SAN DIEGO (KGTV) — A man is searching for the good Samaritan who pulled him from a rip current in La Jolla this week.Patrick Fitzpatrick was swimming at Windansea Beach Tuesday."It took a snap second before I was in control to completely out of control," Fitzpatrick recalled, after becoming caught in a rip current. "There was no way on Earth that I was going to live from this. I was in a panic. I couldn't use my arms and legs now."Someone on shore, only known as "Dustin," noticed Fitzpatrick struggling and swam out to help him."He's a guardian angel. He owe him my life, he saved my life," Fitzpatrick says.Dustin swam out and kept Fitzpatrick calm before more help could arrive and get him to shore.Fitzpatrick is hoping to reunite with his mystery rescuer to say thank you."The humanity that comes from an act of kindness like this, from a perfect stranger," Fitzpatrick said. 892

SAN DIEGO (KGTV) — A heartbreaking scene greeted a youth soccer club in Mira Mesa.All four of their goals were severely damaged.Aaron Vazquez, 12, has been playing soccer since he can remember. But last week, his fun came to an ugly halt."My heart dropped and my stomach tightened," said Vazquez.Juventus San Diego stores its goals at the Mira Mesa Recreation Center. Aaron's father, Sabino, is coaching director of the club. Membership includes about 130 kids, ages 2 to 13.MAP: Track crime happening in your neighborhood"Looked like somebody trashed the goals, bent them and broke them ... left them in the middle of the field," said Sabino Vazquez.The goals are valued at about ,200.Sabino Vazquez says they tried to bend the bent parts back into place, and bought new parts. SAN DIEGO (KGTV) - A Mira Mesa mom she says her special needs son was bullied and robbed at his middle school during lunch.Diagnosed at birth with cerebral palsy, Justin Juanengo has surpassed many of the expected physical limitations, but remains unable to use his legs or his left arm. Michelle Juanengo and her husband adopted him at age 2."We've always been worried there would be other kids who would find him an easy target," she said.Last week her fears became a reality. At lunchtime on Wednesday at Wangenheim Middle School, she says a 7th grade classmate and several other students came up to Justin, 13, and started spinning his wheelchair and calling him names."He was nervous, scared. Didn't know where it was going to go from there. There are a lot of things that can go wrong if you're spinning a wheelchair. Were they going to roll him off somewhere?" said Michelle.Justin says it went on for minutes before his friend got the boys to stop. One of the boys then grabbed Justin's backpack and took off. According to his mother, Justin and a friend went to a classroom and found the ringleader, demanding and getting back the backpack. Inside, his wallet containing dollars was gone."Sad, feel terrible for Justin. I feel like he's had to tolerate enough with all his health limitations ... the ways he sees himself as different from other students. Why should he not have the right to go to school and feel safe?" said Michelle.Michelle says her son didn't have an aide with him, which is mandated by the state. She says she has recently learned the aide suffered a back injury last year and the substitute aide is sometimes not available."That's not good enough. He needs to have the aide. That could have prevented this," said Michelle.Another source of frustration? Justin says his bully is known for bullying and stealing from other kids, something Michelle believes should have been addressed earlier. Vice principal Miko Uhuru declined to talk about Justin's case citing privacy. He told 10News one of Justin's parents could sign a waiver, which Michelle says she didn't know about but now plans to sign."What I can says is we don't tolerate bullying. We investigate it and take is seriously," said Uhuru.Michelle says she was told the boy will be punished by the school, but wasn't given specifics. She says she and her husband are thinking about legal action against the school district to "make sure the same thing doesn't happen to other special needs students." 2499

  

SAN DIEGO (KGTV) — A recent bout with the flu nearly turned deadly for a San Carlos man when it took an unexpected turn.Five weeks ago, the usually healthy 58-year-old Dave Truby came down with the flu."Fever, nausea, inability to sleep ... body soreness," said Dave's brother, Mike.Mike his brother says Dave tried to fight through it. Some five days later, Dave went to an ER, but left because of the wait for beds. That same night at home, his brother found him in bad shape."Literally shaking in a fetal position," said Mike Truby.At the hospital, Mike received some devastating news. His brother's kidneys were failing, and the MRI showed brain damage from a massive stroke. "The brain wasn't getting clean blood. It was shutting down. The whole body was shutting down. They said it didn't look good," said Mike.Loved ones and friends braced for the worst."I said my prayers and breathed deep," he said.Those prayers were answered in gradual fashion. His kidneys started working and Dave started responding."The last two weeks, he moved his head, blinked, and mouthed words. Wheeled my mom into the hospital room a week ago, and he looked up and mouthed, 'Mom.' Gives us a lot of hope," he said. "You never think the flu is going to impact your life in a possibly terminal way."Much of his prognosis remains uncertain, but Mike is optimistic, though he's still a bit in shock over how this came about.Two recent studies suggest the flu can trigger strokes and lead to a prolonged risk lasting months. In Dave's case, he will survive his stroke. "Very thankful and very grateful. My brother has always been a stubborn, forceful man ... I don't think this is going to keep him from getting back," said Mike.A Gofundme campaign has been set up to help with Dave's expenses and long recovery. 1802

  

SAN DIEGO (KGTV) — A Pacific Beach woman is appealing for tips after a hit-and-run driver struck the motor scooter she was riding, leaving her with serious injuries.On Saturday afternoon around 1 p.m., yoga teacher Fallon Lev was headed to a yoga studio, riding her motor scooter on Ingraham Street, when she exited onto Sunset Cliffs Boulevard."Just gotten onto the ramp, going a reasonable speed," said Lev.In a one-lane section, she looked to her left and felt a car right next to her."It bumped me, causing the scooter wiggle back and forth. Instantly, I'm like on the floor, and my whole body is tumbleweeding on the cement. I must have gone five or six times," said Lev.She says the driver kept going. Later, at the hospital came the diagnosis and surgery."I broke my pelvis in two different areas and have these two bars sticking out of my hipbone and a bar straight across," said Lev.She also suffered a painful road rash and a broken tooth. Her road to recovery will be a long one. Lev, a yoga teacher whose income was greatly impacted by the pandemic, is trying to stay positive. The actions of the driver make her angry."I'm trying not to affect it my healing. Of course, it's extremely disturbing and disappointing ... There is no way the driver didn’t see me go down. They actively chose to leave me," said Lev.In fact, Lev remembers feeling like this was no accident. She was leaving traffic on a one-lane section of the roadway."I felt like it was on purpose. I wasn’t going fast enough, and that was my payback," said Lev.Lev is now hoping for tips to track down a hit-and-run driver."The driver deserves to know that’s not the way you treat a human being," said Lev.Lev recalls an older model, maroon sedan, which may have been the car right behind the car that hit her.
