SAN DIEGO (KGTV) — One day after San Diego County allowed dining in restaurants to resume with modifications, Pacific Beach's El Prez was ordered to close for violating county public health orders.Now, the restaurant and bar says it's hoping to reopen sometime next week after passing an health department inspection.Last week, El Prez was the scene of customers ignoring physical distancing and facial covering rules. This facility will remain closed until further notice," Supervisor Nathan Fletcher said at the time. SAN DIEGO (KGTV) - New documents in a search warrant reveal evidence in the investigation of the Poway synagogue shooting during which one person was killed and three were injured. Evidence cited in the documents confirms rumors that have been spread over the last two months surrounding a possible live stream and an alternative chat room site where many alleged John T. Earnest adopted his hateful ideology.The document states, "San Diego Police Department ("SDPD") Officers responded to that location and took John Earnest into custody without further incident. Seen on the front passenger seat was an AR-I5 rifle but no handgun was visible. Additionally, in the vehicle was a helmet with a Go-Pro camera on it."The document later describes the suspect's disposition after officers made contact. "At that time, Earnest did not appear to be under the influence of a controlled substance but did appear to have a 'flat affect' as though he was detached or unaffected by his actions," the document says.The document brings up the manifesto that was the subject of a previous 10News report. "An SDSD system data miner, found a manifesto on Pastebin.com written by a person identifying himself as John Earnest," the document says. "In the manifesto, which he named 'An Open Letter.'"On page six of the document, there is a reference to how Earnest adopted his ideology. "During that interview, he informed an SDSO Detective that he had adopted his ideology of hate for members of the Jewish religion approximately 18 month earlier. Based on my training and experience, I know that there is a process in which someone undergoes adoption of radical ideologies. This process can take several months or several years before a person actually commits to those ideologies. During the interview, Earnest also stated that he was inspired by individuals such as Adolph Hitler and Brenton Tarrant."The document also looks at a Facebook post, from a page investigators linked to Earnest. "Earnest made a posting in which he thought to draw attention to his forthcoming attack on the Chabad of Poway, share his views through his open letter, and offer people the opportunity to observe the attack itself," the document says.The document also contains statements referring to the alternative message board site 8chan, where many believe Earnest adopted a hateful ideology. "Earnest stated in the subject posting, "I've only been lurking for a year and a half, yet, what I've learned here is priceless." This information suggests that Earnest was inspired and/or educated by individuals who commented on his threads."The document explains how hard it is to track users on the site and how easy it is to modify or erase information on the site. For those reasons investigators wanted to keep the search warrant sealed.In attached files, the document shows comments from 8chan users asking "anyone had a decent read of the manifesto yet?" As well as "Anybody not already at least on a vpn [virtual private network] is playing with fire here, don't get yourselves caught before actually making an effort."Earnest will be in court for the preliminary hearing for his state case on August 19. 3182

  

SAN DIEGO (KGTV) — Phone and tuition scams have stole more than 0,000 from the UCSD community since July, university police warn.Police say in just two months, victims within the university community have collectively lost 2,000 to suspects claiming they were with law enforcement in their home country. The scammers would demand money or threaten the victims with detention.In the case of phone scams, scammers would call and pose as an IRA employee or officer claiming to have an open case or, for international students, law enforcement of their home country. International students should refer to their local consulate for any type of government communications.When it comes to reported tuition scams, police say scammers have been targeting students with promises of tuition reduction if they use a third-party service to pay their fees. Scammers often promise a 5% tuition discount and request the victims send the reduced tuition funds. The scammers then request the victim's university credentials to pay their tuition with fraudulent or stolen credit card info. But by the time credit card companies receive the information that the the payment was fraudulent, the scammers have already withdrawn the victims' funds.RELATED: The Venmo scam you should know aboutVictims are then left out of the money paid to scammers and still paying their own tuition.Police say students should never give out their personal information to anyone and work through UC San Diego-approved payment methods. SAN DIEGO (KGTV) - On Monday, San Diego County supervisors met privately to discuss options if the county is moved back into the most restrictive tier.Although the meeting is taking place behind closed doors, it's not stopping them from sharing their frustrations publicly.At a press conference on Monday morning, Supervisor Nathan Fletcher called the actions of two of his fellow board members reckless and irresponsible."Supervisors Jim Desmond and Kristin Gaspar are inciting a fight between government and small business," Fletcher stated. “They are exploiting the pain and suffering the small businesses are going through as a result of the global pandemic as a wedge for political gain."Responding to the statements made at the press conference, Supervisor Kristin Gaspar said that she's never supported an approach to reopening that was not supported by the Public Health Officer and clinical leadership team.In a statement, Gaspar wrote, "Supervisor Fletcher knows this but prefers to continue spreading this false narrative because he is actively running a campaign against me. I measured the distance between our office doors, and it is 7 feet, so he and I can actually have a socially distanced conversation anytime he isn't holding a press conference."The public display of animosity comes as supervisors continue to discuss different options, including taking legal action against the state, to prevent potentially sliding back into the most restrictive risk level.Fletcher is against any potential legal action; Gaspar is for it.A spokesperson from Supervisor Jim Desmond's office said Desmond is weighing the options and waiting to hear any potential ramifications.On Monday, Supervisor Dianne Jacob told 10News, "I will do what is legally possible and where we are on solid legal ground. We do have a good solid legal option here."Jacob said the colleges and universities have a choice whether to allow students back on campus and hold in-person classes. She explained businesses have no choice, and she will fight to keep them open.A spokesperson for Supervisor Greg Cox told ABC 10News they wouldn't comment before the closed-door meeting.Legal actions by citizens and government entities against the state aren't uncommon.ABC 10News has reported on businesses and churches suing Gov. Gavin Newsom.At the end of July, the Orange County Board of Education voted to file a lawsuit against Gov. Newsom and the California Public Health Officer to seek a court order that sets aside the state orders preventing public schools from holding in-person classes and resuming services on campus."There's precedent from before the pandemic and during the pandemic for the county and other local governments to file suit against the state government to try to get the courts to weigh in on who holds the reins," said Lindsay Wiley, Professor of Law at American University Washington College of Law.Wiley said if the county did file a lawsuit, it's likely the courts would defer to the governor based on recent rulings."These cases are unpredictable and there's a fair bit of discretion left to the courts to decide these issues," Wiley said. "It's hard to say much given that we haven't seen what the complaint is that the county might bring but for the most part the general trend has been to uphold reasonable orders of this type." 3346
