LOS ANGELES (CNS) - Uber and Lyft will keep operating in San Diego and across California -- for now -- with a state appeals court Thursday putting on hold a ruling requiring the ride-hailing companies to classify their drivers as employees instead of independent contractors.The decision by the state's 1st District Court of Appeal averted threats by Uber and Lyft to shut down all California operations at midnight. Uber officials said earlier this week they would likely shut down, and Lyft issued a statement earlier Thursday saying its operations would be halting at midnight.In a blog post on Thursday morning, Lyft stated: “At 11:59PM PT today our rideshare operations in California will be suspended. This is not something we wanted to do, as we know millions of Californians depend on Lyft for daily, essential trips.”Lyft added: “This change would also necessitate an overhaul of the entire business model -- it’s not a switch that can be flipped overnight.”The dispute traces its roots to the state's passage of Assembly Bill 5, which effectively required the companies to classify their drivers as employees, a move supporters said would guarantee their wages and assure them of other benefits and workplace protections.The companies, however, said the move would require a complete overhaul of their operations and would actually hurt drivers -- forcing them to work set schedules instead of giving them the flexibility to work only when they wanted. The companies also said the move would result in many drivers losing their jobs unless they could work standard hours, and would likely also harm overall service for riders.California Attorney General Xavier Becerra, and the city attorneys of San Diego, Los Angeles and San Francisco argued in court that Uber and Lyft have misclassified their drivers as independent contractors, preventing them from receiving "the compensation and benefits they have earned through the dignity of their labor" such as the right to minimum wage, sick leave, unemployment insurance and workers' compensation benefits.On Aug. 10, San Francisco-based Judge Ethan P. Schulman ruled against the companies, but he stayed his decision for 10 days to give them time to appeal. They did so, resulting in Thursday's last-minute ruling putting Schulman's ruling on hold.The court, however, warned the companies to continue preparing for the possible switch to employee drivers, saying each company must submit a sworn statement by Sept. 4 "confirming that it has developed implementation plans." The companies must also affirm they are prepared to actually implement those plans and switch to the employee system within 30 days if they ultimately lose their appeal and a company-sponsored measure on the November ballot fails.That ballot measure, Proposition 22, would allow ride-hailing drivers to work as independent contractors.The court scheduled oral arguments in the appeal for Oct. 13.Lyft contends that four out of five drivers prefer working as independent contractors so they can have more flexibility. 3056

LOS ANGELES (CNS) - The Automobile Club of Southern California says it's expecting this year's Thanksgiving holiday to be the busiest in Southern California since 2005, with 4.2 million residents expected to get away for the long weekend.That's a 5.1 percent increase over last year, the AAA said in a statement. The vast majority of Southern California travelers -- 3.6 million or 86 percent of all travelers -- will drive to their destinations, a 5.1 percent increase over last year. Another 476,000 Southern Californians are expected to fly, which is an increase of 5.9 percent from the 2017 holiday, while 123,000 will go by other means, such as train, bus or cruise, which will represent a 1.2 percent increase over last year.The Thanksgiving holiday travel period is defined as five days from Wednesday, Nov. 21 to Sunday, Nov. 25, and a holiday trip is defined as one of at least 50 miles from home.The all-time record number of Thanksgiving travelers was set in 2005, when 58.6 million nationwide, 6.9 million statewide and nearly 4.3 million in Southern California took holiday trips.RELATED: Check?traffic conditions for your holiday trip``Even with an average 5 percent increase in Thanksgiving holiday airfares over last year, consumer confidence has continued to increase demand for air-travel destinations,'' said Filomena Andre, the Auto Club's vice president for travel products and services.Anaheim is expected to be the third most popular destination for Thanksgiving travelers nationwide, according to AAA's online and travel agency bookings.  A survey of the Auto Club's travel agents reveals the top five destinations for Southern Californians this holiday are: 1) Las Vegas  2) San Diego  3) San Francisco  4) Grand Canyon  5) Anaheim.The transportation analytics firm INRIX, in collaboration with AAA,predicts drivers will experience the greatest amount of congestion Thanksgiving week during the early evening commute period, with travel times starting to increase on Monday.In general, the Auto Club recommends travelers plan an early morning start. If travelers' schedules are flexible, the best days to travel during Thanksgiving week will likely be early today, Friday and Saturday.``No matter when drivers leave for their holiday trips, we remind them, `Don't Drive Intoxicated,'' said Auto Club spokesperson Jeffrey Spring.``An increase in traffic requires extra focus on the road ahead and we want drivers to remember texting while driving could lead to the same deadly consequences as alcohol-impaired driving.''According to INRIX, the heaviest congestion period in Southern California will be between 2:30 and 4:30 p.m. Wednesday, Nov. 21, on southbound Interstate 5 between Pacific Coast Highway in south Orange County (Exit 79) and Coast Highway in Oceanside (Exit 54B). The worst time to leave from downtown Los Angeles for LAX via I-110 South over this holiday period, according toINRIX, will be Tuesday, Nov. 20 between 7 p.m. and 9 p.m.Southern California gas prices are dropping at a fairly steady pacefrom their highest levels since 2014 but are expected to still be 50 to 60 cents higher per gallon than during last year' holiday. The Auto Club recommends that travelers use a free app like AAA Mobile to shop virtually for the cheapest gas prices along their route.AAA expects to help 101,000 stranded drivers in California and nearly 360,000 at the roadside across the country during this Thanksgiving holiday.Dead batteries, flat tires and lockouts will be the main reasons for members to call AAA for a roadside rescue. LOS ANGELES (CNS) - The company that operated the helicopter that crashed in Calabasas in January, killing Laker legend Kobe Bryant and eight others, is fighting back against lawsuits over the tragedy, filing a suit of its own contending air-traffic controllers are to blame for the crash.The suit, filed last week as a cross-complaint to litigation against Island Express Helicopters, contends the crash was "caused by a series of erroneous acts and/or omissions" by a pair of air-traffic controllers at Southern California TRACON, or terminal radar approach control.Ian Gregor, a spokesman for the Federal Aviation Administration, which operates the facility, said the agency "does not comment on pending litigation."The helicopter, a 1991 Sikorsky S76B piloted by Ara Zobayan, crashed amid heavy fog on Jan. 26 on a Calabasas hillside, killing the pilot and his eight passengers, including Bryant and his 13-year-old daughter Gianna.At least four lawsuits have been filed against Island Express Helicopters in the months since the crash, including one by Bryant's wife, Vanessa, and others by relatives of other passengers aboard the aircraft.In its cross-complaint, attorneys for Island Express contend that Zobayan contacted the SoCal TRACON facility and requested "flight following," or radar assistance. The request, however, was denied by an air-traffic controller who said, "I'm going to lose radar and comms probably pretty shortly," according to the lawsuit."This denial was improper because radar contact had not been lost and services were being denied based on the possibility that they might be lost at some point in the future," the lawsuit states. "The fact that (the pilot) was able to contact (TRACON) four minutes later, and its transponder was still observed by the controller, proves that the prediction of lost contact was not accurate and services could and should have been provided continuously."The lawsuit claims that the air-traffic controller who initially spoke to Zobayan was relieved a short time later by a second controller. The first controller, however, failed to inform his replacement "as to the existence" of the helicopter, even though he had never "terminated radar services" with the helicopter, leading the pilot to assume "he was still being surveilled and being provided flight following."It was at roughly that point that Zobayan reported his plan to begin climbing above the clouds and fog while banking to the left. A short time later, the helicopter plunged rapidly into the ground, resulting in the fiery crash that killed all aboard, according to the lawsuit.The suit accuses the initial air-traffic controller of "multiple errors," including "failure to properly communicate termination of radar flight following, incomplete position relief briefing and lack of knowledge of current weather conditions." Those failures added to the pilot's stress, workload and distraction, and "significantly impacted the pilot's ability to fly the aircraft."The suit seeks unspecified damages. 3039

  

LOS ANGELES (CNS) - Disgraced former film producer Harvey Weinstein -- who was already charged in Los Angeles with sex-related charges involving three women -- was charged Friday with sexually assaulting two other women in Beverly Hills.Los Angeles County prosecutors filed three new counts each of forcible rape and forcible oral copulation against Weinstein, who is behind bars in New York after being convicted there of sexually assaulting two women.The latest charges involve the alleged rape of a woman at a hotel in Beverly Hills between September 2004 and September 2005 and two alleged attacks on a woman in November 2009 and November 2010 at a hotel in Beverly Hills, according to the Los Angeles County District Attorney's Office.Weinstein was charged Jan. 6 with one count each of forcible rape, forcible oral copulation, sexual penetration by use of force and sexual battery by restraint in connection with alleged crimes involving two women in 2013, and prosecutors subsequently filed a charge of sexual battery by restraint in May involving a third woman at a Beverly Hills hotel in May 2010.Weinstein, 68, could face up to 140 years to life in state prison if convicted as charged, according to the District Attorney's Office.Los Angeles County District Attorney Jackie Lacey said in a written statement that she is "thankful to the first women who reported these crimes and whose courage have given strength to others to come forward.""The willingness of these latest victims to testify against a powerful man gives us the additional evidence we need to build a compelling criminal case," the county's top prosecutor said.In July, the District Attorney's Office announced that it had filed court papers to move the extradition process forward, and an extradition hearing is set Dec. 11 in Buffalo.It remains unclear exactly how soon Weinstein will be brought to Los Angeles County.The case remains under investigation by the Los Angeles and Beverly Hills police departments and the District Attorney's Bureau of Investigation. 2050

  

LOS ANGELES (AP) — Members of the Trump administration visited Los Angeles Tuesday to get a firsthand look at the city's sprawling homeless encampments and efforts to control them, while President Donald Trump directed his staff to develop policy options to address the national crisis of people living on the streets.The visit by a delegation from several federal agencies came about two months after the Republican president called the homelessness crisis in Los Angeles, San Francisco and other big cities disgraceful and faulted the "liberal establishment" for the problem.In July, Democratic Mayor Eric Garcetti issued a public invitation for the Republican president to walk the streets with him and see the suffering and squalid conditions. The mayor released a letter to Trump on Tuesday saying he looked forward to working together, but tensions between the White House and officials in heavily Democratic California were also on vivid display.Gov. Gavin Newsom has sparred with the White House routinely, and his office released a statement Tuesday saying the state was ready to discuss serious proposals but Trump "could start by ending his plans to cut food stamps, gut health care for low-income people and scare immigrant families from accessing government services."San Francisco Mayor London Breed said in a statement that the city would welcome assistance from the federal government to build more housing "but simply cracking down on homelessness without providing the housing that people need is not a real solution."Garcetti, too, said he was ready to talk but wrote that "the federal government has woefully underfunded our housing safety net, contributing to homelessness" and slashed funding for new housing."We must put politics aside," he wrote.And at an event Monday in Beverly Hills, sponsored by the website Politico, Garcetti's chief of state and federal affairs, Breelyn Pete, said the city looked forward to explaining its homeless strategy to administration officials but added, "They're just not thoughtful, and quite frankly not smart enough, to know what we're doing."Trump would make an unlikely pairing with the Los Angeles mayor, who comes from a heavily Democratic state recognized as the center of the so-called Trump resistance. Trump lost California to Hillary Clinton in the 2016 election by over 4 million votes.White House spokesman Judd Deere echoed Trump's earlier remarks linking homelessness with liberal policies, saying "the president has taken notice of the homelessness crisis, particularly in cities and states where the liberal policies of overregulation, excessive taxation, and poor public service delivery are combining to dramatically increase poverty and public health risks."Like many big cities, Los Angeles has struggled with homelessness for decades, and the population on the streets has grown despite a robust economy. Filthy, drug-infested encampments line downtown streets, and homeless people often sprawl on the lawn of City Hall, with tents nearby. The mayor says 36,000 people in the city are homeless on any given night.Figures released in June showed a 16% jump in Los Angeles' homeless population over the last year. The jump came after the mayor helped convince voters in 2016 to borrow .2 billion to construct housing for the homeless.The mayor's office said the federal group visited several homelessness projects, including a recently opened shelter.On Tuesday, Sacramento County and the city of Sacramento joined the fight to overturn a federal court ruling barring municipalities from prosecuting homeless people for sleeping on the streets if there are no available shelter beds, The Sacramento Bee reported .The Trump administration provided no specifics on what its national homeless policy would entail.Taylor Griffin, a spokeswoman for House Speaker Nancy Pelosi, said, "Homelessness is a challenge to the conscience of our nation and a growing humanitarian crisis for communities across our country.
