SAN DIEGO (KGTV) — A Southern California athlete said his life was changed forever from a stem cell product he said came from a San Diego company. “It’s been tough. And it’s still tough,” said Alex Reyes. Team 10 interviewed Reyes at a San Bernardino park, where he took a few moments to play with his young children. Those are the moments he treasures because last year, even holding his kids was something he could not do. “I couldn’t walk for about three and a half to four weeks. I was on a bedpan. It was one of the hardest things I had to go through in my life,” Reyes said. This is coming from a man used to taking punches. He has several accomplishments in mixed martial arts, including King of the Cage Junior Welterweight and Lightweight Champion, as well as the International Brazilian Jiu-Jitsu Federation Absolute Purple Belt Champion. Reyes was signed to the UFC back in September of 2017 to compete in the Lightweight Division. In the UFC, he was known as the Executioner. “It was just the beginning for me,” Reyes said.He started doing stem cell injections last year to help with an old back injury. “It was kind of nagging,” he told Team 10.The first one he tried went well. “It helps regenerate the tissue… there was improvement, and I felt better,” he said. The second time, Reyes said he went to a different clinic in Las Vegas in June 2018. According to his lawsuit, the product used was from the ReGen Series?, developed and manufactured by Genetech. Genetech is not related to the biotechnology company Genentech.“After I got the injection a few days later, I couldn’t walk anymore, I couldn’t stand I couldn’t sit, I couldn’t move. It was really bad,” Reyes said. The lawsuit states patients from all over the country used the Genetech stem cell products from the ReGen Series?, but there were problems. The court documents show Health Departments in Texas and Florida received notification of bacteria in patients who received those injections. Genetech, which used to operate at a building on Bunker Hill Street on the edge of Pacific Beach, is now closed. However, federal regulators are currently looking into the company’s operations. A letter issued late last year by the Federal Drug Administration warned Genetech about several violations with “potential serious risks to patients.” The FDA and Centers for Disease Control are aware of at least 12 patients who received Genetech products. According to the FDA warning issued in late 2018, the federal agencies “have received numerous reports of safety issues including those involving microbial contamination… and subsequently became ill due to blood and other infections caused by bacteria, including Escherichia coli (E. coli).”“I was really terrified,” said Alex’s wife, Rosalie Reyes. “I didn’t know what to think. Is he dying? Am I losing my husband?”In September, the distributor Liveyon suspended shipment of its product and then voluntarily recalled all Genetech products it may have distributed, according to the FDA. 3016

SAN DIEGO (KGTV) — A Superior Court judge gave San Diego County restaurants the green light to serve on-site again, but not all will make use of the opportunity. For Roddy Browning, the pressure to reopen his restaurant is intense.“We lay in bed at 2:30 in the morning, going, 'Okay, what am I going to do? What am I going to do tomorrow? What am I going to do the next day?'” said Browning, who owns Oceanside's Flying Pig Pub and Kitchen.Browning said sales are down 60% and employees have been reduced from 30 to 12. Reopening for outdoor dining under the new court ruling could boost those numbers.“The state's going to appeal it, and what is the point in opening back up again, and then bringing all these people back to work and saying okay guys the ruling changed, now we're going to have to kick you out of the restaurant again,” Browning said. “I don’t want to do that to my employees anymore.”Don't get him wrong. Browning does plan to reopen under the new court order - but he wants to respect the full three weeks intended in this latest shutdown order, set to complete on Dec. 28."This is not about us against them," Browning said. "We said we would give the governor his three weeks, and I'm going to give him his three weeks."But other San Diego restaurants are planning to remain takeout only until health officials advise otherwise. At Spring Valley's Cali-Comfort Barbecue, a gathering place for sports fans, owner Shawn Walchef says he's not offering indoor or outdoor dining.“We believe that the coronavirus is the antithesis of hospitality. Everything we do in our blood is to take care of people,” Walchef said. “Social distancing doesn’t work in our business. We welcome people into our homes.”Walchef cut about half of his staff - a day he calls his toughest as a restaurant owner. But he says Cali Comfort has fully embraced multiple digital ordering systems, helping it to remain profitable amid the pandemic.Still, the recent order impacts many. Nearly 110,000 San Diegans worked in county restaurants in October, the latest state data available. Numbers for November are expected Friday. 2120

SAN DIEGO (KGTV) — A staff member at West Hills High School has tested positive for COVID-19, according to Grossmont Union High School District. The families of 23 students in classes affected by the positive test have been notified and will not participate in in-person classes for 14 days, according to GUHSD PIO Catherine Martin. Those students will continue their instruction virtually during that time, Martin added. All other West Hills students will continue their in-person or distance learning classes as scheduled. In a letter to parents, West Hills High principal Robin Ballarin said after reviewing the positive test with public health officials, there is no need to close the school for in-person learning."We have cleaned and disinfected, as appropriate, and our campus has been deemed safe for occupancy. We understand that this information is concerning. Staff members and students who may have come into close contact with the individual will be directly contacted by San Diego County Public Health with further instructions. We are working with public health to continue monitoring the situation, and we are strictly following all public health guidelines," Ballarin wrote. The identity of the staff member was not released due to privacy laws.According to the California Department of Public Health's guidelines for school reopenings, two-week closures will be put in place if at least 5% of the total number of teachers, students, or staff test positive in a classroom or school, or 25% of a district’s population tests positive.10News is monitoring this breaking news. 1593

SAN DIEGO (KGTV) -- A San Diego woman said her ex-boyfriend stole naked pictures of her and posted one online without her permission. She said people saw the post and took screenshots of it.She’s now suing the man she says posted the photo, her ex-boyfriend William Ashley Oliver III."This pretty much consumed my life,” she told Team 10 investigator Adam Racusin. That’s L.S describing how one social media post of her naked body wrecked her sense of security. 10News is not naming the woman, but instead using the initials L.S. as they appear in her lawsuit against Oliver to protect her identity.“He was threatening for so long to do it that I didn't think he'd really do it,” she said.Their relationship started as most do: Girl meets boy, they fall in love and move in together. "I felt like I really got to know him fast and fell in love fast,” she said.Just like many relationships, everything was great until it wasn't. Unlike the typical breakup story, here's where this takes a different path.L.S. said she moved back to California in October of last year, about eight months after the relationship started.Oliver came to visit in late November, but things did not go well, she said. She said her ex-boyfriend became aggressive."He smashed my laptop in two, he smashed my brand new iPhone on the ground until it was shattered, and was calling me really horrible things,” she said.According to the lawsuit she filed, before leaving, Oliver took L.S’s passport and jewelry from the bathroom sink.A few days after that incident, while Oliver was still in San Diego, he began sending harassing text messages and copies of private photographs to L.S. to make it clear that at some point in their relationship he illegally accessed her computers and cell phones and stole sexually explicit and private digital photographs without her consent, the lawsuit stated."The pictures that he had were never sent to him they were taken before I ever met him," she said.According to the lawsuit, Oliver texted her: “Posted all your naked pics to the industry whore boards.” It said he also wrote among other things: “Your pics are getting blasted on services Moxy.”The lawsuit says L.S.’s pleas for Oliver to stop had no effect on him. The lawsuit claims Oliver then posted a sexually explicit photo of her on his public Instagram account, accessible by anyone, followed with the text: “(y)our naked pics are starting to proliferate.""My best friend sent me a text message, and she just said oh my god, and it was a screenshot of the picture that Will had posted on Instagram of me,” she said.Team 10 investigator Adam Racusin asked her what she thought when she saw that.“I was just so scared,” she said. “I was just devastated.”According to the lawsuit, Oliver admitted he posted the picture. The lawsuit stated L.S. was informed by a friend and multiple colleagues that they saw the photograph on Oliver’s Instagram site and knew it was her."I don’t know how many people have that; it's everywhere,” she said.Team 10 tried to get a hold of Oliver, but he hung up after answering once and didn’t respond to our request for comment.L.S is suing Oliver for revenge porn among other things. She said having her body on display for anyone to see is sickening. When Team 10 asked her how often she thinks about it, she said, “Every day, every day, many times a day.”L.S. did call the police but did not press charges against Oliver. Revenge Porn is a crimeIn California, revenge porn is a crime. The San Diego City Attorney’s Office said they prosecute revenge porn as a misdemeanor within its jurisdiction. The Penal Code section is 647(j)(4)(A).Typical punishment may include custody of up to six months in county jail per charge, three years of probation, public work service, counseling, a waiver of Fourth Amendment Rights, and fines of up to ,000 per charge.A spokesperson told 10News they’ve filed the charge 11 times since 2015, with nine cases resulting in a conviction, one awaiting trial, and one defendant failing to appear at arraignment.“Revenge porn is an egregious betrayal of a person’s trust, an attack on their privacy and reputation,” said City Attorney Mara W. Elliott. “Victims should know that our Sex Crimes Unit prosecutes these cases aggressively.”A spokesperson for the San Diego County District Attorney said from 2015 to 2018 they located six cases where the facts are consistent with ‘revenge porn.’ 4432

SAN DIEGO (KGTV) — An unresponsive man was pulled to shore Wednesday after possibly being swept out to sea by strong waves along Ocean Beach's coast.San Diego Fire-Rescue lifeguards responded to reports of the man not breathing at about 2 p.m. at Dog Beach. Lifeguards on jet skis found the man lodged into the rocks on the jetty, according to SDFD Sgt. Bruce Jamieson. He had reportedly been swept about 75 yards from shore, according to SDFD.Lifeguards performed CPR and rushed the man to a nearby hospital, but did not give an update on his condition.Witnesses said the man, who is approximately 50-years-old and from Nevada, may have been chasing after his dog in the water when he was pulled out to sea.A high surf advisory was issued for San Diego County's coastline from 10 a.m. Wednesday to 10 p.m. Thursday, bringing large sets and the threat of rip currents to the area's shores. Due to the high surf, lifeguards closed Ocean Beach Pier early Wednesday. 971
