SAN DIEGO (KGTV) -- A former professional skateboarder convicted of raping and murdering a woman in Carlsbad nearly three decades ago is suitable for parole, a hearing panel at Donovan Correctional Facility determined Tuesday.The Board of Parole Hearings panel determined Mark “Gator” Rogowski is not an unreasonable risk to the community, setting him up for release despite objections from the victim’s father and the San Diego County District Attorney’s Office over a crime that stunned the region in the 1990s.“We think the decision did not take into account the grave public safety concerns posed by this inmate. We think he still poses a threat, especially to women,” said Supervising Deputy District Attorney Richard Sachs. “When someone does something as horrible as this, it shocks the conscience that they would be granted parole,” he added.A world champion skateboarder in the 1980s, Rogowski was convicted of beating Jessica Bergsten with a metal rod into semi-consciousness, raping her, wrapping her in a surfboard bag, and strangling her to death in a fit of rage that spanned three or more hours. Rogowski later buried her body in the desert.Bergsten was a friend of Rogowski's ex-girlfriend. He said he took out his rage from the break-up on Bergsten, a college student and part-time model, in a case of "misplaced revenge."“The pain never goes away,” the victim’s father Stephen Bergsten told the panel. “This inmate received a life sentence, but he imposed a death sentence upon Jessica and our family.”Commissioner Brian Roberts said the panel took several factors into consideration, including Rogowski’s remorse for the crime, lack of significant criminal history, good behavior in custody, and rehabilitation programs he has completed during his 27 years in prison.Roberts said the panel also put significant weight on a new law that gives added leniency to “youthful offenders” who commit crimes before the age of 26. The law, which took effect in 2018, is based on studies showing the impulse control architecture in the brain is not fully developed in most people until about age 25.“I’m disgusted with what I did. I think about it every day,” Rogowski told the board. “I took everything from that poor family. They have every right to be angry with me. I want to make it go away but I can’t.”The Board of Parole Hearings has 120 days to finalize the decision. After that, the case will go before the governor for review.“Unfortunately, justice wasn’t served today, but the governor will have a chance to look at this case and we hope he will,” Deputy DA Sachs said.Commissioner Roberts ordered Rogowski to live temporarily in transitional housing upon release. SAN DIEGO (KGTV) -- A father and daughter were taken to the hospital for injuries related to an apartment fire in Carmel Valley Tuesday afternoon. According to the San Diego Fire-Rescue Department, firefighters were called to an apartment complex on the 12000 block of Torrey Bluff Drive around 4:30 p.m. The department says the man was taken to the hospital with burns to his hands and face while his daughter was hospitalized for smoke inhalation. The fire was reportedly contained to only one room of the apartment. Preliminary investigations revealed that the blaze may have been started by some sort of device the father was using to smoke. SAN DIEGO (KGTV) - A California lawmaker is planning to move forward on a housing bill that would eliminate hyper low-density zoning near transit and job centers.Senate Bill 50 aims to clear the way for apartment buildings and affordable housing in those locations so more people can live near transit and near where they work, proponents say.California State Senator Scott Wiener of San Francisco tells 10News, in January SB 50 will come back before the Senate, and he intends to move it forward.RELATED: Making it in San Diego: Zoning rules partially responsible for low housing supply, report says"California has a massive housing shortage – which threatens our economy, environment, and diversity – and state action is essential to solve this major problem," Wiener said in a statement.While they wait for action at the state level, some San Diego community groups are pushing for local lawmakers to move forward with their version, dubbed SD 50."We are still working in these neighborhoods to try and change those communities," said Ricardo Flores, executive director of the Local Initiatives Support Corporation (LISC) San Diego.Flores said the City of San Diego needs to end its single-family home zoning regulations. "I believe San Diegans should be in control of what happens in our neighborhoods. There was nothing in SB 50 to mandate that."If San Diego updated its zoning policies, it wouldn't be alone.City leaders in Minneapolis passed "Minneapolis 2040" which aims to increase affordable housing and racial disparities in housing.Ricardo Flores said he believes it's time for politicians to make San Diego more inclusive."If you own a single-family home on your lot and you want to keep that you should be allowed to keep it, but if you like me and are interested in building a couple extra units for mom and dad to move into or to rent it out to help pay for a mortgage you should be allowed to do that," Flores said.In a statement to 10News, San Diego City Council member and Land Use and Housing Committee member Scott Sherman wrote, "A recent study noted that 47 percent of housing costs are due to government red tape and regulation. Since taking office, I have worked to reform land use codes and streamline the permitting process to make homebuilding less expensive. It was the first year in the zoo's 100-year history in which attendance surpassed 4 million, according to zoo officials, who believe the appeal of new exhibits such as Walkabout Australia and Conrad Prebys Africa Rocks contributed significantly to the record-setting year."We are delighted to have been able to host more than four million people at the zoo, and I know that a lot of this is due to the wonderful new guest areas and the commitment to guest service shown by our employees every day," said San Diego Zoo Director Dwight Scott. SAN DIEGO (KGTV) - A 9-year old in Ocean Beach is using his lemonade stand to help others.Dylan Rodriguez sets up his lemonade stand on Bacon Street every Wednesday near the OB Farmer's Market. Initially, he wanted to make some money for himself."He wanted to raise a 0 bill," says his mother, Holly Raines.But after accomplishing that goal, his efforts became more altruistic."It feels nice helping somebody out, because, if I was in that position, I would like a lot of help too," says Dylan.Over the past three years, he's used some of the money from the lemonade stand to pay for a handful of charitable projects. He's given backpacks of supplies to the homeless, bought art supplies for kids at Rady's Childrens Hospital and bought holiday presents for refugee families."It makes me satisfied knowing that he's got a giant heart," says Raines.Recently, Dylan's giving has become more personal. One of his friends was diagnosed with a form of Muscular Dystrophy. Dylan decided to help with payments for his treatments."He needs a lot of money for each treatment," says Dylan. "It's, like, ,000 each time. So I'm trying to raise money for him."In June, Dylan was able to give his friend 0. He says he'll keep giving his lemonade money to his friend indefinitely."I'd like to give him ,000," says Dylan.
