A federal judge has dismissed several charges against Dr. Jumana Nagarwala in the historic female genital mutilation case, ruling that the federal law against female genital mutilation is unconstitutional.U.S. District Court Judge Bernard Friedman ruled that Congress did not have the power to enact a federal law that banned female genital mutilation in the United States.Instead, Friedman made the argument that the law was too broad and it violated Congress' powers, as the law does not stand up to scrutiny under either the Necessary and Proper Clause or the Commerce Clause of the US Constitution.He also found that laws penalizing Female Genital Mutilation should be handled at the state level, similar to laws regarding Criminal Sexual Conduct, battery or child abuse.  Shannon Smith is the Defense Attorney for Dr. Nagarwala.  She says the ruling is "absolutely a huge victory. While we’re happy with the victory and we’ll certainly take it, there’s a part of me that’s a little disappointed that the public isn’t going to see the evidence brought out at a trial to see that she was never guilty of it in the first place," Smith said.The ruling comes after Friedman also dismissed a "conspiracy to transport minor with intent to engage in criminal sexual activity" charge in January. That was the only count that could have lead to life in prison for both Nagarwala and Dr. Fakhruddin Attar.Friedman's ruling leaves two counts in place in the case. A historic and disproportionate number of women have left the workforce since the start of the pandemic, and new studies are showing many more are still considering downshifting their career.“I had just found another position that I was going to start part-time in addition to the one I had, and I was hoping to build my career with that,” said Ashley Stewart in Virginia.Stewart is a mother of three young children, who at the beginning of the year was hoping to transition to full-time work as an occupational therapist. However, when the pandemic hit, she had to reevaluate what was best for her family.“I switched to doing just a couple of virtual sessions on my computer during the week,” said Stewart. "It ended up that it was just too much to handle here, with the kids screaming in the background or climbing on me while I am trying, so I ended up stopping altogether.”It was a bittersweet decision. She was sad to halt a blossoming career, but grateful her family could afford to make that decision. She felt it was safer for her children and worth the sacrifice on her end. Stewart’s decision has become a common one for women across the country. The latest data from the Department of Labor shows that between August and September, 865,000 women dropped out of the labor force, compared to 216,000 men. That is essentially women dropping out of the workforce four time faster than men.“The number of women who have left is startling,” said C. Nicole Mason. “Because at the beginning of the year, we were celebrating the fact that women were 50% of the workforce, so we have lost significant gains since then.”Mason is the president and CEO of the Institute for Women’s Policy Research.“We can draw the direct line between the lack of childcare and daycare closures to women exiting,” said Mason.Experts, like Mason, are concerned a decade or more of women’s equality and progress in the workforce could be erased, if women continue to drop out of the labor force at this rate.“Employers have a role to play by making sure workplace policies are flexible, providing access to childcare,” said Mason. “The federal government has a role to play by instituting a national care infrastructure that will do more to keep women in the workforce by making sure they have childcare and other supports."Many companies have begun to offer more flexibility during the pandemic, but the data indicates more may need to be done. In terms of government responding to this disproportionate loss of women in the workforce, the childcare industry has been calling on Congress for funding for weeks. The industry’s plea is not only to save providers but to support women needing their service to go back to work. Subsequent tests confirmed Listeria contamination in a product made at another Blue Bell facility in Broken Arrow, Oklahoma, which led to a second recall announcement on March 23, 2015.According to the plea agreement with the company, FDA inspections in March and April 2015 revealed sanitation issues at the Brenham and Broken Arrow facilities, including problems with the hot water supply needed to properly clean equipment and deteriorating factory conditions that could lead to insanitary water dripping into product mix during the manufacturing process.Blue Bell temporarily closed all of its plants in late April 2015 to clean and update the facilities. A Florida man is accused of attacking a Volusia County ambulance crew on the way to the hospital Sunday night.The paramedics told deputies that the suspect, David W. Parsons, 33, had been belligerent throughout the evening. The paramedic who was driving the ambulance said he looked in the rear-view mirror and saw Parsons getting off the stretcher and attacking the paramedic riding in the back.The ambulance driver said he pulled over, opened the back door and found Parsons with the paramedic in a choke hold.The driver said he then put Parsons in a choke hold until he released the other paramedic. Deputies said the altercation then spilled out of the ambulance.The sheriff's office said Parsons then attempted to run at them and into oncoming traffic, where the altercation continued.Deputy Micah Stoltz arrived and found Parsons putting a paramedic in a choke hold on the side of the road. The suspect was straddling one paramedic while the other was trying to pull him off.Stoltz had to use his stun gun after repeated commands to let go of the paramedic.The paramedics were in good condition after the attack and scuffle.Parsons was later medically cleared at Florida Hospital DeLand before being transported to the Volusia County Jail. He remained held Monday afternoon on ,000 bail, charged with two felony counts of battery on an EMT. 1387
