Companies are using some pretty sneaky tactics to make you think you're getting more than you actually are when it comes to buying things like cosmetics. But are they breaking rules?U.S. consumers spent billion in 2017 on cosmetic products.  Makeup enthusiast Alex Langer says she’s never really paid close attention to the amount of product inside the fancy cosmetic bottles."Unless you're a mathematician, you don't know what that really is," says Langer. The NOW’s investigative team looked at some popular brands and found some tricky packaging that seems misleading. (Disclaimer: we are not mathematicians)"I think that there is an ethical issue with trying to convey that there is more in that package than there really is," says marketing expert Darrin Duber-Smith.The NOW looked at two different oils from Olay products. One actually had more product than the other. The company is using what marketers refer to as "downsizing," which started a decade ago."You can make your package thicker, and that way it holds less stuff,” explains Duber-Smith. “You can put a false bottom or a thicker bottom at the bottom…you can fill it, not all the way to the top."Another product from e.l.f. looked as if it was full of product, but when you start unscrewing things and pulling if apart, you learn quickly that looks are very deceiving."Competitors have to kind of have larger packages in order to convey the perception that there's more and more product in there," explains Duber-Smith.Companies, however, cannot lie about the amount on the product’s label. The companies are required to be precise about what’s included on labels and the product amount is included."We have labeling requirements,” explains Duber-Smith. “We have regulatory agencies that do oversee these things."Packaging can change your perception dramatically. Each bottle of foundation we looked at differed in design, but the amount in the bottles were the same."I would agree completely that it's very misleading to consumers,” Duber-Smith says. “And my feeling is that if your intent is to deceive you have an ethical issue."So before you purchase your next beauty product, pay attention and make sure you are checking the labels; don't be deceived by pretty packaging. 2264

COLUMBUS, Ohio — Border Patrol agents detained an Ohio woman for eight hours and falsely accused her of human smuggling. The woman said she and her husband were leaving a funeral in California when agents stopped them at a checkpoint. For nearly 40 hours, Reina and her husband made the 2,000-mile drive from their home in Columbus, Ohio to Calexico, California. The couple was taking in the scenic views state-by-state, "Ohio, Missouri, Indiana, Oklahoma until we got to California," recalled Reina. The two were attending a funeral in the border city for a family friend. However, the quick trip would turn into a frightful and long ordeal, Reina said. She would eventually be left stranded in the California desert."I said 'I'm in trouble, I have to find my way home,' " said Reina. Her troubles all began on their way home. Reina and her husband were driving up Highway 86 when they came across a toll-like booth under a white canopy. It was a Border Patrol checkpoint near the Salton Sea."I don't know if it's because we have out-of-state tags or because of what we look like, but he asked us what is our citizenship," Reina recounted. "I answered, then they asked my husband."Reina, an American of Puerto Rican descent, handed agents her passport, but it wasn't so simple for her husband. He is an undocumented immigrant from Honduras, and without the proper papers, agents detained Reina's husband and then shifted their attention to her."And he said 'Take off your jewelry.' I said 'Why?' He said, 'Cause you are being arrested.' I said, 'For what?' he said 'For smuggling,' " said Reina.Agents were accusing her of traveling to the border to smuggle her husband into the United States."He said 'You came here and picked up your husband, didn't you?' " recalled Reina.Reina said she insisted she had proof the two traveled together. She had hotel and gas receipts detailing their journey. But agents booked and fingerprinted Reina and placed her in a locked holding cell."It is freezing like an icebox in there," she said. "The benches are aluminum. The toilet is stainless steel, and there is a camera in the corner watching you."Minutes turned to hours before Reina said she was taken in for another round of questioning."He said, 'Oh I didn't know you were still here; they forgot about you,' " said Reina.           The U.S. Attorney's office decided against charging Reina with smuggling. Only then was she free to go, after sitting in that cell for eight hours."I felt violated. I felt betrayed because I was an American and I have my own rights," said Reina. She was then left to find her own way home since Border Patrol agents confiscated the couple's rental car. Reina said agents dropped her off at a truck stop a few minutes up the road close to midnight. She said a manager there drove her an hour to the nearest airport. That is where she booked a 9 plane ticket home.WEWS reached out to the United States Border Patrol. They said agents followed the protocol for when someone is suspected of "alien smuggling." They also say when a person is released, it is up to them to get a ride or agents will take them to a nearby public place. 3227

Consumers can consider many factors when evaluating an airline, but getting you where you’re going on time, not losing your checked bag, and giving you no reason to lodge a formal complaint seem like decent baselines.Fortunately, the government requires the nation’s largest dozen commercial airlines to report statistics on just those things. The Air Travel Consumer Report, released by the Department of Transportation, measures not only performance of major U.S. airlines such as American Airlines, Delta Air Lines and United Airlines, but also regional carriers such as ExpressJet and SkyWest, which are contracted to fly short routes to and from hubs of those big airlines. Here’s how airlines measured up in 2017, according to the report.On-time rates 784

College campuses across the country have largely sat empty for months, but as schools consider whether to bring students back, they're also considering their legal obligations.“They are a business that needs revenue to function,” explained Chris Feudo, an attorney with Foley Hoag in Boston, Massachusetts. As an attorney, Feudo has been advising folks about COVID-19 waivers, which gained national notoriety leading up to President Donald Trump’s rally in Tulsa last month. Businesses have also been turning to these forms in hopes of freeing themselves from legal responsibility if someone catches the virus. The next round of waivers could be coming from colleges and universities, and many have already mandated student-athletes to start signing the forms in order to start practicing. Students returning to empty campuses could be next.“It sends a really dangerous message,” Feudo said. “If you’re saying to your employees, faculty, students, it’s sending a message that the college or university is bringing people back when there’s still a substantial risk.”A COVID-19 waiver could mean a family loses any right to seek compensation if a student gets sick at school. But Feudo is skeptical any of these waivers will hold up in court.“You’re not going to find out whether it’s enforceable until somebody gets sick and sues,” he said. 1344

Cyberbullying among kids related to the election is a growing problem right now. And with how divisive things are, there are concerns this won't be going away after the polls close next week.“This is a very, very polarizing and almost even more in front of kids’ faces, election than any other time in history,” said Titania Jordan with Bark Technologies.Bark Technologies currently monitors more than 5 million kids online at home. Its monitoring shows from mid-August to the end of September, there was a 25% increase in bullying overall from the beginning of July. And there was a 220% increase in severe bullying. You'd expect to see this with the start of the school year, but the numbers show this is about a 50% increase from what Bark typically sees over this period. They say the feedback they've received from parents supports the increase with a direct tie-in to election-related cyberbullying.“It’s not something that she gets to judge over or bully over or make people feel bad about,” said Kathryn Noble, whose daughter was impacted by cyberbullying. “That's not acceptable at any age but especially at 13.”Noble says her 13-year-old daughter recently blocked one of her friends on social media over them supporting a different candidate than her.Bark found around 45% of what kids are sharing is memes about the two candidates. They've found this month that messages including the word “Trump” are being flagged more frequently for depression, hate speech and weapons.Messages including the word "Biden" are being flagged more frequently for cyberbullying, because they include disparaging or belittling language.“They're being bullied even because of maybe something their parents have said or something their family says,” said Matt McKee at Bark Technologies. “Hey, this is where we stand right now and because of that, kids are being brought into those situations.”As far as addressing this cyberbullying, the tech experts we talked with say asking your kids to teach you about a certain app they are using will give you more insight into what's happening earlier.Things to watch for include changes in sleep patterns or behavior. They also say now is really the time to encourage empathy with your kids. 2229
