SAN DIEGO COUNTY (KGTV)— Many residents in San Diego County woke up to a big mess after yesterday’s storms brought in the steady rain. Many people witnessed an early morning recovery mission in San Diego Bay Sunday. A 30-foot boat was found partially underwater at La Playa Cove near Shelter Island. San Diego Harbor Police believed no one was inside. But, a friend of the boat owner thought last night’s weather and rough waters might be the reasons it sank.“They may have come in last night during the storm and coming in, the boat sank on them,” friend of the boat owner, Jeff Gough said. Meanwhile, in North County, a large pine tree toppled down onto Eldorado Drive in Escondido.“There was room for like one car width for people to go around it,” homeowner Richard Bensinger said. Bensinger remembered when he planted what was a tiny Christmas tree in his front lawn 15 years ago. It has since grown to be more than 30 feet tall. Bensinger was shocked it came down this morning. He knows now, not to underestimate the power of mother nature.“It was angled a bit, but the roots were spread all over the place. So I'm surprised it actually fell over, but it’s just been so wet and muddy out there, and as you can see, all that mud pulled the whole thing over,” Bensinger said. He now has to live with a pile of pine chunks on his front lawn until county crews come to pick them up. Still, he is relieved no one was hurt.“I’m glad it didn’t fall onto somebody as they were falling down the street,” Bensinger said. The next storm is headed to San Diego County on Wednesday. SAN DIEGO (KTGV)— A homeless man and convicted rapist accused of sexually assaulting a woman at an East Village bar in November faced his accuser in San Diego Superior Court. Gary Cushinberry, who's accused of multiple counts of sexual assault and attempted rape, pleaded not guilty. The judge ordered all media to conceal the victim’s identity, and to refer to her as Jane Doe. Jane Doe took the stand and recalled what happened on the evening of November 5th. She said she was at Amplified Kitchen and Beer Garden in East Village, celebrating with some colleagues.After having a few drinks, she headed to her car. She admitted she was drunk at the time, and her memory was hazy. But she did remember the moment her bottom touch the ground.“He was touching underneath the blanket, and I just remember being shocked. Uh, next he further proceeded to put his hand in my pants,” Doe said. While he attacked her on the ground underneath a dirty blanket, he tried to drug her with what she thought was a meth pipe, Doe continued. Detective Carlos Munoz of the San Diego Police Department also spoke in open court. After the case was assigned to him, he monitored surveillance cameras in the area. The detective found footage of a homeless man fitting Gary Cushinberry’s description, pulling Jane Doe into a bush next to her car. The two were not in frame for the next 25 minutes, until video captured Jane Doe speeding away from the parking lot, back into Amplified, where she later reported the assault.“It’s like you imagine a fight or flight. And I didn’t really fight and I didn’t flight. I just froze,” Doe said. Cushinberry, who is already a convicted rapist in Indiana, returned to the frame, just two minutes later. “When he walks up toward the intersection, or the corner, he is adjusting his belt, he is adjusting his waist,” Detective Munoz said. The next day, Jane Doe provided information for a suspect sketch.Officers also took her to Palomar Hospital to run a rape kit. DNA Criminalist Adam Dutra of the San Diego Police Department Crime Lab tested the DNA swab taken from the front button and zipper of Jane Doe’s shorts.“There was strong support for the inclusion of Mr. Cushinberry as the 98% contributor,” Dutra said. Cushinberry’s past convictions include rape in 1995, sexual battery in 1997, and recently, felony robbery in San Diego.His next court appearance is on December 19th. 2407

SAN DIEGO (KGTV) -- Thousands of refugees, immigrants and asylum seekers are finding a place to stay through the Safe Harbors Network, an organization which got its start at the Christ United Methodist Church in Normal Heights. Pastor Bill Jenkins began giving shelter to Haitian refugees back in 2009. And for quite a while the church was the only immigrant welcoming shelter in southern California. Eventually, the Safe Harbors Network was created. It's a growing collection of churches, organizations, and individuals that house refugees, immigrants and asylum seekers. Pastor Jenkins says he's seen an explosion of interest from people wanting to help in recent months after Trump's zero-tolerance immigration policy went into effect. Safe Harbors works in cooperation with ICE to give shelter to people awaiting their day in court.   886

SAN DIEGO (KGTV)- Students at some private schools in San Diego returned for on-campus learning Tuesday.The Academy of Our Lady of Peace in Normal Heights is one of them. The 138 year-old Catholic, all-girls high school is the oldest in San Diego.Solana Musicant is excited to start her senior year."I think this is kind of the new normal, I think getting used to it now is really good," said Musicant.Head of School Dr. Lauren Lek said they began preparing for this day as soon as the school year ended."It's about layer upon layer of safety," said Lek.Those layers include face mask requirements, social distancing, and temperature checks upon entry."From our plexiglass desk to 6 feet physical distancing to make at all times to only eating outdoors to even our UV lights that are on in our buildings to help make sure all bacteria and viruses are cleaned out before the air comes into the classrooms," said Lek.Lek says the changes cost more than half a million dollars. The twenty-thousand dollar a year tuition and donations paid for the upgrades.It's an investment Musicant appreciates."I learn better in person, having a teacher there than I do virtually."Lek says 15% of the roughly seven-hundred plus students chose to continue learning virtually from home. 1275

SAN DIEGO (KGTV)- Drugs and graffiti were just some of the problems filling parks around San Diego, with most of the activity happening during the night hours. A curfew has now been put in place for several parks.Community members and city leaders threw a party Friday morning to celebrate the change. Residents have been rallying for a curfew at City Heights Square Mini Park, which sits in the middle of an assisted living facility for seniors. Neighbors say before the curfew, they observed everything from gangs and drugs at the park. “We are this beautiful community,” says Delia Contreras. “We have kids, we have a lot of good things, but the drugs are no good.”Since the beginning of the year, 217 crimes have been reported within a 1,500 feet radius of the park. The crimes include assault, theft, and vandalism. “To me, San Diego is a paradise, and we need to clean up the whole town,” says Ronald Tieken. City Heights Square Mini Park will now have a nightly curfew from 9 pm to 5 am. There were other parks around the city with the same problems. Cedar Ridge Mini Park, Montclair Neighborhood Park, North Park Community Park and North Park Mini Park. These parks will now have a curfew of midnight to 6 a.m. “It took a lot of time because we didn’t want to take just one site, so we opened it up for other sites to bring their concerns in, and five parks were identified to go forward with it,” says Raul Contreras, with the city’s Parks and Recreation Department. City Heights Square Mini Park will also offer programs for all ages, like aerobics and arts and crafts. The events are free of charge. 1619
