SAN DIEGO (AP) — A military judge on Monday took the rare step of removing a prosecutor accused of misconduct from the war crimes case of a decorated Navy SEAL.Capt. Aaron Rugh ordered Cmdr. Christopher Czaplak removed from the case of Operations Chief Edward Gallagher after defense lawyers accused the prosecution of spying on their emails, according to the ruling.The defense asked Rugh to dismiss the case or remove prosecutors because of a surreptitious effort to track defense emails without court approval in an effort to find the source of news leaks.Rugh said it was not in his power to determine prosecutorial misconduct, but there was the possibility of a conflict of interest that required Czaplak to be removed, the ruling said.Rugh has not yet ruled on whether to dismiss murder and attempted murder counts against Gallagher.Last week, Rugh unexpectedly released Gallagher from custody as a remedy for interference by prosecutors.The removal could delay the trial scheduled to start June 10.Republicans in Congress have rallied in support of Gallagher, saying he has been mistreated. President Donald Trump, who intervened to move Gallagher to better confinement, has considered dismissing the charges.Gallagher pleaded not guilty to murder in the death of an injured teenage militant in Iraq in 2017 and to attempted murder for picking off two civilians from a sniper's perch.It is extremely unusual for a military judge to remove the prosecution or dismiss a case only days before the start of a trial. SALT LAKE CITY, Utah – A wildlife overpass near Salt Lake City is proving to be successful at helping animals safely migrate over a busy interstate.The Utah Division of Wildlife Resources (UDWR) hailed the Parley's Canyon overpass a success in a recent Facebook post, saying it has also helped motorists stay much safer as well.In its Facebook post, UDWR included video that show many animals using the overpass to safely cross to the other side of Interstate 80. Cameras set up along the bridge captured moose, bears, porcupines, squirrels, mountain lions, deer, coyotes, and other critters.The Utah Department of Transportation (UDOT) and Utah State University have been monitoring the overpass throughout the year.The overpass opened in December 2018. UDOT says it spans six lanes of interstate and was constructed to improve safety on I-80 by reducing wildlife and vehicle collisions.UDOT coordinated with UDWR on the wildlife issues specific to the project, including wildlife migration patterns.While it may be tempting to visit the bridge in an attempt to spot some critters, UDWR says to keep off the overpass and not disturb the animals. 1154

SAN DIEGO (CNS) - A 17-year-old from San Diego driving a vehicle police suspected to be stolen was shot by a detective during a traffic stop, Hemet police said Saturday.Detectives with the department's Crime Suppression Unit conducted the traffic stop at about 9:45 p.m. Wednesday in the 300 block of North San Jacinto Street, Lt. Jeff Davis said."Detectives transitioned to a high risk stop after a records check revealed the vehicle was reported stolen from the San Diego area. An officer involved shooting occurred during the stop," Davis said.The San Diego teen was hospitalized with a non-life-threatening gunshot wound and later released to his guardian after receiving treatment, according to the news release.It was unclear what led to the shooting, and a call to Davis by a reporter Saturday morning was not returned.No officers were injured in the encounter, and an investigation was ongoing. 910

SAN DIEGO — Three teenagers were taken into custody in three separate attempts to smuggle fentanyl across the U.S.-Mexico border, according to federal officials.U.S. Customs and Border Protection (CBP) said the incidents occurred on March 30 and 31 at the San Ysidro Port of Entry near San Diego, California.On Friday, CBP agents stopped a 17-year-old Mexican citizen. After noticing an "anomaly" on the teen's back, agents conducted a pat down and found two packages strapped to his back. The packages contained four pounds of fentanyl — a street value of 1,000.The next day, CBP agents stopped two more male teens within 10 minutes of each other: a 17-year-old and a 15-year-old. Both were found to have packages of fentanyl strapped to their backs. The two combined were carrying about nine pounds of drugs, a street value of more than 6,000.The teens in each case were arrested and turned over to Homeland Security Investigations. The all drugs were seized by CBP officers.According to Pete Flores, the director of Field Operations for Customs and Border Protection in San Diego, Fentanyl is 50 to 100 times more deadly than heroin."Please understand that no matter what you may be told, there are consequences for engaging in this type of activity, not to mention the dangers of working with transnational criminal organizations,” he said, 1383
