SAN DIEGO (KGTV) — Four San Diego businesses, including two restaurants and two gyms, have filed a lawsuit seeking an emergency injunction to stop the latest shutdown orders.Under the red tier, both sectors were open for indoor operations as limited capacities. Restaurants were allowed to serve people inside at 25 percent of the normal capacity, and gyms at only 10%.On Saturday, purple tier restrictions will go into effect, meaning businesses like restaurants and gyms must shutdown indoor services completely and move outside.Cowboy Star Restaurant & Butcher Shop, Home & Away Encinitas, Fit Athletic Club, and Bear Republic filed the lawsuit against California Gov. Gavin Newson and the County of San Diego, as well as other state and county officials arguing that the closures go against their rights.The lawsuit states that Newsom and the California Department of Public Health (CDPH) lack the authority to impose the continuing restrictions on California businesses.All four businesses detail the numerous health and safety measures they’ve added to provide a safe environment for staff and customers during this pandemic.“I think it’s pretty clear that the law is on the side of governmental authority to try to get this under control,” said Jan Ronis, an attorney with the Law Offices of Ronis & Ronis. “Why they continue to file lawsuits… it’s beyond me.”Ronis is not involved in this case, but said when the pandemic began, he reviewed emergency legislation available to the government at both state and federal levels.“These laws have been in the book for decades, and governments have used them sparingly, and quite frankly think they’re valid as surprised as I was by the breadth and scope of government authority once these emergency declarations are declared,” said Ronis.He said he had seen similar lawsuits filed across the state during the last several months, and most don’t hold up in court.“I really feel sorry for the businesses, but the fact is this is a monumental health crisis,” said Ronis.Dr. Wilma Wooten, San Diego County’s public health officer, recently asked for the CDPH to allow the county to stay in the red tier. She explained that businesses that would be impacted the most by purple tier restrictions, like restaurants and gyms, are not the cause for the local increase in COVID-19 cases.The lawsuit said despite the data provided by Dr. Wooten, the CDPH still denied the request without any justification based on science or data.Both the law firm that filed the lawsuit and the County of San Diego refused to comment on this matter, stating they do not comment on pending litigation. 2646
SAN DIEGO (KGTV) — For the fourth consecutive year, the USS Champion has won a contest held between ships at Naval Base San Diego over which crew could put together the best decorations."It's just a great opportunity for the crew to really come together, enjoy some time not focusing on the day to day, but to really express themselves," said the ship's commanding officer, Lt. Commander Matthew Yokeley.The Champion, an Avenger-Class Minesweeper, was covered in decorations. Lights, bows, and bells lined the railings and were struck all the way to the top of the mast. Giant inflatables were mounted on the deck, along with a Christmas tree. The lights were synchronized to flash with a holiday music show.This is a big deal for us. Christmas lights are pretty competitive," said Petty Officer Pierce Cloninger. "We like to win. They don't call us Champion for nothing." 880
SAN DIEGO (KGTV) - Finding a place to live is about to get easier for low-income San Diegans.Right now, landlords are not required to accept tenants who receive Section 8 rental assistance. However, in August 2019, a new amendment to San Diego's source of income ordinance will prevent landlords from declining a tenant-based only on the household receiving rental assistance."It's safe and everything is right across the street from me," said Maria Hernandez.That's how Maria Hernandez describes her neighborhood in Poway.Maria uses the Section 8 voucher program to help pay the rent. She says she waited about five years for that help."You know without Section 8, I don't know where me or my daughter would be," Hernandez said.Hernandez is lucky. Her landlord accepts Section 8. That's not always the case."I guess there's like that stereotype of people that are on Section 8, you know they think people are going to destroy their homes that people are poor who live on Section 8."Starting August 1, 2019 landlords and property managers in the City of San Diego cannot refuse an application from a prospective tenant, charge a higher deposit, or treat them differently in any other way based on their source of income.According to the San Diego Housing Commission, under the new ordinance, landlords and property managers cannot advertise or state a preference for certain sources of income. The tenant must still meet other requirements for tenancy and have the financial resources to pay any rental amounts not covered by the voucher/subsidy. Landlords and property managers must include any rental payments made by the voucher/subsidy when determining whether the applicant meets the minimum income requirements. Landlords and property managers may ask what an applicant's source of income is as long they do not discriminate based on that information."I want to give an equal treatment to every single San Diegan," said San Diego City Council President Georgette Gomez. "No matter how you're going to pay your rent, everyone should be looked at as an equal applicant."Gomez championed the changes to the city's law. She says for some it could be life-changing, allowing renters to choose what part of town they live in not just who accepts their form of payment."It's not just about housing, but better jobs and just an ability to not have that stress," Gomez said.The anti-discrimination policy is just one move making things more comfortable in San Diego.According to SDHC, "Effective July 1, 2019, SDHC increased its payment standards for the Section 8 Housing Choice Voucher rental assistance program, which helps more than 15,000 low-income households pay their rent. Raising the "payment standard" expands rental opportunities for families by allowing them to consider housing units with higher monthly contract rents, which are paid by a combination of rental assistance from SDHC and a portion of the tenants' income."Also, starting in August, the SDHC will launch the Landlord Partnership Program, which provides incentives to landlords to rent housing units to SDHC Section 8 Housing Choice Voucher rental assistance participants. SDHC tells 10news it will expand the Landlord Services Team, composed of specialized staff, to provide quality customer service to landlords and support families in the move process to ensure timely lease-ups.The agency also launched The Landlord Advisory Committee to identify best practices, programs, and incentives to attract new landlords to the Section 8 Housing Choice Voucher program. SAN DIEGO (KGTV) - Driving under the influence arrests have dropped noticeably in cities where ride sharing programs have expanded, a new study says.An analysis performed by Moll Law Group and the University of California says DUI arrests in San Diego dropped 32% from 2015 to 2016.The study also looked at four other major cities with declines in California: 28% in San Jose, 26% in Sacramento, 14% for Los Angeles and the San Francisco-Oakland area.“We still seeing quite a few impaired people, they’re just not sitting in the front seat,” said Mark McCullough with San Diego Police Department’s traffic division.McCullough says the declining trend began a few a years ago when more new forms of transportation became available.“Five years ago we’d run a DUI checkpoint on a Friday night and we’d arrest 20 people and up,” said McCullough, “now on any given Friday if we arrest 10-15 people that’s a busy night for us.”Experts believe there may be other reasons behind the figures declining, but it’s still a number they don’t mind going down.“You’re not using your brain to your full potential if you get arrested for a DUI,” said McCullough, “there are just so many forms of alternative transportation.” 1225
SAN DIEGO (KGTV) — Heavy rains and wind across San Diego County hit one Coronado business particularly hard.The Coronado Tree Farm had only been open for about a week before Thursday's Grinch of a storm rolled through the area, heavily damaging the small farm at the ferry landing. The farm posted on Facebook that it would have to close for the season, before it could fully deliver some Christmas joy."Sad to say that the Tree Farm has to be closed down," the farm wrote. "The rain destroyed all our inventory and commercial props, generator, hay, games, prizes, tables, fencing, tents etc... We would have to start all over again in order to run it."Steve Albert, co-owner of the Coronado Flower Lady, told 10News they tried to curtail any damages but the weather simply took hold."I started trying to get everything I could under the big tent, and while I was doing that, one would break lose, and then another one," Albert said. "The whole thing is just kind of anchored together. The whole thing just went."Some of the trees and decorations are in good condition and will be offered up to anyone.
