A federal judge in Seattle granted a motion for a preliminary injunction on Monday that blocks a Texas man from releasing downloadable blueprints for 3D-printed guns until the litigation is resolved, according to court documents obtained by CNN.Judge Robert S. Lasnik of the US District Court for Western Washington extended an earlier temporary restraining order, which will now remain in place until the case is resolved, the court documents state."The Court finds that the irreparable burdens on the private defendants' First Amendment rights are dwarfed by the irreparable harms the States are likely to suffer if the existing restrictions are withdrawn and that, overall, the public interest strongly supports maintaining the status quo through the pendency of this litigation," Lasnik wrote in the ruling.The ruling comes as part of a years-long battle between the federal government and Defense Distributed, an organization that in 2013 posted designs for a 3D-printed handgun called the Liberator. The pistol was made out of ABS plastic, the same material used in Lego blocks, and could be made on a 3D printer.The US government ordered him to take the blueprints down that year, and the company's founder Cody Wilson sued the government in 2015. The Trump administration settled the case in June, and the 3D weapon blueprints were scheduled to be posted online August 1.However, Washington state and other states sued to block the release of the blueprints that day. Judge Lasnik sided with the states and temporarily blocked the settlement, although more than 1,000 people downloaded the designs before the judge's decision.Defense Distributed took down the plans after the temporary restraining order, and a note on the website DEFCAD explained the reasoning."This site, after legally committing its files to the public domain through a license from the US Department of State, has been ordered shut down by a federal judge in the Western District of Washington," the website DEFCAD.com says. 2011

A judge ruled Tuesday the City of Omaha must release a video showing the death of a TV crewman during a shootout at Wendy's in 2014.Bryce Dion, a sound mixer on a shoot at a Wendy's in Omaha for the reality TV show "Cops," was shot and killed Aug. 26, 2014, after Omaha Police returned fire on a man who shot a pellet gun at officers. Officers were called to the restaurant on a report of a robbery.In the video, someone could be heard repeatedly asking, "Bryce, are you alright?" He can be seen slumped against a glass wall in the vestibule of the restaurant.Dion was wearing a bulletproof vest, but was hit with a bullet under his armpit. The suspect, Cortez Washington, who was using an airsoft pellet gun, was also killed.In 2016, Dion's brother, Trevor Dion, filed a wrongful death lawsuit against the city, which had asked a Douglas County District judge to bar the release of the video, according to the Omaha World-Herald. The lawsuit says Dion was doing as instructed when he was hit by gunfire from an Omaha police officer.“Bryce positioned himself where told, when told, and acted in accord with police officer instructions. The perpetrator drew what appeared to be a pistol, but proved to be a pellet gun that simulated discharge. Police responded with live rounds of ammunition. They shot and killed the perpetrator. As they did so, they also shot and killed Bryce who was positioned as directed between at least one police officer who arrived at the scene belatedly, other police officers, and the perpetrator.”Brian Jorde, Dion's attorney, says he plans to use the video and other evidence at trial. The proceedings are expected to begin sometime after July."There's approximately 20 bullet holes just near the area of where Mr. Dion was alone so there's a significant amount of gunfire that was exchanged," Jorde said. "We think the public deserves to know what happens when their taxpayer dollars are at work with the police and otherwise. And I think it sheds light on exactly what happened and that Mr. Dion was caught in the line of the crossfire through no fault of his own."Omaha City Attorney Paul Kratz said the city played the video in court Tuesday to support its motion for the case to be dismissed."The city presented the video to the court in support of its motion for summary judgment, and we believe the video will support that motion," Kratz said when reached by phone Tuesday night. 2468

  

A Kentucky high school teacher on Tuesday ousted an incumbent state lawmaker who had a role in passing a controversial pension bill this year that sparked outrage from teachers across the state.Republican voters chose Travis Brenda, a high school math teacher, over House Majority Floor Leader Jonathan Shell, who was first elected in 2012.Brenda bested Shell by a narrow margin of 123 votes In Tuesday's Republican primary for House District 71st, according to unofficial results posted to the Kentucky State Board of Elections.This past spring, Kentucky teachers held rallies at the state Capitol for more funding and to oppose a controversial pension bill, Senate Bill 151, which, among other initiatives, prevents changes to annual cost-of-living adjustments and limits the number of sick days teachers can put toward their retirement.Shell had helped turn SB 151, which had been about sewage services, into a pension overhaul and voted in support of the bill. The bill was quickly passed in the House and the Senate without allowing the public to read it, and then sent to GOP Gov. Matt Bevin to sign the bill on April 11.During the campaign, Brenda used his experience as a teacher to make the point that he's not a politician and he understands the importance of funding education. On Twitter, Brenda was critical of the pension bill and posted pictures from the April 2 teacher protest at the state Capitol.Shell confirmed to CNN he called Brenda Tuesday night to congratulate him. A former Nazi SS guard known as "the bookkeeper of Auschwitz" has died before serving a four-year jail term, authorities in Germany said.Oskar Groening, 96, was sentenced for being an accessory to murder in 2015, but never went to jail due to a series of appeals for clemency on grounds of old age and ill-health.He died in a hospital on Friday, according to Spiegel Online. The Hannover public prosecutor's office said it had been informed of Groening's death by his lawyer.Groening was found guilty of being an accessory to the murder of 300,000 people at the Auschwitz death camp in Nazi-occupied Poland during World War II.He was accused of counting the cash found in the belongings of new arrivals at the camp and sending it to Nazi headquarters in Berlin.At least 1.1 million people were killed in the camps at Auschwitz, the vast majority of them Jewish victims of the Nazi genocide, but also Poles, gay people, disabled people and other persecuted minorities.About six million Jewish people died in Nazi concentration camps during the war.For many years after the war, Groening worked as an accountant in a factory and suppressed what he had witnessed and participated in at Auschwitz.But in the mid 1980s he finally came forward to say he had seen the mass killings in response to claims by Holocaust deniers.This admission opened him up to public attention and scrutiny -- and ultimately prosecution.During his trial, Groening admitted that he was "morally complicit" in the crimes but denied that he was legally guilty.Groening insisted in a 2005 interview with Der Spiegel that he had been no more than a "cog in the gears".His first plea for clemency was denied by German prosecutors a day after it was made public, but he never served the sentence due to a raft of further appeals. His latest appeal was denied in January.The legal doctrine under which Nazis can be tried in Germany began to evolve with the conviction in 2011 of another convicted Nazi war criminal, John Demjanjuk, as an accessory to the murder of 28,000 Jews in the Sobibor death camp in Poland.Groening's conviction extended the doctrine further, opening a door to further trials of alleged Nazi criminals.In 2016, Reinhold Hanning, a former SS guard at Auschwitz, was convicted of having assisted in the deaths of 170,000 people and sentenced to five years in prison.The trial of Hubert Zafke -- then 95 and accused of being an accessory to at least 3,681 murders at the same camp -- also began in 2016, but ended in September last year after he was deemed no longer fit to stand trial due to dementia, according to Reuters.In statement posted online, Dr Efraim Zuroff, chief Nazi-hunter at the Simon Wiesenthal Center, a Holocaust research group, said Groning's death just before he was due to serve his sentence was "unfortunate, at least on a symbolic level.""Without at least symbolic justice, these trials -- as important as they are -- lose an important part of their significance," he said."Their victims never had any appeals, nor did their tormentors have any mercy.
