SAN DIEGO (KGTV) — From the confrontation in a Los Angeles Trader Joe's to a showdown in a San Diego Starbucks, there have been a lot of customers claiming businesses can't legally require them to wear a mask.Some customers even carry a card threatening fines and citing the Americans with Disabilities Act, or ADA. But there are three things to consider before making an ADA claim, according to lawyers.First, to bring a successful ADA lawsuit, attorneys say the person without a mask must truly have a disability. Businesses can ask if a person has a disability, but not much beyond that.RELATED: Confrontation over wearing a mask at Coronado coffee shop"You can't delve into someone's medical condition and ask them a bunch of questions," said attorney Colin Harrison. "I would not advise businesses to ask for any type of documentation."If the person says they have a disability, the ADA requires businesses to make reasonable accommodation. There's a third component in the ADA: Subsection 36.208 allows businesses to turn disabled people away if they pose a direct threat to the health and safety of others."Someone not wearing a mask, they might think they're not infected, but they could be and pose a direct threat to spread the virus to many people," Elia said.The Equal Employment Opportunity Commission has said COVID-19 does constitute a direct threat, so our experts say the threat of a successful lawsuit in a case like this is low.That said, there's nothing stopping people from filing these lawsuits. There have been at least nine across the country. But businesses that win can pursue legal fees from the other party. 2548

San Diego (KGTV) -- Hotel guest jolted awake after the Howard Johnson by Wyndham caught fire, early Tuesday morning.The fire erupted around 4:15 a.m. on El Cajon Blvd in the College East neighborhood.One of the rooms was destroyed, and two others were severely damaged, according to firefighters. At least 4 to 5 units are reported to be uninhabitable for various reasons.It took about 20 minutes to knock down the fire.One man staying in the unit right next to the fire, told ABC 10News he had to run right past the flames to escape.The entire hotel was evacuated, and everyone managed to get out safely. No one was hurt.Firefighters are trying to figure out if anyone was inside the unit when it caught fire. SAN DIEGO (KGTV) - For decades Veterans Village of San Diego has been committed to serving homeless veterans, aiding in transitional housing and rehabilitation. In recent years, however, they've been struggling to fill vacant beds."Over the last several years, we've just seen a change in the environment. There's a lot of resources here in San Diego for homeless veterans. The number of veterans who've wanted to come through our programs has decreased," said Kim Mitchell, President and CEO of Veterans Village. "Some just aren't ready, as you know there's are a lot of homeless here in San Diego, not only veterans but non-veterans, people are in various stages of where they are in life."Now the nonprofit hopes to welcome non-veterans into two of their programs: County-funded Drug Medi-Cal and the transitional housing program. "There is a lot of people that want to get off the street and want to go through a program to get clean and sober, and so if we have beds in this program that can help them do that we want to do that," said Mitchell.Mitchell says they have full support from the Housing Commission and the U.S. Department of Veteran Affairs.Leaders will ask City Council on Tuesday to approve the request. If approved, the nonprofit could serve non-veterans within weeks. 1297

SAN DIEGO (KGTV) -- Due to struggling ridership, the City of San Diego has been busy creating a plan to revamp its bikesharing program.On Wednesday staff will provide an update on improvements made and future plans, in response to a grand jury report in 2016.The program, DecoBike, is privately owned but works in partnership with the city.Critics of the program say it has not met the city's needs due to where stations were built.Last year a county grand jury report titled "San Diego's Bikesharing Program Needs Help," outlined ways the city and DecoBike could improve to better serve the community.One recommendation was to put more stations in beach communities, even though local business owners and residents protested them being there.Since then, the city has done the opposite, removing 14 stations from beach communities.City spokesperson Katie Keach says the city and DecoBike are concentrating on increasing the number of stations in the urban core.By doing this, they believe it will provide for a comprehensive system to increase alternative transportation options. They say it will also help the city meet its Climate Action Plan goals.Keach says they hope to have additional stations in North Park, Uptown, Golden Hill and downtown this winter.The city is conducting presentations to community planning groups this fall, seeking public input.Bicycle and climate activists want the program to succeed, saying it's critical to the city's Climate Action Plan.  1486

What we need is strength and some resolve that we haven't seen yet,” said former Vice President Joe Biden.In an interview, candidate Sen. Bernie Sanders renewed calls for an assault weapons ban but acknowledged uwpards of 10 million are already in civilian hands. “That is more than the United States military has,” Sanders said. "We have to immediately ban the sale and distribution; I think we ought to take a hard look about licensing these weapons for the people who own them."Sanders added a buyback program would also be an option.Sen.
