LOS ANGELES (CNS) - A much-debated gas tax hike billed as raising billions of dollars a year for statewide transportation improvements will remain in place, with voters rejecting a ballot measure that would have repealed the increase.Proposition 6 would have repealed the hikes that took effect in November 2017, raising the tax by 12 cents per gallon for gasoline and 20 cents per gallon for diesel fuel. The increases included in Senate Bill 1, the Road Repair & Accountability Act of 2017, are projected to raise .2 billion a year, with the money earmarked for road and bridge repairs.Gas tax opponents gathered more than 640,000 petition signatures across the state in an initiative drive to put the repeal effort on the ballot. The drive was spearheaded by former San Diego City Councilman Carl DeMaio, and it was funded in part by Republican gubernatorial candidate John Cox.YOUR VOICE YOUR VOTE: See results of key races"The cost of living is already on the increase in California and families are struggling to survive. This is unacceptable," DeMaio said earlier this year of the gas tax hike. DeMaio and other Prop 6 backers contend that under the gas tax and vehicle registration fee hikes, the average family of four can expect to pay almost 0 more this year alone. A ballot argument co-authored by Cox in favor of Proposition 6 dismisses contentions that the gas tax funding is critical to fixing the state's roads and improving transportation in the state. "Don't be fooled by opponents who claim there is no money to fix roads if Prop 6 passes," the ballot argument states. "If the transportation- related taxes and fees we already paid before this new tax increases took effect were spent on transportation, the state would have .6 billion annually for transportation needs, without raising taxes."Opponents of the measure blasted the proposition, insisting that repealing the gas tax would eliminate funding for transportation projects statewide. In Los Angeles, a recent City Administrative Office report estimated that eliminating SB1 funding would cost the city .5 million in funding this fiscal year alone, while the county could lose more than billion.Gov. Jerry Brown, who championed the gas tax, has been vocal in his opposition to Proposition 6."The test of American strength is whether we defeat this stupid repeal measure which is nothing more than a Republican stunt to get a few of their losers returned to Congress," Brown said during a recent event at Los Angeles Union Station. "And we're not going to let that happen." 2585

LOS ANGELES (CNS) - In a tearful news conference, the Riverside couple wounded when an off-duty Los Angeles police officer fatally shot their developmentally disabled son during what the lawman contends was an act of self- defense at a Costco in Corona decried the shooting Monday and said they presented no danger to the officer. ``I begged and told him not to shoot,'' Russell French told reporters at the Ayres Hotel in Corona. ``I said we have no guns and my son is sick. He still shot.'' Russell and Paola French's son, 32-year-old Kenneth French, was killed when Los Angeles Police Department Officer Salvador Sanchez opened fire the afternoon of June 14 inside the Costco store after what the officer's attorney has described as a life-threatening assault by Kenneth. Sanchez, a Southwest Division patrol officer who has been with the police department since May 2012, is on paid administrative leave. Dale Galipo, attorney for the French family, again insisted the shooting was not only unwarranted, but ``one of the most egregious shootings I have seen.'' Galipo said he filed a damages claim Monday against the LAPD and the city of Los Angeles, a precursor to a lawsuit. He did not specify a damages amount being sought. Kenneth French's parents suffered gunshot wounds to the back when the lawman opened fire, according to Galipo, who said earlier the injuries confirm ``that they were not facing in Officer Sanchez's direction at the time they were shot.'' He said the couple have had a difficult physical recovery. Galipo called for the release of surveillance video from inside the Costco store. The release has been blocked by a court order obtained by the Riverside County District Attorney's Office, which is investigating the shooting to determine if charges are warranted. District Attorney Mike Hestrin declined to comment on the matter Friday. He told City News Service in June that the Corona Police Department had submitted its findings on the Costco incident without a specific recommendation, leaving it to the D.A.'s office to make an unbiased determination regarding potential criminality. Conflicting stories emerged over the circumstances, with the officer's attorney, David Winslow, insisting his client responded appropriately. Kenneth French, whom Galipo said was a diagnosed schizophrenic and nonverbal, was in the freezer section of the store at 480 N. McKinley St. when he came into contact with Sanchez, according to witnesses. Corona police said the off-duty officer was shopping with his family, holding his 18-month-old son in his arms, when, ``without provocation, (Kenneth French) assaulted the officer.'' According to Winslow, Sanchez was knocked to the floor and briefly lost consciousness. When he awoke, he found his son next to him, screaming. Winslow said his client ``had no choice but to use deadly force'' in self- defense. Galipo told reporters that Kenneth French, who had recently been taken off of his medications for undisclosed reasons, pushed or shoved the officer in the back in a food-sample line, but he denied that there was any serious threat. He also said French's parents tried to explain to the officer that their son was intellectually disabled. Galipo called Sanchez's response ``a complete over-reaction.'' He pointed out that, ``if anyone other than an off-duty police officer had shot three unarmed civilians in a Costco, that person would be in jail and facing criminal charges for murder.'' Winslow, however, repudiated the ``push or shove'' description, saying French's action amounted to ``a violent attack.'' The officer suffered minor injuries, but his son was not hurt. 3654

LOS ANGELES (CNS) - Two Beverly Hills men, including a Realtor, have been charged with burglarizing the homes of singers Usher and Adam Lambert and other residences by allegedly using open houses to facilitate the crimes, the Los Angeles County District Attorney's Office announced Thursday. Jason Emil Yaselli, a 32-year-old Realtor, is scheduled to be arraigned Friday in a downtown Los Angeles courtroom on 50 felony counts, including first-degree residential burglary, first-degree residential burglary with a person present, money laundering, identity theft, conspiracy to commit burglary and conspiracy to commit money laundering. The charges include an allegation of taking more than 0,000 through fraud and embezzlement. Yaselli, who was arrested Wednesday by Los Angeles police, was jailed in lieu of .73 million bail. Co-defendant Benjamin Eitan Ackerman, 33, pleaded not guilty Monday to the same charges, which allege crimes between December 2016 and August 2018. The criminal complaint alleges that Yaselli ``allowed defendant Ackerman to use his credit card with the understanding that defendant Ackerman would pay down the principal and interest from the proceeds of the sale of the luxury items taken from 14 inhabited dwellings'' and ``encouraged'' Ackerman to commit the burglaries. The alleged victims of the burglaries included Usher, Lambert, reality TV personalities Paul and Dorit Kemsley and former professional football player Shaun Phillips. In many instances, Yaselli and Ackerman allegedly identified the targets or committed the burglaries during open houses in Beverly Hills, West Hollywood, Brentwood and Hollywood Hills, according to Deputy District Attorney Stephen Morgan. At a Jan. 2 news conference, Los Angeles police announced that more than 2,000 high-end items -- including art work, clothing, purses, jewelry and fine wine -- had been seized from a home and storage unit belonging to Ackerman. ``Ackerman would pose as either an interested buyer or in purchasing the property or he would pose as a real estate broker wanting to show the property,'' Los Angeles Police Department Capt. Cory Palka said at the news conference. ``With the assistance of the LAPD's Commercial Crimes Unit, Hollywood detectives were able to identify 13 separate burglary victims based on evidence recovered from the locker or storage unit and Ackerman's residence. We believe there may be additional victims based on the large volume of stolen property that was recovered and are asking the public's help in identifying additional victims, and most importantly, returning their property to them.'' LAPD Detective Jared Timmons estimated that the items are collectively worth ``in the millions of dollars, multiple millions of dollars.'' Investigators determined that Ackerman -- who has a criminal record -- had signed into open houses on several occasions and asked in one instance about acquiring rare art work, the detective said. Ackerman -- who allegedly went after ``high-value targets'' -- showed up to the open houses while ``dressed to the nines'' and ``acted the part'' without being challenged to confirm his identity or where he was employed, according to the detective. ``He would tour open houses and he would come back later,'' Timmons told reporters. ``... This person is very sophisticated. In a lot of these cases, we see tampered surveillance videos. We're still looking into that. As we said, open houses usually were the main source of that. However, we do have one case where he targeted a family friend, so nobody's off the table.'' Ackerman was initially arrested last September by Los Angeles police, then arrested again on Aug. 16, one day after the criminal charges were filed. He was subsequently released on a .2 million bond and is due back in court Oct. 3, when a date is scheduled to be set for a hearing to determine if there is sufficient evidence to require him to stand trial. Yaselli and Ackerman could face up to 31 years and eight months in prison if they are convicted as charged, according to the District Attorney's Office. 4099
