If you are filing for divorce, it could take much longer than you think. There is a backlog in family court of about four months, according to the Court Executive Officer, Michael Roddy.  Sherman McEachern found that out as he was going through his divorce process. He and his soon to be ex-wife filed for divorce in October. McEachern said it should have been finalized in April. When he tried to find out why divorce documents were not mailed back to him yet, he learned it was going to take much longer. “I called the clerk’s office. That was the first time, I realized they were telling me we’re eight to ten months behind,” McEachern said.  It’s affecting him both personally and financially. “I can’t change health insurance until I have the signed divorce decree. She doesn’t want to use my health insurance because we’re separated, getting a divorce, so I’m paying for coverage no one’s using,” McEachern said. “We’re hearing a lot of complaints from people,” Roddy said. “They want to get divorced.” Roddy said this fiscal year, they’ve had to make million in budget cuts on top of a million deficit.  “That’s a million dollar hit to the court. We lost about 100 employees and we had a hiring freeze,” Roddy said.  In small claims court, Roddy said it takes about a year to set your case for trial.  When asked who is at fault for the backlog, Roddy said it started with the recession. “The recession hit California very hard, hit the courts very hard, and we have not bounced back to that level,” Roddy said. “It’s just very frustrating because every day, I’m still being tied to a marriage that we both have left from,” McEachern said. He added that it is “disheartening” that people pay for a process and the service isn’t being delivered. Roddy said they are hoping for more money in this next fiscal year, which they can use for personnel. He is expecting a flood of new orders in family court as the new tax law could affect divorce cases, with the changes in alimony payments. 2076

The upside is that you may find a 20-year-old one-owner cream puff, cheap. It does happen. But most cars have had several previous owners, and a checkered past is not rare. Plus, you’ll have to arrange your own financing.Adjust your expectationsThere is a built-in risk-versus-reward element to used car shopping: The more you’re willing to spend, the less chance the car will need repairs and overdue maintenance. Here’s an overview of the three price levels of used cars:High-end used cars: If your budget is over, say, ,000, you might consider getting a certified pre-owned (CPO) car from a dealer. Shopping for a CPO car is easier because it’s pre-inspected and comes with an included warranty. While you’ll have to pay a premium, you’ll also be able to buy a car with more modern technology and safety features. Of course, you can always buy a non-CPO car and purchase an extended warranty.Midrange used cars: A sweet spot for used car buying is a 3-year-old vehicle coming off a lease. Many of these cars will sell for 40% of their original price and still retain a new-car feel, according to Drury. Another source of near-new bargain-priced vehicles is car rental lots. According to an iSeeCars analysis, Hertz vehicles are selling for an average of ,389 below market value.Older used cars: Many people are afraid that cars from 7 to 15 years old will require costly repairs. But Holthoff points out that new cars can effectively cost the owner ,000 a month in depreciation.“You might have to spend money on a repair, but depreciation is a constant,” he says.To offset repairs, set aside 0 a month so sudden mechanic bills won’t deplete your savings.It’s best to buy older cars from private-party sellers because you can get a better idea of the mechanical condition, Holthoff advises. A used car dealer will show you the vehicle history report, but a private party might have the service records and can answer many other questions.Look for unexpected valueThe used car market is vast and, if you can spot an outlier, you can save big money. Here are a few examples of how to find that diamond in the rough:Cars that haven’t been recently redesigned will sell for less. Check car sites such as Edmunds.com to find out when the last time major changes were made to a model.While there is a stigma to buying a used rental car, the vehicles are well-maintained and priced lower than buying from dealers, Drury says.If a car dealer’s vehicle history report shows you are looking at a former rental car, leave and buy a similar one directly from the rental agency’s sales lot. You’re likely to find it cheaper.Be willing to travel to an area where the car you want is less popular. For example, all-wheel-drive vehicles sell for less in the southern U.S., where winter driving isn’t a factor.Be willing to travel to a more competitive market. A Honda dealer with a city to itself has less pressure to dicker on a CPO vehicle than a dealer in a city with three or four rivals.Used luxury cars often offer the biggest savings, according to Holthoff. In a sharp turn of events, a San Francisco judge denied Monsanto's request to nix a 0 million award to a man who said he got terminal cancer from Roundup weedkiller.But she's also slashing that man's punitive award down to about million.Former school groundskeeper Dewayne Johnson was the first cancer patient to take Monsanto to trial, claiming Roundup gave him non-Hodgkin's lymphoma.Jurors sided with Johnson and awarded him 0 million in punitive damages (to punish Monsanto) and about million in compensatory damages (for Johnson's lost income, pain and suffering).The jury's verdict came in August. But on October 10, the tide appeared to turn in Monsanto's favor.That's when Superior Court Judge Suzanne Bolanos issued a tentative ruling granting Monsanto's request for a JNOV -- a judgment notwithstanding verdict. That's basically when a judge in a civil case overrules the jury's decision.Bolanos said the plaintiff "presented no clear and convincing evidence of malice or oppression to support an award of punitive damages." In other words, Johnson's entire 0 million punitive award was in jeopardy.The judge gave attorneys on both sides a few days to respond and further make their cases.When she issued her final ruling Monday, Bolanos reversed her tentative ruling and denied Monsanto's request for a JNOV.But it wasn't a complete victory for Johnson. Instead of 9 million in combined damage awards, Johnson is slated to get a total of about million.Bolanos said the punitive award was too high and needed to match Johnson's million compensatory award."In enforcing due process limits, the court does not sit as a replacement for the jury but only as a check on arbitrary awards," Bolanos wrote in her ruling Monday."The punitive damages award must be constitutionally reduced to the maximum allowed by due process in this case -- ,253,209.35 -- equal to the amount of compensatory damages awarded by the jury based on its findings of harm to the plaintiff."Monsanto had also requested a new trial on the punitive damages. The judge said that request will be denied if Johnson accepts the smaller punitive award. If he does not accept the million punitive award, then a new trial would be set.The 1 million plummet in Johnson's punitive award caught some legal experts by surprise, including University of Richmond?law professor Carl Tobias."I am somewhat surprised, but the punitive damage award was high even though the (percentage of) reduction was steep," Tobias said. "No one thought the plaintiff would retain the whole (punitive damages) award." 2626
