VISTA (CNS) - A male recently reported missing from Oceanside was hospitalized this morning after he was struck by an SUV in Vista.The collision was reported just before 3 a.m. at 2405 N. Santa Fe Ave., said San Diego County sheriff's Sgt. Kevin Johnston.The pedestrian was struck by a red Dodge Dakota that was southbound on Santa Fe Avenue. ``The driver of the Dodge Dakota looked down briefly and when he looked back up a pedestrian was standing in the middle of the roadway in front of him,'' Johnston said. ``The driver of the Dodge Dakota attempted to swerve but collided with the pedestrian.''Oceanside firefighters provided first aid to the pedestrian who suffered an apparent broken leg and was unconscious with what appeared to be severe head trauma, the sergeant said.He was taken to Palomar Medical Center for treatment, Johnston said. The SUV driver remained at the scene and speed or alcohol do not appear to be factors in the crash, he said. 964

VISTA, Calif. (KGTV) – A group of teenage girls attempted to set a trap for a 32-year-old man who tried to meet one of them for sex, according to San Diego County sheriff’s officials. According to sheriff’s officials, deputies responded to a reported kidnapping at 1385 East Vista Way in Vista around 2:30 p.m. Sunday. A group of juveniles told responding deputies they used a social media app to contact “an older man who was looking for underaged girls to have sex with. The group hoped to expose the male and turn over the information to law enforcement agencies for prosecution.” Sheriff’s officials said the group made contact with Robert Dreyfus on the app and exchanged text messages. A meeting location was established at a shopping center at 1385 East Vista Way. Officials said that “Dreyfus arrived and convinced the 17-year-old victim to get into his vehicle to talk,” but he then drove away with the girl without consent. According to officials, the girl was able to message her friends for help, and they contacted authorities. Deputies made contact with Dreyfus, and he stopped his vehicle near the 2000 block of East Vista Way. The girl got out of his vehicle and was not hurt, officials said. Dreyfus was arrested by responding deputies and booked into Vista jail on suspicion of kidnapping, sending harmful matter to a minor and communication with a minor for specific offenses. (KGTV) -- A Navy veteran accused of torturing and disfiguring his neighbors’ dogs decided Tuesday to represent himself in court.The accused attacker, David Herbert, told the jury room repeatedly that he didn’t do it, adding that authorities have the wrong man.Prosecutors in the case say the evidence and video show there’s no mistake. Herbert is accused of such torture as gouging out a Husky’s eye and pouring acid on another. Prosecutors say they have several smoking guns, including a bloody bat and saliva samples with DNA from the dogs taken from Herbert’s car and home.The most compelling evidence in the case is surveillance video of a missing dog Herbert is seen driving away with. The dog was never seen again.Other neighbors further detailed the alleged abuse inflicted on the two Huskies. One of the dogs was dumped at Camp Pendleton and, when that failed, Herbert reportedly broke into their home, gouging out one of the dog’s eye and forcing another to ingest antifreeze.Both families said they moved, terrified Herbert would hurt their children. (CNS) - A verdict has been reached in the trial of a woman and her gun instructor who are accused of carrying out a plan to kill the woman's estranged husband.A jury has found Diana Lovejoy, 44, guilty of conspiracy to commit murder and attempted murder. Welcon McDavid Jr. was also found guilty of conspiracy to commit murder, but the reading of the verdict had to be postponed because Lovejoy passed out. Lovejoy and McDavid Jr. were charged with conspiracy to commit murder and attempted murder in the Sept. 1, 2016, attack on 45-year-old Greg Mulvihill, who was wounded in the 11 p.m. shooting in Carlsbad.Police allege Lovejoy and McDavid planned the crime and that the latter - - who worked at a gun range where Lovejoy was taking marksmanship lessons -- called the victim, arranged to meet him in the alley and opened fire on him with a rifle while hiding in a patch of bushes.Court records indicated Lovejoy and Mulvihill were in the midst of a contentious divorce, and that she had obtained a restraining order against him on accusations of emotional and sexual abuse.Mulvihill took the stand during the trial and described the moments leading up to him being shot, saying he didn't realize he'd been shot right away and, at first, he thought he felt something in his back even though he could see the shooter in front of him.Mulvihill testified about a bitter custody battle with his estranged wife.Mulvihill said he went up a remote trail in Carlsbad out of desperation, fearing Lovejoy would reopen their custody battle. He took a friend, a flashlight and a small aluminum baseball bat, but he thought he was picking up documents from a private investigator.Instead, as he approached the spot off Rancho Santa Fe Road and Avenida Soledad, he shined his flashlight around and spotted someone dressed in camouflage pointing a long gun right at him.Before he knew what was happening, Mulvihill said he was hit once in the side, the bullet exiting out his back. McDavid faces 50 years to life behind bars, and Lovejoy could be sentenced to 25 years to life.After court, the jury foreperson, Erin Reed,  told reporters the defense version of the shooting "seemed too far-fetched." 2224

(KGTV) - The mother of a 14-year-old girl sexually assaulted by a San Diego Deputy filed a civil lawsuit citing negligence and invasion of privacy.Deputy Timothy Wilson pleaded guilty to lewd acts on a minor and two counts of unlawfully taking computer data. He’s serving jail time. The victim’s mother, Jennifer Tanis, says Wilson accessed her daughter’s police file 44 times. He was able to get her home address, videos, and pictures of her daughter. She tells 10News she’s suing the county, not for money, but change. Currently, all deputies are allowed to access police files, but she thinks the only person who should have access to them is the lead investigator.She says the county failed her.“There was no system in place to protect my daughter, her story or the pictures they took of her during the investigation," Tanis said.Tanis is pushing for change not only in the county but the entire country. She reached out to Congressman Mike Levin’s office for help. San Diego County has said they have the capability of making police reports private, but only in some cases. Deputy Wilson’s case wasn’t reportedly one of them. 1152
