(KGTV) - The Vista Unified School District's school board on Tuesday passed new rules for its middle and high schools seeing cases of COVID-19In a special meeting, the school board discussed a staffing issue that’s occurred since reopening for in-person learning last week.There have been at least four confirmed COVID-19 cases within the district. As a result, teachers are being quarantined and school officials say they’re having difficulty finding substitute teachers to fill in.The board unanimously approved a plan that would allow in-person learning to continue as the district addresses the staffing issue. The plan is to use a threshold system to close down some of its middle schools and high schools with positive COVID-19 cases.The details have yet to be hashed out, but in principle, the district's board agreed the new rules would be:-- If one school has two positive cases in a specific time, the whole school would have to switch to virtual learning for 14 days-- If three secondary schools see one case each within a certain period, all three would have to go virtual for two weeksMission Vista High School already has two positive COVID-19 cases, so the district plans to close the school on Thursday and transition students and staff to virtual learning. They plan to notify families and faculty on Wednesday.The new threshold system does not apply to elementary schools.There is one reported case each at Roosevelt Middle Schoo, Alamosa Park Elementary School, Mission Meadows Elementary, and Alta Vista High.In light of the positive cases, at least 400 students and nearly two dozen staff members have been ordered to quarantine. 1672

WASHINGTON (AP) — Defense Secretary Mark Esper said Monday that President Donald Trump gave him a direct order to allow a Navy SEAL accused of war crimes to retire without losing his SEAL status.Esper told reporters at the Pentagon that Trump’s order was the reason he announced Sunday that Chief Petty Officer Edward Gallagher would be allowed to retire with his Trident Pin, retaining his status as a SEAL.Last week Trump had tweeted that he wanted Gallagher to be allowed to retire as a SEAL, but Esper’s comments Monday revealed that Trump had given the defense secretary a direct order to make this happen.Gallagher was acquitted of murder in the stabbing death of an Islamic State militant captive but convicted of posing with the corpse while in Iraq in 2017.In his remarks, Esper also made the extraordinary accusation that Navy Secretary Richard Spencer last week had secretly offered to the White House to rig the Navy disciplinary process to ensure that Gallagher not lose his Trident. Spencer has not responded to requests for comment on Esper’s accusation. However, in a letter Sunday to Trump acknowledging his firing, Spencer gave a different version of his thinking.Spencer said he could not in good conscience follow an order that he believed would undermine the principle of good order and discipline in the military – suggesting that he had been -- or expected to be -- ordered to stop the peer-review process for Gallagher.Esper said he remains concerned, based on the Gallagher case and other trouble with battlefield behavior by the military, that soldiers, sailors, airmen and Marines are not properly and fully trained in ethical standards. He said he had ordered the Pentagon’s legal office to review how the military educates and trains service members on wartime ethics and the laws of armed conflict. The review also will look at how the services monitor, investigate and adjudicate adherence.In announcing Sunday that he had dismissed Spencer, Esper said he acted after learning of Spencer’s secret plan to guarantee the outcome of the Navy SEAL peer-review board that was scheduled to convene Dec. 2 with the goal of recommending whether Gallagher should be allowed to retain his Trident.Spencer had “proposed a deal whereby if the president allowed the Navy to handle the case, he would guarantee that Eddie Gallagher would be restored to rank, allowed to retain his Trident and permitted to retire,” Esper said.This was “completely contrary” to what Esper and the rest of the Pentagon leadership had agreed to, he said, and contrary to Spencer’s public position that the Navy disciplinary process should be allowed to play out with no interference.Esper said he had previously advocated for allowing the Navy peer-review board go forward Dec. 2. But when Trump gave him a “verbal instruction” Sunday to stop the process, he did so.“The commander in chief has certain constitutional rights and powers which he is free to exercise, as many presidents have done in the past,” Esper said. “Again, these are constitutional powers.”Esper did not say explicitly that he disagreed with Trump’s order.Once Trump gave the order, Esper said he responded, “Roger. I got it.”“I can control what I can control,” he told reporters. The president, he said, “has every right” to issue such an order.Esper said he had been “flabbergasted” when he learned at the White House on Friday that Spencer had gone behind his back to propose a secret deal.The White House did not immediately respond to a request for comment.Esper said that when he called the Navy secretary, “he was completely forthright in admitting what had been going on.”The next day, Saturday, Esper called Trump to tell him that he intended to fire Spencer and Trump supported the decision.On Sunday afternoon Esper called Spencer and told him he was being fired. Spencer “took it in stride” and said he would have a resignation letter to him within 30 minutes – “and he did.”In that letter, Spencer made no mention of what Esper called Spencer’s secret deal with the White House.Esper said it was best, under the extraordinary circumstances set in motion last week, that the Gallagher review board not proceed as planned. (KGTV) - The mother of a 14-year-old girl sexually assaulted by a San Diego Deputy filed a civil lawsuit citing negligence and invasion of privacy.Deputy Timothy Wilson pleaded guilty to lewd acts on a minor and two counts of unlawfully taking computer data. He’s serving jail time. The victim’s mother, Jennifer Tanis, says Wilson accessed her daughter’s police file 44 times. He was able to get her home address, videos, and pictures of her daughter. She tells 10News she’s suing the county, not for money, but change. Currently, all deputies are allowed to access police files, but she thinks the only person who should have access to them is the lead investigator.She says the county failed her.“There was no system in place to protect my daughter, her story or the pictures they took of her during the investigation," Tanis said.Tanis is pushing for change not only in the county but the entire country. She reached out to Congressman Mike Levin’s office for help. San Diego County has said they have the capability of making police reports private, but only in some cases. VISTA, Calif. (KGTV) - Neighbors in the 700 block of Lemon Avenue in Vista say they were stunned as they watched a landlord pull out a pistol and start shooting at his tenant.Neighbors tell 10News there have been screaming matches at the home in the past. They say the landlord had been trying to evict a tenant who was living in the garage. The neighbors did not wish to share their names out of fear for their family's safety.The watch commander said they received a 9-1-1 call around 6 p.m. when the first shot was fired. Deputies arrived and investigated, then left when they couldn't find the landlord.Around 7:50 p.m. the landlord returned and, according to the watch commander, fired several shots at the tenant.Neighbors said it sounded like fireworks. They said they saw the landlord cocking his pistol, they believed it jammed.A video provided to 10News by neighbors shows deputies with rifles drawn approaching the home.They arrested the landlord and his associate.Details on the man, the associate, the tenant and the charges are not currently known. 1070

  

WASATCH COUNTY, Utah — A man has been arrested and charged after police say he threw his wife into the Provo River in Utah on Sunday.According to an arrest report, 61-year-old Douglas Harold Green and his wife were at the Provo River Resort, located just downriver from Deer Creek State Park in Wasatch County, when they began arguing over dinner arrangements.Police say Green became angry and threatened to drown her in the river. He then dragged her to the bank of the Provo River and forced her in, the probable cause statement says.Witnesses said they tried to help her, but Green yelled at them to stay away.Police said the woman had a bruise on each arm, which she said were from Green dragging her. It was not made clear if she sustained further injuries, how long she was in the river or how she got out.Green was arrested and held without bail after a judge in the Heber District Court ruled that releasing him "would constitute a substantial danger to an alleged victim of domestic violence."He has been charged with aggravated kidnapping, a third-degree felony, and assault, a class-B misdemeanor.This story was originally published by Spencer Burt at KSTU. 1176
