SAN DIEGO (KGTV) -- San Diego City Attorney Mara W. Elliott has heard complaints from neighbors and has filed a civil enforcement action to shut down a short-term vacation rental property in La Jolla that has been dubbed a "COVID party mansion."The complaint alleges that defendants are maintaining a public nuisance and engaging in unfair competition, including false advertising at the La Jolla Farms rental property located at 9660 Black Gold Rd. According to city officials, the rental property continues to operate in violation of state and county COVID-19 public health orders.According to a press release, Elliott is seeking civil penalties and a permanent injunction against property owners Mousa Hussain Mushkor and Zahra Ali Kasim, property manager Nital Meshkoor, and Steven S. Barbarich, who leased the property from Mushkor and subleased it as a short-term rental.City officials said the oceanfront mansion has been the subject of at least 30 calls to the San Diego Police Department. Officers have spent more than 173 hours at the property to investigate nuisance activity. Most of the incidents involved raucous parties, some of which had up to 300 attendees.Elliott said about a dozen of the party complaints came during the COVID-19 pandemic, while public health orders prohibited large gatherings.According to the press release, concerns about the property were brought to the City Attorney’s Office by San Diego police and by neighbors who reported that the situation was "becoming more pronounced as the COVID-19 pandemic progressed." “Shutting down dangerous party houses protects the public health by preventing COVID super-spreader events and other illegal behavior,” Elliott said. “It’s unfortunate that San Diego does not have short term rental regulations in place. Relief for this neighborhood would have come much sooner. Instead we must rely on time-intensive prosecutions at significant taxpayer expense.”According to the press release, gunfire was reported to police during a party in May of 2019. Officers arrived and found a large party in progress. Partygoers questioned by police admitted gunshots were fired during a fight that had occurred earlier. Police found shell casings outside the property and a neighbor found an additional casing the next day and turned it over to police. The City Attorney's Office assembled evidence from investigations by SDPD, the Code Enforcement Division of the City’s Development Services Department, the County Health & Human Services Department, and the City Fire Marshal. About 34,000 homes and businesses received 48 hours' notice of the possible shut-off to lower the hazard posed by power lines, according to SDG&E. "You have to make sure that it [the generator] is working so that we have some power. Get us through this little event. SAN DIEGO (KGTV) — San Diego County is seeing far fewer influenza cases at this point in the flu season compared to last year, due in part to coronavirus-related safety measures, according to public health officials.So far this season, the county has recorded 39 influenza cases, compared to 1,220 cases at this point last season. Flu season generally runs from October through May, with flu activity peaking in December and February.The county says it's "very likely" physical distancing, hand washing, and mask-wearing are contributing to the low flu activity."Influenza activity remains very low to date this season in San Diego County. This is very likely due to the social distancing, hand washing, and mask-wearing interventions instituted to reduce the transmission of SARS-CoV2, the virus that causes COVID-19," the county's influenza report said. Health officials say influenza vaccination rates are also contributing to the lower numbers. So far this season, 1,043,552 San Diegans have been vaccinated for the flu. SAN DIEGO (KGTV) — San Diego Police are warning parents in the Carmel Valley area after a man reportedly exposed himself to students walking to school Tuesday.Police say a man was in the passenger side of a parked car on Carmel Creek Road, and exposed and touched himself inappropriately with the car door open. SAN DIEGO (KGTV) — San Diego County reported 409 new coronavirus cases Thursday and a single-day record of 17 new deaths from the virus.Thursday's new cases had a 4% positive rate out of 10,434 reported tests, according to the county, bringing the region's total to 21,855 cases. The county's new deaths brought the county's death toll to 465. Eleven men and six women died between July 2 and July 15, and their ages ranged from 51 to 90 years of age. All but one had underlying conditions.The county also reported one new community outbreak traced to a gym, bringing the region's total to 14 community outbreaks in one week — double the region's trigger.Of the region's total COVID-19 cases, the county says 2,127 or 9.7% have needed hospitalization, and 558 or 2.6% of all cases and 26.2% of hospitalized cases were admitted to an intensive care unit.The county remained above the state’s threshold of no more than 100 cases per every 100,000 residents at 153.2 cases. 978
