(CNS) - A verdict has been reached in the trial of a woman and her gun instructor who are accused of carrying out a plan to kill the woman's estranged husband.A jury has found Diana Lovejoy, 44, guilty of conspiracy to commit murder and attempted murder. Welcon McDavid Jr. was also found guilty of conspiracy to commit murder, but the reading of the verdict had to be postponed because Lovejoy passed out. Lovejoy and McDavid Jr. were charged with conspiracy to commit murder and attempted murder in the Sept. 1, 2016, attack on 45-year-old Greg Mulvihill, who was wounded in the 11 p.m. shooting in Carlsbad.Police allege Lovejoy and McDavid planned the crime and that the latter - - who worked at a gun range where Lovejoy was taking marksmanship lessons -- called the victim, arranged to meet him in the alley and opened fire on him with a rifle while hiding in a patch of bushes.Court records indicated Lovejoy and Mulvihill were in the midst of a contentious divorce, and that she had obtained a restraining order against him on accusations of emotional and sexual abuse.Mulvihill took the stand during the trial and described the moments leading up to him being shot, saying he didn't realize he'd been shot right away and, at first, he thought he felt something in his back even though he could see the shooter in front of him.Mulvihill testified about a bitter custody battle with his estranged wife.Mulvihill said he went up a remote trail in Carlsbad out of desperation, fearing Lovejoy would reopen their custody battle. He took a friend, a flashlight and a small aluminum baseball bat, but he thought he was picking up documents from a private investigator.Instead, as he approached the spot off Rancho Santa Fe Road and Avenida Soledad, he shined his flashlight around and spotted someone dressed in camouflage pointing a long gun right at him.Before he knew what was happening, Mulvihill said he was hit once in the side, the bullet exiting out his back. McDavid faces 50 years to life behind bars, and Lovejoy could be sentenced to 25 years to life.After court, the jury foreperson, Erin Reed,  told reporters the defense version of the shooting "seemed too far-fetched." 2224

WASHINGTON (AP) — A statue of Confederate Gen. Robert E. Lee that represented Virginia in the U.S. Capitol has been removed.Virginia Gov. Ralph Northam said in a statement that workers removed the statue from the National Statuary Hall Collection early Monday.“The Confederacy is a symbol of Virginia’s racist and divisive history, and it is past time we tell our story with images of perseverance, diversity, and inclusion,” said Northam.Each state is entitled to display two statues in the collection. Lee’s statue had stood with George Washington’s statue since 1909 as Virginia’s representatives in the Capitol.The Lee statue had been one among 13 located in the Crypt of the Capitol, representing the 13 original colonies.Northam had requested its removal and a state commission has recommended replacing Lee’s statue with a likeness of Barbara Johns.Johns was an American civil rights leader who protested poor conditions at her all-Black high school in the town of Farmville in 1951. Her court case became part of a landmark U.S. Supreme Court decision that struck down racial segregation in public schools.Virginia’s General Assembly must approve the replacement before a sculptor can be commissioned for the new statue. WASHINGTON (AP) — Dozens of email accounts at the Treasury Department were compromised in the massive breach of U.S. government agencies being blamed on Russia. That's according to an Oregon Democrat, Sen. Ron Wyden, who says hackers broke into systems used by the department’s highest-ranking officials. Wyden issued a statement Monday after he and other members of the Senate Finance Committee were briefed by the IRS and the Treasury Department. Wyden says that though there is no indication that taxpayer data was compromised, the hack “appears to be significant." In addition, the breach appears to involve the theft of encryption keys from U.S. government servers, Wyden said.“Treasury still does not know all of the actions taken by hackers, or precisely what information was stolen,” Wyden said in a statement.It is also not clear what Russian hackers intend to do with any emails they may have accessed.A Treasury Department spokeswoman declined to comment on Wyden’s statement.Treasury was among the earliest known agencies reported to have been affected in a breach that now encompasses a broad spectrum of departments. The effects and consequences of the hack are still being assessed, though the Department of Homeland Security’s cybersecurity arm said in a statement last week that the intrusion posed a “grave” risk to government and private networks.In the Treasury Department’s case, Wyden said, the breach began in July.
