SAN DIEGO (CNS) - A transient who allegedly overpowered a woman in the East Village, dragged her into some bushes and sexually assaulted her before running away pleaded not guilty Tuesday to three felony charges, including assault with intent to commit rape.Gary Ryan Cushinberry, 51, who is on felony probation for robbery and failing to appear in court, was ordered held without bail.Late on the evening of Nov. 5, Cushinberry allegedly grabbed a 26-year-old pedestrian walking by herself in the 400 block of 13th Street, pulled her off the sidewalk and assaulted her before fleeing.Detectives identified Cushinberry -- a recent transplant from Indiana who has been living on the streets of San Diego -- as the alleged perpetrator by means of ``several tips and leads,'' Lt. Jason Weeden said.Cushinberry was arrested last Friday about 6:45 a.m. in the 200 block of 17th Street.When Judge Jay Bloom ordered the defendant to stay away from the alleged victim, Cushinberry said ``I don't know the woman,'' according to Deputy District Attorney Martin Doyle.The prosecutor said Cushinberry has a criminal past from Indiana that is still being looked into.Cushinberry -- who is also charged with two counts of digital penetration by a foreign object, faces 21 years in prison if convicted, Doyle said.A readiness conference was set for Dec. 3 and a preliminary hearing for Dec. 5. 1391

SAN DIEGO (CNS) - Construction crews will close the northbound Interstate 5 off-ramp at Balboa Avenue Friday for a full weekend of work to make improvements to the off-ramp and its intersection with Balboa Avenue, according to the San Diego Association of Governments.The closure will take place from 9 p.m. Friday through 5 a.m. Monday, during which time construction crews will widen the off-ramp from one lane to two and add a traffic signal at the affected intersection. The signal will go into permanent operation on Monday when the ramp re-opens to vehicle traffic. The improvements will make it easier for motorists to access the future Balboa Avenue trolley station once it opens.The closure will necessitate lane reductions on Balboa and Garnet avenues between Mission Bay Drive and Moraga Avenue, according to SANDAG. Only one lane in each direction will be open to vehicle traffic throughout the weekend, although the schedule is subject to change.The weekend work is part of the .17 billion Mid-Coast Trolley Blue Line Extension, which includes a planned 11-mile extension of trolley service by MTS from Santa Fe Depot in downtown San Diego to University City. The extension will add trolley stops in Mission Bay Park, UC San Diego and Westfield UTC. SAN DIEGO (CNS) - At least one person was seriously injured this morning in a crash that may have involved an alcohol-impaired driver, the California Highway Patrol said.A car reportedly rolled over and caught fire about 3:44 a.m. on southbound state Route 15 near state Route 94, according to a California Highway Patrol incident log. Moments later, dispatchers were told the car appeared to have exploded.The fire-damaged car was then struck by another car, according to the incident log. A third vehicle was also involved in the crash, though details were scant.At least one person was left with serious injuries. SAN DIEGO (CNS) - A man was sentenced to nearly a decade in state prison Wednesday for his role in the fatal shooting of a Navy sailor who pulled over on a San Diego freeway ramp to help a seemingly stranded motorist.Harvey Liberato, 26, pleaded guilty to voluntary manslaughter and other charges stemming from the Oct. 27, 2018 slaying of 21-year-old Curtis Adams on the connector ramp between southbound state Route 15 and northbound Interstate 5.Adams was driving on the freeway with his girlfriend at around 2 a.m. when he stopped to assist a disabled vehicle on the side of the freeway, which was actually a car that had sustained flat tires in a shootout from a bungled vehicle burglary earlier that night.RELATED: Man found guilty of murder in slaying of Navy sailor on freewayThe disabled car was occupied by Liberato, Susana Galvan, 40; Brandon Acuna, 23; and Brandon's brother, Edson Acuna, 26.Believing Adams was the person they had engaged in a shootout with earlier in the night, Edson Acuna exited the car and shot Adams in the chest.Edson was convicted by a jury earlier this year of first-degree murder, robbery, burglary, various firearm counts and a special-circumstance allegation of committing the murder in the commission of a burglary.
