PONTIAC, Mich. (WXYZ) — An Oakland County, Michigan, judge ruled Monday to keep a high school sophomore in detention after violating probation by failing to complete online school work. The Oakland County Children’s Village TAG program provides several forms of therapy, counseling and educational support, but defense attorneys argue it is not an appropriate legal action.Judge Mary Ellen Brennan says she had to consider the actions that placed Grace on probation to begin with. Last fall, arguments between the teen and her mother turned violent. The judge says the mother was the victim and the daughter the aggressor.“How many times does she get to jump her mom before she’s a threat? How many times?” Judge Brennan said.“That is not the question in front of the court,” Defense Attorney Saima Khalil responded.“That’s the question I’m asking you. How many times?” said Judge Brennan.Fifteen-year-old Grace's story has gained national attention. She was placed in juvenile detention in June after violating probation by failing to complete online school assignments in May. The judge says the teen's mother repeatedly called a case worker for help.During court proceedings Monday, the defense pointed out that a lot of students struggled with virtual classwork, but the judge says Grace's mom was the one who made repeated calls to the case worker saying her daughter refused to get out of bed, wouldn't do her school work and needed help.Khalil and fellow defense attorney Jon Beirnet went head-to-head with Judge Brennan, who continued to bring up the original violation for Grace, which included physical altercations with her mother last fall."The probation violation had nothing to do with a violent act. There is no tampering of a GPS tether," a defense lawyer stated.That probation violation put the high school sophomore in juvenile detention during a pandemic.Grace attends Birmingham Groves High School, where she receives support for ADHD. Grace's school closed in March like everything else when Gov. Gretchen Whitmer issued a stay-home order.When classwork was made available online, Grace's attorney says it wasn't required. There was no academic or classroom consequence. Judge Brennan said Grace's mother had repeatedly called the case worker for help.Outside the courtroom, demonstrators demanded Grace's release."We must dismantle the school to prison pipeline," said Tylene Henry with Michigan Liberation Action Fund.The action fund is asking for support, not punishment.In the courtroom, Grace spoke before the judge."Each day I try to be a better person than I was the last," the teen said. "And I’ve been doing that since even before I was in this situation. And I’m getting behind in my actual schooling while here. The schooling here is beneath my level of education."Judge Brennan insisted Grace should continue in the detention program, which offers therapy while her mother takes parenting classes."The goal is you and mom safe healthy and happy in the home, we disagree about what that looks like," The judge said. "To get to that goal... you think you’re ready, I think you’re not. I think you’re exactly where you’re supposed to be; you're blooming there."There was another motion filed by the defense attorneys. POWYS, Wales – A police dog in Wales had an eventful first shift and he deserves all the treats.Dyfed-Powys Police say their newly licensed dog, Max, found a missing mother and her 1-year-old child on the edge of a ravine during his first night on the job.Police say the 2-year-old German shepherd and his handler, PC Peter Lloyd, were crucial in tracking down the woman and toddler, who were reported missing on Saturday.The woman had reportedly not been seen or heard from for two days, which was out of character, and her phone wasn’t working.Thankfully, officers say the woman’s car was quickly found on a mountain road, which gave crews an area to start searching.“This is where PD Max’s tracking skills really came into play,” said Inspector Jonathan Rees-Jones in a press release. “Despite only recently becoming licensed, and on his first operational shift, he immediately commenced an open area search.”Police say Max and Lloyd covered a significant distance and at 1:30 p.m., they spotted the missing woman waving for help near a steep ravine on the mountain side. She was helped down, and arrangements were made for her and her baby to be checked out by medical professionals.“They were safe, but cold, and appeared to have been in the area for a significant amount of time,” said Rees-Jones.Max is a general-purpose dog, who will primarily be used for tracking and locating people in buildings and open air, tracing discarded property and tracking and detaining suspects, according to police.“I was really pleased that during our first operational deployment as a dog team, myself and Max were able to safely locate the missing mother and baby,” said Lloyd. “Max remained focused throughout the long search and he proved invaluable when he reacted to the call for help which resulted in us locating them.” 1825

POWAY, Calif. (KGTV) - Poway residents gathered Monday night to rally against an anti-Semitic hate crime during Hanukkah. Someone painted a swastika on the side of a Jewish family’s home and poured some type of chemical on their car Sunday night. Shawn Seibert lives in the house with his mother. He says he heard noises around 11:20 p.m. and went outside, only to see two people away. That’s when he noticed the swastika on the side of their house and the damage to his car. Sunday night was the start of Hanukkah.“When you see it, it just shakes you down to your core,” Seibert said. “How can someone do something like that to someone they don’t know?” The community came together Monday to show their support for the Seiberts. Several dozen people gathered at the corner of Poway and Community Roads with signs preaching against hate, as drivers honked their horns in support of the rally. The Seiberts were able to remove the swastika Monday morning. 963

President Donald Trump plans to announce his Supreme Court nominee on Saturday. He has said it will be a woman and she will be conservative.If the nominee goes through, it would give conservative justices a 6-3 majority over their more liberal counterparts.That sets up talk about abortion, but the Roe v. Wade debate isn't all about the Supreme Court.“Enough lower courts have not decided what they think about this,” said Carol Sanger, a professor at the Columbia law school. “We, the Supreme Court, doesn't like to lead on a particular issue until the lower courts who have trials and so on have thought about it.”Under a conservative majority, the Supreme Court has ruled on an abortion case. Conservative Chief Justice John Roberts sided with a ruling that kept abortion clinics open by not requiring abortion doctors to have nearby hospital admitting privileges.The high court already ruled on a similar case out of Texas.“There is a special doctrine called stare decisis, which means when you have a case and it’s like a previous case, look to that previous case and say how did that come out,” said Sanger. “And unless there is a very, very strong reason to change that decision, you follow precedent, you follow what happened the last time this issue came up.”Sanger says enough lower courts have to rule and be split on the decision to make it to the Supreme Court.The Supreme Court would need to decide it wants to take up Roe v. Wade before courts before them. Sanger believes that's unlikely to happen.“It seems pretty clear that he doesn't want to be known as the guy who had Roe knocked out under his chief justice-ship,” said Sanger.Both Justices Kavanaugh and Gorsuch said they accepted Roe v.
