A custody battle has been raging over the large mammal. The question at hand: Where should a 7,000-pound elephant live? The legal issue pits an elephant sanctuary in Hohenwald, Tenn. against the woman who raised Tarra the elephant since she was a baby. The case went to trial just this week and ended with a hung jury, so the fate of Tarra -- perhaps the best known of the Sanctuary's elephants -- remains in limbo.Tarra is an Asian elephant. Many remember the story from a decade ago of Tarra and her loyal canine companion, Bella. She was the first elephant at the Sanctuary in Hohenwald, brought there by co-founder Carol Buckley in 1995.Years earlier, Buckley took ownership of Tarra from a businessman in California."It was an instantaneous attraction to each other. She needed a mother. She was a baby, and I was happy to fill that role," Buckley said. This led to Buckley starting the sanctuary, but after several years, Buckley was ousted. She left Tarra there knowing it was the best place for her at the time. Now, Buckley operates a new sanctuary in Georgia. She said she never surrendered Tarra, has worried about her welfare in Hohenwald, and is suing to get her back."The lawsuit is very simple. It says I own Tarra," said Buckley.Legal expert Jim Todd said this is the first-of-its-type case in Tennessee.Todd said there's the custody issue, but he added there's also the question of whether Buckley abandoned Tarra. She said no and added her concern has always been what's best for the elephant."I'm going to put her wherever it is best. If Georgia is better for her, I would move her to Georgia," Buckley said. "If Tennessee is better, I would leave her in Tennessee."The two-day trial this week in Lewis County ended with a hung jury. Ten jurors voted to return Tarra to Buckley with two others saying no. A retrial likely won't happen until 2019.Asian elephants typically have a lifespan of 48 years. Tarra is 44 years old.The Elephant Sanctuary issued the following statement saying in part, "We remain fully committed and exist to provide home, herd and individualized lifetime care to all residents of the Sanctuary, as we have done for the past 23 years." 2211

A Chinese court has banned the sale and import of most iPhone models in a stunning decision sure to escalate the nasty trade war between the United States and China. The ban does not cover the new iPhone XS, iPhone XS Plus or iPhone XR, which were not yet available when Qualcomm filed its lawsuit. The phones covered by the ban make up about 10% to 15% of current iPhone sales in China, according to Daniel Ives, analyst at Wedbush Securities. The court granted a pair of preliminary injunctions requested by Qualcomm, an American microchip maker. Qualcomm claims that Apple violates two of its patents in the iPhone 6S, iPhone 6S Plus, iPhone 7, iPhone 7 Plus, iPhone 8, iPhone 8 Plus and iPhone X. The patents allow people to edit and resize photos on a phone and to manage apps by using a touchscreen, according to Qualcomm. The practical effect of the injunction is not yet clear. The ruling was announced publicly Monday but put into effect last week, but Apple said in a statement that all iPhone models remain available in China."If Apple is violating the orders, Qualcomm will seek enforcement of the orders through enforcement tribunals that are part of the Chinese court system," Don Rosenberg, general counsel for Qualcomm, said in a statement.Apple accused Qualcomm of playing dirty tricks, including asserting a patent that had already been invalidated by international courts, and other patents that it had never before used. Apple said it will pursue a legal response in court."Qualcomm's effort to ban our products is another desperate move by a company whose illegal practices are under investigation by regulators around the world," Apple said.Apple on Monday filed a request for the court to reconsider its decision. Qualcomm applauded the ruling, saying Apple owes it money for using its technology."We deeply value our relationships with customers, rarely resorting to the courts for assistance, but we also have an abiding belief in the need to protect intellectual property rights," Don Rosenberg, general counsel for Qualcomm, said in a statement. "Apple continues to benefit from our intellectual property while refusing to compensate us."Investors were mostly unmoved. Apple's (AAPL) stock was about flat Monday afternoon. Qualcomm's (QCOM) stock rose 2%.  2293

A gunman armed with a .38 revolver and a shotgun walked into Santa Fe High School in Texas on Friday and killed 10 people, according to authorities. Two days later, Texas Gov. Greg Abbott is still touting a shotgun giveaway on his website. The entry period for the drawing began on May 1 -- before the shooting in Santa Fe -- and ends on May 31.Participants in the giveaway enter with a chance to win a 0 certificate that can be redeemed at a licensed gun dealer in Central Texas. Entrants must be Texas residents, per the governor's campaign website, and at least 18 years old. They must also be legally allowed to buy a pump-action shotgun.Abbott's office did not immediately respond to a request for comment about the shotgun giveaway.Abbott's campaign has also advertised the giveaway on other campaign materials.Vikki Goodwin, a candidate for the State House District 47 in west Travis County, was door-to-door campaigning on Saturday afternoon when she came across a door hanger advertising the giveaway."I was just astounded that he was giving away a shotgun," Goodwin told CNN. "The timing of it just seemed really bad."Goodwin notes she only saw the door hanger on one house and didn't know how long it had been there. "I thought, 'Surely they didn't just put this on the door and say they're giving away a shotgun right after 10 people have died as a result of another school shooting,'" she said. The Austin chapter of March for Our Lives -- the gun control initiative started by students in Parkland, Florida, after their own school shooting -- blasted the governor on Twitter for the giveaway. The group demanded he take the page on his website down."To put it bluntly, we find this a disgusting display of disregard of the toll gun violence takes and an absolute failure to respect your constituents in the wake of the #SantaFe shootings," the chapter said on Twitter."Having a raffle of a shotgun, considering that shotgun is what was used just two days ago to kill 10 of my peers, I frankly think that's disgusting what Gov. Abbott is doing,"Jack Kappelman, a high school senior and an organizer for Austin March for Our Lives, told CNN.The giveaway made Abbott's recent call for a roundtable discussion to curb gun violence illegitimate, said Kappelman.Dimitrios Pagourtzis, the suspected 17-year-old shooter, is currently being held on charges of capital murder and aggravated assault of a public servant.According to a probable cause affidavit signed by the Galveston County Sheriff's Office, Pagourtzis told officers he used a Remington 870 shotgun and a .38-caliber pistol in the shooting.Abbott told reporters on Friday the weapons were legally owned by Pagourtzis' father. His family released a statement on Saturday, saying they were "as shocked and confused as anyone else by these events that occurred.""We share the public's hunger for answers as to why this happened, and will await the outcome of the investigation before speaking about these events," the statement said. It's not the first time Abbott has held a giveaway for a shotgun. According to MySanAntonio.com, Abbott also hosted a raffle in October 2015 during his first year as governor. 3208

A day after a Marine Corps veteran stormed into a country music dance hall in California and opened fire into the crowd, killing 12 people, investigators said there is no clear motive behind the attack.Authorities say Ian Long, 28, fired a Glock .45-caliber handgun without a word as many patrons line-danced at the Borderline Bar & Grill in Thousand Oaks around 11 p.m. (2 a.m. ET) Wednesday. He first shot a security guard and a woman working at the counter, but authorities say there was no indication he was targeting employees.Hours after police found Long dead of what is believed to be a self-inflicted gunshot wound, law enforcement officials swarmed the home where he lived with his mother to search for clues, while hundreds of people joined family, friends and survivors to mourn the victims. 815
