VISTA, Calif. (KGTV) — The jury deciding former NFL star Kellen Winslow Jr.'s fate in a rape trial, sent a note to the judge asking two questions.The questions lending a window into what's happening as the jury continues deliberating.10News spoke with Defense Attorney Gretchen Von Helms, to gain insight.On the surface, the questions seem obvious: "The jurors could benefit from an explanation as to what being under oath means. Additionally, how we should follow the law and not what we think the law should mean."RELATED: Kellen Winslow Jr. rape trial: More accusers set to testify"Every fourth-grader knows what under oath is and so also, should we follow the rules? Yes, you're supposed to follow the law," Von Helms said.She said the note made her think the jury was not agreeing, "the jury's trying to be nice here and say there's one person who just doesn't want to follow the rules, that's what it sounds like."The first question, she said, could indicate questions the jurors have, "sometimes police officers have to take an oath to be a police officer and maybe they feel that the police officer didn't do their job and follow up correctly or maybe they feel that their definition of that oath is different from the jurors oath."In regards to the second question, she said "the gut versus law issue, they must follow the law, even if they don't like the defendant, even though some people may not want to convict him because he's a football legacy, you can't do that. You have to look at the evidence and make a determination, is there enough?"RELATED: Accusers set to testify in Kellen Winslow Jr. rape trialVon Helms said the most important take-away from the note and the time spent during deliberations is that it appears the jury is taking the case very seriously.She said the prosecution's job is to lay out the evidence so clearly that the jurors have no doubt on the verdict.She added, the more time they take to come to a decision, the more reasonable doubt there may be.Winslow faces three counts of felony rape, misdemeanors of sexual misconduct among other charges. 2096

VISTA (CNS) - A homeless man accused of fatally stabbing a fellow transient outside an Escondido fast-food restaurant was ordered today to stand trial on a murder charge.John Christopher Burns, 48, is accused of stabbing Jose De Jesus Martinez in the neck shortly before 6:30 p.m. on Jan. 27, outside the Burger King on West Valley Parkway.According to preliminary hearing testimony, witnesses said Burns made statements indicating he believed the 32-year-old victim was trying to steal his bicycle, which had been left outside the restaurant.Martinez was taken to Palomar Medical Center, where he was pronounced dead, according to the Escondido Police Department.Burns was arrested by San Diego County sheriff's deputies at the Pala Casino one day after Martinez's death.He's due back in court Sept. 2 for a Superior Court arraignment. 844

Walmart has announced which of its stores will be hosting free drive-in movies as part of a nationwide tour later this summer.Earlier this year, Walmart announced that it would transform the parking lots of 160 of its stores around the country into contact-free drive-in movie theaters.On Wednesday, the retail giant announced more details about the showings, including the dates, times and locations of the showings.In a press release, Walmart announced each location would be showing one of nine movies: "Wonder Woman," "Spy Kids," "Space Jam," "Spider-Man: Into The Spider-Verse," "Ghostbusters," "The Wizard of Oz," "Black Panther," "E.T." or "Friday Night Lights." Movie choices will vary by location.Tickets to the screenings are free, but must be reserved in advance to ensure parking lots aren't overcrowded. Tickets are given out per car, and cover "as many people as you have seatbelts in your car."Tickets will be available by clicking here beginning at 5 p.m. ET on Wednesday.For all showings, gates will open at 6 p.m. local time, and the films will begin at 7:30 p.m.To ensure proper social distancing, guests will be required to remain in their cars during the showings. WASHINGTON (AP) — Defense Secretary Jim Mattis says he plans to visit the U.S.-Mexico border, where troops are helping erect barriers and performing other tasks in support of border security.Mattis gave no details in a brief comment to reporters Tuesday, but ABC News sources said he would be in Texas.About 5,800 active duty troops are assigned to the border mission.
