SAN DIEGO (KGTV) -- A San Diego gym owner said he is keeping his doors open despite state restrictions on indoor operations that took effect early Wednesday morning.For Shawn Gilbert, the owner of Boulevard Fitness in University Heights, keeping his business open is a matter of survival."I took a huge financial hit in May. Money out of my pocket that's never coming back. We have bills to pay, we have rent to pay,” Gilbert told ABC 10News.Gilbert said he believes his gym can operate safely with face covering and social distancing guidelines because it is a large, open space with high ceilings. The gym also has an outdoor space that Gilbert plans to also utilize.According to Gilbert, none of his gym members or employees have tested positive for coronavirus.Gilbert told ABC 10News he’s prepared for any possible citations for staying open."We have a lawyer with six other gyms, all representing us gym owners. What [Gov. Gavin] Newsom did this time is unlawful. I find it criminal,” said Gilbert.Boulevard Fitness is closed Wednesday for cleaning, but the facility will reopen Thursday at 6 a.m. 1111

SAN DIEGO (KGTV) -- A new report from the Auto Club ranks San Diego as the top travel destination for Southern Californians this Labor Day weekend.According to the report, Las Vegas, San Francisco, Grand Canyon and Santa Barbara also rank among top travel destinations for Southern Californians. The Auto Club is also warning San Diegans not to drink and drive. According to AAA, 31 people were injured in DUI-related crashes last year over Labor Day weekend.Statewide, eight people were killed in DUI crashes last year. “While alcohol-related crash fatalities have dropped in the last three years over this holiday, injuries have risen,” said Auto Club Traffic Safety Manager Anita Lorz Villagrana.“We want to remind everyone to make a plan before celebrating – use a rideshare service, stay at a hotel or someone’s home, or designate a sober driver. SAN DIEGO (KGTV) – A local marijuana testing lab is releasing vape test results that are alarming. Almost 80% of the cannabis vape cartridges were tested and deemed "unfit for consumption."Tucked away in a quiet San Diego business park, Platinum Vape manufacturing company produces high-potency, pesticide-free cannabis products that go through rigorous testing. Co-founder George Sadler is on a mission to spread awareness about the serious potential health risks of using products from unlicensed vape makers and sellers."It's horrible," he tells 10News, adding, "It's doing so much harm to people, versus walking into a licensed store."Platinum Vape recently teamed up with nearby licensed cannabis dispensary Mankind to buy back cartridges that ranged from home-made concentrates to counterfeits of popular legal brands.In exchange, customers got discounted Platinum Vape cartridges that are tested and regulated.Mankind Chief Operating Officer Vera Levitt tells 10News, "We wanted to encourage them to replace something that could make them sick with something that was safe."The cartridges were sent to Infinite Chemical Analysis Labs, or InfiniteCAL. It's a local cannabis testing lab that then analyzed the cartridges for potency, pesticides, and heavy metals.The lab found that 79% of the cartridges were deemed "unfit for consumption". Additionally, 62% of them failed for pesticides. Almost 40% of the cartridges failed for lead."[Were there] toxic levels of lead?" 10News asks InfiniteCAL co-founder David Marelius. "One of the vape pens had almost a hundred times the legal limit," he explains.The lab also discovered that half of the products had less than 50% THC in them. Some of the cartridges were cut with excessive levels of vitamin E acetate; the additive may be linked to numerous vape-related deaths and illnesses. Marelius adds, "20% of them had a significant amount.""It's sad for me. SAN DIEGO (KGTV) — A Rancho Penasquitos man says on Sunday morning he walked outside to discover someone had broken into most of the mailboxes on his street. He added that even mailboxes that had locks had been pried open and left empty.“I woke up this morning to pick up my newspaper and I noticed every mailbox up and down the street and adjacent streets I could see had been opened and all the mail had been removed,” he said. The neighbor asked ABC 10News not to be identified.He said he’s lived in the area for about 10 years and it’s generally quiet. They had one incident a few years ago where mail was stolen around tax return season. He’s concerned about this theft because of the looming November election.“I kinda felt it might’ve had something to do with stealing the ballots,” he said.He said both he and his next door neighbor had received their ballots in the days immediately before the theft. Other neighbors in the area also said they already got their ballots in the mail, but the incident is a reminder to be extra cautious with important voting documents moving through the postal system.“Personally, I’ve never been a victim of crime here, or do I know anybody that’s been a victim of crime here, so it’s something that’s concerning,” he said.The neighbor added that he did email the registrar’s office to let them know of the possibility of stolen ballots in his neighborhood. 1407

SAN DIEGO (KGTV) - A man was sentenced Wednesday after pleading guilty to selling fentanyl to a 26-year-old La Mesa woman who overdosed in 2018, according to the U.S. Attorney's Office.Uriah Odish, 28, was charged with Conspiracy to Distribute Fentanyl and faces 14 and a half years in prison with five years of parole.According to the U.S. Attorney's Office, "Odish sold more than 500 grams of what he knew to be fentanyl between 2017 and the day of the fatal overdose."Tiffany Hansen died from that fatal dose. Her mother Keri Cuppage said Odish apologized Wednesday, "he asked for forgiveness and said he was very very sorry that his decisions led to Tiffany's death."She replied, "my biggest hope is that the time served in jail will help him and he will be able to beat his addiction."She said Tiffany loved the beach and all things Disney. After she passed, Cuppage had her ashes formed into a sea turtle and placed at the Neptune Memorial Reef. The reef is an underwater memorial created to look like the Lost City of Atlantis, off the coast of Miami Florida.Cuppage said every day after Tiffany's death is a struggle. "Every time I get a joyful emotion, it's just a backwash of sad. Not a day has gone by that I haven't cried, that I don't miss her desperately."She urges everyone to stay away from fentanyl, saying death or sentencing your loved ones to a lifetime of sadness isn't worth the high. She said she wishes she could give out her phone number so she could be there for anyone debating using the drug so she could discourage them from making a mistake.The U.S. Drug Enforcement Administration documented a surge in fentanyl-related deaths this year in San Diego County.In 2019, the DEA said 152 people died from fentanyl-related overdoses.
