SAN DIEGO (CNS) - A Catholic priest who oversees churches in four California counties, including San Diego, is suing Gov. Gavin Newsom and 19 other state, county and municipal officials, alleging COVID-19 restrictions on places of worship are unconstitutional.Father Trevor Burfitt contends in his court papers that public health guidelines restricting worship activities are ``no longer warranted'' and ``causing far more harm than good.''Among the restrictions contested by Burfitt are bans on indoor worship, occupancy restrictions, social distancing requirements -- which ``precludes proper conduct of Catholic worship'' -- and face covering mandates, which ``not only radically interferes with Catholic worship in numerous ways but irrationally threatens individual health...,'' according to his 77-page complaint filed Sept. 29 in Kern County Superior Court.RELATED: In-Depth: Answering legal liability questions about coronavirusDefendants named in the suit include Newsom, California Attorney General Xavier Becerra, San Diego County Public Health Officer Dr. Wilma Wooten, San Diego County Sheriff Bill Gore and San Diego Police Chief David Nisleit. The suit also names officials in Los Angeles, Kern and San Bernardino counties, where Burfitt also oversees mission churches. Burfitt is the prior of Saint John Bosco Mission in San Diego, according to the complaint.Since the pandemic began, similar lawsuits have been filed by religious leaders and institutions across the state, including South Bay United. Pentecostal Church in Chula Vista, which challenged the state's restrictions on church attendance in a case that went before the Supreme Court in May and was rejected 5-4.Like many of the other lawsuits, Burfitt challenges places of worship's status as ``non-essential'' and alleges Newsom has arbitrarily deemed other businesses and industries as critical.Paul Jonna, one of Burfitt's attorneys, said in a statement, ``It is now beyond reasonable dispute that, absent judicial intervention, Governor Newsom intends to continue indefinitely a massive and baseless suspension of the constitutional rights of Father Burfitt and nearly 40 million other residents of the state of California.``He continues to levy strict limits or outright prohibitions on public and private worship activities, which continue to be designated as `nonessential,' while liquor stores, marijuana dispensaries, and the Hollywood movie industry are allowed to operate unhindered. California's residents are apparently expected to live their lives behind makeshift `face coverings' while maintaining an arbitrary distance of six feet from everyone they encounter outside their homes. And to complete Newsom's despotic mandates, anyone who declines to obey faces criminal and civil penalties. This is unconstitutional and a blatant violation of the rights guaranteed by California's constitution.'' 2897

SAN DIEGO (CNS) - A former Navy police officer who engaged in sexual acts with a 14-year-old Oceanside girl after convincing her on social media to send him sexually explicit photos, was sentenced 20 years in federal prison Monday.Isaiah Smallwood Jackson of Vista was convicted last fall of sexual exploitation of a minor and enticement of a minor after he convinced the girl to send him nude photos, then meet for sex outside her home. He was 21 at the time and is now 23.Following his prison term, Jackson will be on supervised released for 10 years and will be required to register as a sex offender, which will preclude him from initiating contact with minors, loitering in places primarily frequented by minors, or using the Internet unless the device can be monitored by U.S. probation officers.RELATED: Jury convicts man of using social media to convince 14-year old to have sex with himProsecutors say Jackson met the girl on an app called "Spotafriend." Her online profile indicated she was 14 years old, yet when she asked Jackson if it was bad that she still wanted to "cuddle" with him, he told her, "Not at all, is it bad that I don't care about your age?" according to court documents.The two continued talking over text messages, during which he attempted to persuade her to meet up with him for sex, despite her stating she was nervous and unsure if they should meet.Jackson responded by telling her, "Please I'm dying to see you."When she said, "I know it's hard to say yes because I only known you for 2 days over the phone," Jackson responded, "Take a leap of faith?" according to court documents.Eventually, he went to the girl's home, where they engaged in sexual acts outside the house.After he left, the victim told her sister, who contacted police. Oceanside police officers arrested Jackson four days later. 1841

  

SAN DIEGO (CNS) - A 52-year-old man was struck and gravely injured Sunday in a San Diego trailer park, and the motorist who hit him in a stolen Hummer was arrested.The incident began just after 11:10 a.m. when the San Diego police received a call from Chula Vista police who were involved in the pursuit of the stolen Hummer, SDPD Lt. Andra Brown said.The Hummer was snatched from a RoadOne impound yard in Chula Vista, SDPD Lt. Bryan Brecht told the media.The vehicle initially crashed at a gas station at 1400 Melrose Ave. in Chula Vista, but continued evading police south on Interstate 5, exiting into a trailer park at 1600 Palm Ave., Brown said.Officers tried to stop the driver but he sped away and hit the pedestrian, Brown said. It appeared the collision was intentional, Brown added.The 44-year-old driver was eventually taken into custody with help from a K-9 dog deployed to stop him, Brown said. The driver was taken to a hospital for treatment of minor injuries before being taken into custody. His name was not immediately available.The victim suffered severe trauma and was unresponsive when paramedics transported him to a hospital, Brown said.Because of the severity of the pedestrian's injuries, the case was being investigated by the SDPD's homicide unit, she said.Anyone with information on this crash was asked to call the homicide unit at 619-531-2293 or Crime Stoppers at 888-580-8477. 1417

  

SAN DIEGO (CNS) - A 28-year-old man was behind bars Friday on suspicion of stabbing his girlfriend multiple times inside a Colina Del Sol apartment, police said.Dispatchers received multiple calls shortly before 10 p.m. Thursday from neighbors who reported hearing screaming coming from one of the apartments in a complex on 49th Street just south of El Cajon Boulevard, San Diego police Officer Tony Martinez said.Officers responding to the scene found that a woman had been stabbed multiple times and the suspect had fled, Martinez said.The victim, whose age was not immediately available, was taken to a hospital for treatment of her wounds, which were not believed to be life- threatening, the officer said.Around 10:35 p.m. Thursday, the suspect apparently called 911 and told a dispatcher his location, and that he was going to surrender, the San Diego Union-Tribune reported.The 28-year-old man, whose name was not immediately available, was taken into custody around 10:45 p.m. on El Cajon Boulevard near El Cerrito Drive, Martinez said. 1053
