VISTA, Calif. (KGTV) - Kellen Winslow Jr. affirmed his innocence to 10News Thursday as he appeared in court to face a third charge of rape.The son of a Chargers legend, Winslow pleaded not guilty to the alleged rape a 17-year old girl in 2003.  10News was able to capture a few words with Winslow as he walked to his car in the parking lot outside court. When reporter Jim Patton asked about the new rape charge, Winslow responded it would all come out in court. Then asked if he was innocent of the other allegations of raping two women in Encinitas, Winslow said, "I'm advised by my lawyer to not speak on much. But yes, I am innocent." The new charge involves a woman who was 17 years old at the time. Winslow was 19. She claims he raped her while she was unconscious. Winslow Jr.'s attorney has previously said their relationship was consensual.  Thursday, the defense repeated a request for the woman's psychological history.Thursday's court hearing lasted no more than 15 minutes as attorneys debated whether this new case should be tried along with the other two rape allegations. Winslow Jr.'s attorneys argued the new charge could prejudice the other two.The judge allowed the cases to remain joined for now for efficiency but said the trial judge would make the ultimate decision.  Winslow is currently free on a million bond, while required to wear a GPS monitoring bracelet. His trial date was set for March 19th, 2019. 1507

WASHINGTON (AP) — Defense Secretary Mark Esper on Sunday fired the Navy’s top official over his handling of a disciplinary case involving a Navy SEAL.Esper asked for the resignation of Navy Secretary Richard Spencer and Spencer submitted it Sunday, said the chief spokesman for the Pentagon, Jonathan Hoffman.The firing was a dramatic turn in a long-running controversy involving Navy Chief Petty Officer Edward Gallagher, whose case has been championed by President Donald Trump.Esper also directed that Gallagher be allowed to retire at the end of this month, and that a Navy disciplinary board that was scheduled to hear his case starting Dec. 2 be cancelled, Hoffman said. At Esper’s direction, Gallagher will be allowed to retire as a SEAL at his current rank, Hoffman said.Hoffman said Esper lost trust and confidence in Spencer “regarding his lack of candor” over conversations with the White House involving the handling of the SEAL case.“I am deeply troubled by this conduct shown by a senior DOD official," Esper said in a written statement issued by Hoffman. "Unfortunately, as a result I have determined that Secretary Spencer no longer has my confidence to continue in his position. I wish Richard well." 1225

VISTA (CNS) — A man who beat his mother to death with a claw hammer in their Escondido apartment last year was sentenced Wednesday to 26 years to life in state prison.David Noel McGee Jr., 26, was convicted in May of first-degree murder for killing 55-year-old Rebecca "Becky" Apodaca.Deputy District Attorney Keith Watanabe said Apodaca failed to log in for her at-home medical billing job on Feb. 1, 2017, and failed to respond to messages left by her supervisor, family and friends. Apodaca's adult daughter went by the victim's apartment on North Hickory Street about 6:30 p.m. and found her mother unconscious on her blood-soaked bed.RELATED: Son accused of killing mom with claw hammerThe defendant -- naked and covered in blood -- was found hiding in a closet. He had self-inflicted knife wounds on his wrists and forearms and a self-inflicted knife wound across his neck, Watanabe said. A bloody toaster was plugged in and was sitting on the bathroom sink and an empty bottle of Benadryl was found in the bathroom.Levels of an over-the-counter antihistamine found in Benadryl were so high in the defendant's blood that he could have ingested 100 or more 25mg pills, the prosecutor said.Deputy Public Defender Lindsay Itzhaki said McGee's attack on his mother happened "in a fog of Benadryl," and that there was a difference between "killing and murder."RELATED: Man arrested, accused of killing mother in Escondido apartmentAfter his release from the hospital, McGee told police that he was depressed and blamed his mother for bringing him into the world. VISTA, Calif. (KGTV) – A group of teenage girls attempted to set a trap for a 32-year-old man who tried to meet one of them for sex, according to San Diego County sheriff’s officials. According to sheriff’s officials, deputies responded to a reported kidnapping at 1385 East Vista Way in Vista around 2:30 p.m. Sunday. A group of juveniles told responding deputies they used a social media app to contact “an older man who was looking for underaged girls to have sex with. The group hoped to expose the male and turn over the information to law enforcement agencies for prosecution.” Sheriff’s officials said the group made contact with Robert Dreyfus on the app and exchanged text messages. A meeting location was established at a shopping center at 1385 East Vista Way. Officials said that “Dreyfus arrived and convinced the 17-year-old victim to get into his vehicle to talk,” but he then drove away with the girl without consent. According to officials, the girl was able to message her friends for help, and they contacted authorities. Deputies made contact with Dreyfus, and he stopped his vehicle near the 2000 block of East Vista Way. The girl got out of his vehicle and was not hurt, officials said. Dreyfus was arrested by responding deputies and booked into Vista jail on suspicion of kidnapping, sending harmful matter to a minor and communication with a minor for specific offenses. Online, hundreds of groups that set up stings, hoping to expose child predators. “This was really dangerous and something that’s best left to professionals in law enforcement,” said criminal defense attorney Jan Ronis. Ronis said the teens’ actions could complicate the criminal case. “Normally, law enforcement runs these operations. The solicitation is recorded. The coversations, the meeting places are surveilled. This is a bunch of kids.” Dreyfus’ bail was set at 5,000, according to the San Diego County Sheriff's Department's inmate information. He’s due to appear in court next week. 1998

  

WASHINGTON — Vandalism at four downtown Washington churches after rallies in support of President Donald Trump is exposing rifts among people of faith as the nation confronts bitter post-election political divisions. The houses of worship that were vandalized included two historically Black churches where people ripped down Black Lives Matter banners. Video posted to social media showed one banner being burned, defacement that police say is being investigated as possible hate crimes. Rev. Dr. Ianther Mills, the senior pastor at Asbury United Methodist Church, compared the vandalism of the banners to a cross burning in a statement released on Sunday. On Monday, she said she hoped evangelical Christians condemn the vandalism, but added that she didn't want to make her statements about politics.At the Mount Vernon Place United Methodist Church nearby, a banner with colors supporting LGBTQ rights was slashed by protesters.“People need to denounce it and call it an act of racial violence,” Claycomb Sokol told The Associated Press. “People who have been really quick to be silent need to wrestle with what actually took place on our streets on Saturday, and how silence can actually be a sign of support, of complicity.”The vandalism also raised questions among some pastors and members at the churches about why more fellow Christians were not speaking out against the incidents. 1398
