SAN DIEGO (KGTV) -- A judge has ruled that the government can continue waiving environmental laws to proceed with construction of a U.S.-Mexico border wall.Judge Gonzalo Curiel issued the ruling Tuesday afternoon. The ruling allows 14 miles of border wall to be built southeast of San Diego.The ruling comes one day after the Washington Post reported that President Trump will visit border wall prototypes in mid-March. RELATED: President Trump to visit San Diego, inspect border wall prototypesIn early February, ABC News reported that the Center for Biological Diversity filed a lawsuit against the U.S. Department of Homeland Security to protect endangered butterflies. Environmentalists claim the Quino checkerspot butterfly and a number of other species could be in danger if construction of the border wall continues. “We intend to appeal this disappointing ruling, which would allow Trump to shrug off crucial environmental laws that protect people and wildlife,” said Brian Segee, a senior attorney at the Center for Biological Diversity.“The Trump administration has completely overreached its authority in its rush to build this destructive, senseless wall. They’re giving unprecedented, sweeping power to an unelected agency chief to ignore dozens of laws and crash through hundreds of miles of spectacular borderlands. SAN DIEGO (KGTV) — A popular North Park concert venue has agreed to pay ,000 worth of fines and reimburse the City of San Diego ,000 in police investigation costs.The operators of Observatory North Park agreed to pay the penalties after City Attorney Mara Elliott filed a complaint against the venue on July 3. The complaint alleged the venue's operators were maintaining a public nuisance and operating without required permits. The city attorney's office added that the Observatory has become a source of local complaints for, "noise, violence, teenage drinking, public intoxication, public vomiting, and the accumulation of trash, debris, and human waste."“The Observatory has long dragged its heels on correcting violations that would protect the safety of its patrons and North Park community residents,” Elliott said in a release. “Its managers have agreed to begin following the law, and if they don’t, our Office will be there to hold them accountable.”The building also includes West Coast Tavern next door, which shares restrooms and bar areas with the theater.Between January 2015 and May 2019, San Diego Police received 174 calls to the venue, leading to 500 hours of overtime, the office said.The operators of the North Park venue agreed to address criminal activity and nuisance complaints and obtain all required permits. The venue's mezzanine and balcony will also remain closed until building permits and code violations are addressed. If the Observatory fails to comply with the terms of the agreement with the city, another 0,000 in fines will be issued, the office said.The lawsuit is the latest issue in the city's battle with the venue. SAN DIEGO (KGTV) -- A man died after an SUV veered off a freeway in the National City area and crash landed in the Sweetwater River Friday morning.The California Highway Patrol said the incident involving a Lexus SUV was reported just before 5:40 a.m. on the westbound side of state Route 54, near the transition to Interstate 5.ABC 10News learned a woman was walking on a bike path along the Sweetwater River when she saw a vehicle come off the freeway and down an embankment.The woman told authorities that the SUV almost hit her and then crashed in the water.Authorities at the scene confirmed that a man believed to be the driver was pulled from the water but died despite life-saving measures at the scene. The CHP identified the man as a 69-year-old Chula Vista resident.A team of divers was sent into the water to determine if more people were in the SUV, but no other victims were located. The CHP later confirmed the deceased male was the SUV's lone occupant.A tow truck helped pull the vehicle from the water.The cause of the crash is under investigation and anyone who may have witnessed the incident is urged to contact local authorities. 1158

SAN DIEGO (KGTV) -- A San Diego family is hoping to make their way home from Mexico on Thursday after having to ride out Hurricane Delta at the hotel where they were staying. Victor Lopez is a local restaurant owner of El Pollo Grill. Lopez's family traveled to Playa Del Carmen, Mexico last week. As Hurricane Delta was approaching, they booked a flight to leave the region, but their flight was canceled as they were heading to the airport. As the hurricane was approaching, the family was moved to a hotel ballroom where they spent the night as the hurricane passed. Lopez says there were no windows in the ballroom so they could only hear the heavy rain and strong winds. Lopez admits that the ballroom was crowded and there was some concern of COVID-19, but he said the hotel staff was disinfecting constantly and everyone was wearing masks. The hurricane did little damage to the resort in Playa Del Carmen, but just 45 minutes away in Cancun's hotel zone, debris and palm fronds were scattered all over the streets. Lopez and his family are hoping to return to San Diego on Thursday afternoon. Hurricane Delta is expected to make landfall in Louisiana on Friday afternoon. 1188

SAN DIEGO (KGTV) -- A local father is just a few days away from reuniting with his family who is in federal quarantine in Northern California at Travis Air Force Base. Ken Burnett's wife and two young children were visiting Wuhan, China when the coronavirous broke out. The city shut down and the three were stranded, unable to fly home. Their 14-day federal quarantine ends on Tuesday. Burnett plans on traveling to Northern California to reunite with his wife and kids so they can all travel back to San Diego together.
