SAN DIEGO (KGTV) -- Proposition 25 is a measure that would end the money bail system, replacing it with an assessment for public safety and flight risk. If approved, it would allow SB 10 –signed into law in 2018—to take effect.Team 10 spoke to a San Diego mother against Proposition 25. She did not want to be identified because her daughter has an open case. She said she was recently able to get her out of jail by paying bail.“It would be devastating not to have that available,” she told Team 10 over the phone. “Unfortunately, she is caught up in a very unhealthy relationship and she actually was the victim in this.”She said her daughter has mental health issues and is worried that her daughter would have unfairly stayed in jail longer.“Not having [bail] available, I wouldn't have been able to get her out especially with this whole pandemic going on. There [are] delays in the courts. Courts are not open.”While many civil rights groups have worked to reform the current system, some do not believe this proposal is better. The No on 25 ad features the President of the California NAACP.In the ad, Alice Huffman says “Prop. 25 ends our right to put up bail for anyone, even though they may have been racially profiled. Prop. 25 replaces bail with computer algorithms.”Backers of the measure believe Proposition 25 is a fairer system. Opponents believe it is a “new discriminatory system of computer-generated profiling,” according to the argument against Prop. 25 in the official voter guide.Legal analyst Michael Crowley said while parts of the ad are factual, there are misleading statements.“It is factually correct that this proposition will replace the cash bail [and] bail bondsman with algorithms. They say algorithms like it's a dirty word, but we live with algorithms every day,” Crowley said. “In fact, they're using some algorithms in the court system as we speak.”In reference the term “black boxes” used in the ad, Crowley said that it is a “term in the industry that is just used to talk about algorithms that they keep them proprietary.”The American Bail Coalition is a major backer of the No campaign. The Legislative Analyst's Office said if approved, it could increase state and local costs by the mid hundreds of millions of dollars a year. It could also decrease county jail costs in the high tens of millions of dollars.“In the criminal defense community, there are people on both sides on it,” Crowley said. “The civil rights groups have kind of split on it.” 2500

  

SAN DIEGO (KGTV) — Parents who are concerned about their traditional school district’s ability to handle distance learning this fall are running into a roadblock when seeking other options: wait lists.School choice advocates say a growing number of California parents are seeking out charter schools that specialize in “nonclassroom-based” instruction because of their long track records in distance learning, but a new state law is essentially capping enrollment at pre-pandemic levels.“Tens of thousands families are in limbo right now,” said Jeff Rice, founder of the APLUS+ Network Association, an association of 85 nonclassroom-based California charters that specialize in personalized instruction.There are at least 13,000 students currently waitlisted throughout about two dozen of the association’s schools, Rice said.Advocates have launched petitions, urging lawmakers to scrap a provision in SB 98 that capped funding for all public schools -- including charter schools -- at February attendance levels.Schools are typically funded on a per pupil basis, but the cap means funding will not scale up as attendance grows.“Some [charter] schools have wait lists of 2,000,” said Jennifer Cauzza, executive director of the JCS Family of Charter Schools.Cauzza said she’s in contact with about 30 charter school executive directors and “all of them are capped.”About 300 of California’s 1300 publicly funded charter schools are classified as “nonclassroom-based,” Rice said. The term includes home school, online and hybrid models, and is somewhat of a misnomer because students often get some in-person instruction from a credentialed teacher.These tuition-free charter schools will operate wait lists on a lottery system, not a first-come basis, so parents still have time to apply.Otherwise, parents who want to homeschool their children have two other options, and both require the parent to act as the teacher, said Elisa Hilliard, who operates the Facebook page San Diego Homeschool Mom.Parents can file a PSA, a Private School Affidavit, and essentially open their own private school within their home. Parents select and teach their own curriculum, and must fund it themselves.Parents can also join a PSP, a Private School Satellite Program. These are umbrella organizations or co-ops of parents that assist with paperwork and help swap curriculums.Parents have until October to file a PSA, so families who are unable to get into a nonclassroom-based charter school may want to see how their traditional district school handles distance learning before going off on their own, Cauzza said. 2608

  

SAN DIEGO (KGTV) -- Police responded Monday after a vehicle crashed into a Chick-fil-A in Mira Mesa.The crash happened on the 10700 block of Camino Ruiz near Mira Mesa Community Park. Authorities say no one was injured.Due to the crash, the inside of the restaurant was closed for the day as a structural engineer inspected the damage. Authorities haven't said what caused the crash.  407
