SAN DIEGO (CNS) - The California Supreme Court on Monday upheld the conviction of a death row inmate found guilty of hiring another man to shoot and kill his fiancee in Alpine 20 years ago.Michael William Flinner applied for a life insurance policy for 18-year-old Tamra Keck, then arranged for his former employee, Haron Ontiveros, to kill her on June 11, 2000, according to the ruling.The killing occurred shortly after Flinner met Keck and began dating her.According to the ruling, Flinner named himself as the beneficiary in the insurance policy, and falsely alleged Keck was an employee at his landscaping business whose death would cause him to suffer financially. Prosecutors alleged Flinner arranged for Ontiveros to meet with Keck at a gas station, then direct her to his car in a nearby cul-de-sac under the guise of having engine trouble. Once there, he shot Keck in the back of the head.Separate juries convicted Flinner and Ontiveros of murder and conspiracy and found true special circumstance allegations of killing for financial gain and lying in wait. Jurors recommended capital punishment for Flinner and life imprisonment without the possibility of parole for Ontiveros.In the appeal, Flinner's counsel alleged his case was adversely affected by issues that included limited access to defense counsel, which was allegedly restricted by Flinner's relocation from the downtown San Diego jail to the jail in Vista. Flinner's defense attorney at the time claimed the distance to Vista and other limits on telephone communication would hurt the defense's preparation for trial. According to the ruling, the relocation was implemented because Flinner obtained the home addresses of the prosecutor and trial judge through another inmate.The state Supreme Court found the claims had no merit, as the trial court permitted increased communication between Flinner and the defense team at the defense's request.Another claim alleged juror misconduct by one panelist who sought to write a book about the trial. Flinner's counsel alleged her objectivity may have been compromised as a result. The state Supreme Court disagreed, though it noted the juror had made misconduct claims about other panelists, which the high court also ultimately ruled were unfounded. 2276

SAN DIEGO (CNS) - The historic Hotel del Coronado is reopening Friday, ending the first closure in the hotel's 132-year history.The famous red-roofed hotel on Coronado Island's Orange Avenue closed with other hotels in late March as the COVID-19 pandemic reached San Diego.Hotels have started to reopen in June, following state and county public health guidelines. The Hotel del Coronado, a major tourist attraction, will reopen with limited amenities and reduced occupancy.Hotel del Coronado General Manager Harold Rapoza told 10News guests and hotel staff can expect to feel safe and comfortable after numerous modifications."We disinfect all the high-touch areas, including the light switches, remote control, door handles. We sanitize the entire room, and then we put a seal on the outside of the door so when guests do check in, they know that no one has accessed the room. They are the first person to access the room since it was cleaned and disinfected," Rapoza said.Rapoza added face coverings/masks will be required for all hotel staff and guests while in public areas. He also said there will be sanitation stands and cleaning wipes around the resort.Rapoza said as soon as they learned the hotel would be allowed to reopen, staff worked "fast and furious" to meet new health and safety guidelines."This is a very busy resort in the summer. There's a lot of foot traffic and we wanted to make sure we could manage through the guidelines. We want everyone to come and enjoy the Del and see the Del this summer. We're excited to show them our new amenities and our new protocols," he told 10News.The luxury villas the Beach Village at The Del will also open Friday. The hotel's main pool and Cabana guestrooms will remain closed until at least July 19 until upgrades are completed.Until the pool reopens, hotel management said guests will be able to borrow sand chairs for the beach and umbrellas for free. Guests will also get a daily dining credit and discounted self-parking.The hotel plans to premiere its Sun Deck, ENO Market & Pizzeria and Babcock & Story Bar in early August."I think people are excited. I mean, this is a great time of year for Coronado and for the town. The weather's great and our beaches are amazing, and I think people are going to enjoy it," Rapoza said.Hotel del Coronado opened in February 1888 and quickly gained a reputation as a celebrity getaway. SAN DIEGO (CNS) - The San Diego City Council on Monday will honor area residents who assisted victims in the Las Vegas mass shooting that left 58 concert-goers dead and hundreds of others wounded.Councilwoman Lorie Zapf plans to introduce a proclamation declaring "Las Vegas Unsung Heroes Recognition Day" in San Diego.In it, she calls the Oct. 1 shooting at a country music festival "one of the most horrific events in American history" and lauds Taylor Winston, Jenn Lewis, Officer Max Verduzco, Officer Tom McGrath and his wife, Tiffany.RELATED: Brother of Las Vegas shooting victim Jennifer Irvine urges educator-only pension to divest in gunsShe said Winston -- an ex-Marine living in Ocean Beach -- and Lewis, his girlfriend, found a truck with its keys in the ignition and used it to rush about two dozen shooting victims to a hospital.Verduzco knocked over a fence, allowing the crowd to escape the scene, according to Zapf. SAN DIEGO (CNS) - San Diego County public health officials have reported 2,509 COVID-19 infections and 27 additional deaths, bringing the county's totals to 122,972 cases and 1,280 fatalities.On Friday, a record 3,611 COVID-19 infections were reported. The cases surpassed the previous record set one week ago -- 2,867 last Friday -- by 744 new cases. It marks the first time the number of daily infections has surpassed 3,000 as well as the 18th consecutive day with more than 1,000 cases and the 11th day overall with more than 2,000 new cases.The top four-highest daily cases have all occurred in the past week, with Wednesday's 2,807 cases and Thursday's 2,604.Also on Friday, an appeals court stayed a judge's decision to halt enforcement of COVID-19 restrictions against San Diego County restaurants, meaning eateries must again abide by the state's regional stay-at-home order, at least for now.Lawyers for the state filed the emergency challenge to San Diego Superior Court Judge Joel R. Wohlfeil's preliminary injunction, which was issued Wednesday in a lawsuit filed by two San Diego strip clubs Wohlfeil ultimately ruled could remain open.Wohlfeil's ruling also encompassed all restaurants in the county and all businesses that provide "restaurant service."Three justices from the Fourth District Court of Appeals, District One, read and considered the order and stayed the injunction "pending further order of this court." The court ordered any oppositions to the state's filing to be submitted by noon Wednesday, according to an appeals court docket.Lawyers from the state argued that Wohlfeil overreached in his ruling, as no restaurants were parties in the suit initially filed in October by Cheetahs Gentleman's Club and Pacers Showgirls International.County supervisors met in closed session Friday to appeal the ruling made by Wohlfeil Wednesday."The board voted to appeal the order," said County Supervisor Greg Cox. "But the board directed county counsel to only argue that the order is incorrect as it relates to the continued operation of strip clubs and the allowance of indoor dining.""We support outdoor dining with appropriate safety protocols that have been previously established. We remind everyone that the virus is still out there," Cox said.Supervisor Nathan Fletcher concurred."I vehemently disagree with the recent judicial decision allowing strip clubs and all restaurant activities to resume, and I support appealing the entirety of the recent court ruling," he said. "It is a positive step that our board voted unanimously to join the state in the appeal as it relates to strip clubs and indoor dining."A jump of 46 hospitalizations Friday set a record with 1,218 COVID-19- positive patients hospitalized locally. An additional 305 COVID-19 patients are in ICUs -- also a record.The county's hospitals have 16% of their ICU beds available, unchanged since Tuesday, which is at odds with the state estimate that the Southern California region's ICU beds are entirely full.Where the discrepancy comes from is unclear.In the San Joaquin Valley, ICU beds are said to also be full. In Greater Sacramento, the estimate is 14.5% of ICU beds available; in the Bay Area, it's 12.8%.Only Northern California remains outside the Gov. Gavin Newsom-directed stay-at-home order with 21% of ICU beds available. That order applies to regions with fewer than 15% ICU beds remaining.San Diego County has seen a 220% increase in COVID-19 hospitalizations in the past 30 days and a 155% increase in ICU patients in the same time frame.The previous peak in hospitalizations -- in mid-July -- topped out at about 400 patients.Cox on Wednesday asked for patience from county residents, as more vaccines are on the way.The U.S. Food and Drug Administration has now approved a vaccine developed by Moderna to join the 28,275 Pfizer vaccines already in the region available for civilian acute health care workers.San Diego County is home to 82,623 health care workers toiling in hospital or psychiatric facilities, 39,755 of whom are considered "highest risk" and will first receive vaccines.The 28,000-plus vaccines will cover about 72% of those slated to be inoculated until more vaccines arrive in California. 4231
