SAN DIEGO (KGTV) - The family of a mother and daughter killed by a YouTuber in a wrong-way crash on Interstate 805 filed a lawsuit this week against the teenager’s estate, the City of San Diego, and the County of San Diego. Eighteen-year-old Trevor Heitmann, known as McSkillet, drove his McLaren the wrong way on the freeway in August 2018, killing Aileen Pizarro and her 12-year-old daughter Aryana. The sports car collided with the family’s SUV, which burst into flames. In their lawsuit, Aileen’s father Miguel Pizarro and son Dominic Pizarro cited the County and City for negligence resulting in death. The lawsuit cites an incident the day before the crash, during which the San Diego County Psychiatric Emergency Response Team responded to a call claiming Heitmann was “screaming, paranoid, and delusional”. A psychiatrist, Dr. Mary Rusher, told police she had evaluated Heitmann and he was “a danger to himself and to others and must be immediately detained on a California Welfare & Institutions Code 5150 hold,” the suit stated. Rusher also told a police dispatcher Heitmann had displayed manic symptoms and appeared paranoid, delusional, out of control, and threatened to harm his mother in preceding days, according to the court document. “Police left the home without any evaluation of Trevor’s condition, or notifying PERT, if they were not part of same (PERT),” the lawsuit says. The suit claims the police officers were not exercising their authority to place Heitmann on a 5150 hold in accordance with the law. SAN DIEGO (KGTV) - The Medical Board of California has filed an accusation and petition to revoke the probation of a Del Mar doctor who is accused of prowling in a former girlfriend’s backyard.10News first broke the story about Dr. Jeffrey Lovin in May after we were given home security video showing a man lurking behind a home. An ex-girlfriend said the man in the video was Dr. Lovin, a radiologist. Lovin was charged with prowling, peeking and violating a restraining order. He pleaded not guilty.At the time, Lovin was already on probation with the Medical Board for other criminal activity. This month, the Board issued an accusation and petition to revoke his probation. SAN DIEGO (KGTV) - The hospital patient who brutally beat a San Diego nurse faced a judge on Friday for his sentencing. 10News was in the courtroom, where the nurse described how she fought for her life while 41 year-old Geoffrey Brizzolara attacked her.“I stood in his doorway and I said, ‘How may I help you, sir?’ His response was to lift a 25-pound chair over his head and throw it at me,” nursing supervisor Mary Prehoden told the courtroom. “Mr. Brizzolara beat me with his fists. He kicked me and then scratched me and he pulled a handful of hair straight out of my head,” she went on to say.The attack happened last summer at Scripps Mercy Hospital in Hillcrest. He was a patient at the hospital and apparently has a history of mental health issues. He did not know Nurse Preholden.“His actions were deliberate and vicious. I was defenseless,” she told the courtroom.She was joined by other nurses who say that patient violence against nurses is a constant concern across the country. Nurse Trish Mcauliffe told us, “The resources have to be increased- mental health resources.” Mcauliffe described how she was once attacked by a different patient at another hospital. “I ended up with a split lip [and] loose teeth and then he stood in the doorway, laughing.”Friday, Brizzolara was sentenced to one year behind bars, with an option for early-release to a mental health treatment facility.“Every single one of us who chooses to do this for a living is under threat every day in every hospital in this country,” added Prehoden. 1542

  

SAN DIEGO (KGTV) - The fate of a beloved torrey pine - saved from the chopping block more than seven years ago - is once again in question.Along tree-lined Long Branch Avenue, one tree has captured the hearts of Jeff Ray's family."My kids loved it.  They touch it all the time.  It's wonderful," said Ray.The towering torrey pine is believed to be about 90 years old."It signifies the beauty of nature and the history of the area," said Ray.The history includes safety concerns. In 2010, with the sidewalks buckling, city experts deemed it a safety hazard, concerned the leaning tree would fall over. Upset neighbors hired their own arborist. Eventually, the city relented, deeming the tree stabile and repairing the sidewalks.  Since then, the tree has been granted Heritage status, giving it extra protections. Still, safety concerns remain.  On Wednesday afternoon, a city advisory panel met and the city's forester told the group the tree isn't just learning. It's actually on the move."The tree has moved an inch-and-a-half in the last two-and-a-half years. The city is recommending removal of the tree based on safety," said City Forester Brian Widener. 1192
