholes in the law that allowed unscrupulous pet store owners to continue to ship puppy mill puppies into our state for sale. Thanks to Assemblymembers Gloria and O’Donnell, California will finally end the retail sales of dogs, cats and rabbits once and for all. We look forward to receiving Governor Newsom’s signature and to the impact this critical legislation will have on the importation and sale of inhumanely bred animals in our state.” 2518

(KGTV) - A bill that would create the option for a third gender marker on California driver's licenses and birth certificates is heading to the state Senate.SB 179, also known as the Gender Recognition Act and introduced by Senator Toni Atkins, passed through the State Assembly 50-13 and will now return to the Senate for approval of amendments made in the assembly. If approved in the Senate, it will head to Governor Jerry Brown's desk for signing.RELATED: San Diegan third in nation to change gender to 'nonbinary'California Assemblymember Todd Gloria (D-San Diego), a co-author of the bill, said the legislation aims to end the stigma and hardships Californians face when it comes to government documentation.“All too often, members of our transgender, intersex, and nonbinary community experience hardships and even stigma when their government documents don’t match their gender presentation," Gloria said in a release. "Despite the divisive rhetoric at the federal level, SB 179 demonstrates the inclusiveness of California and represents recognition from government that people can exist as more than just male or female."In addition to a third gender marker on state-issued identification documents, the bill is also designed to "streamline" the process for transgender, intersex, and nonbinary Californians to get those certificates.RELATED: Oregon becomes first state to allow gender-neutral licensesCurrently, changes to gender in California require proof of "clinically appropriate treatment." Atkins' bill does away with this requirement.Under the bill, anyone who chooses to change their gender would be allowed to "to attest, under penalty of perjury, that the request is to conform the person’s legal gender to the person’s gender identity and not for any fraudulent purpose."If approved, this portion of the bill would go into effect September 2018.In the case of driver's licenses, the bill would require an applicant to have the choices of male, female, or nonbinary, as specified, available. This portion would go into effect January 2019, according to the bill's text.Read the bill's full text here. 2164
